THE FIRST IS AN INQUIRY INTO THE NATURE OF THE DEVELOPMENTS PLANNED FOR THE ORA MAE HOARN DISTRICT PARK.

AT THE POOL, WE HAVE BEEN TOLD TO SAY THAT WE ARE EXPECTING A SORT OF FACELIFT TO THE PARK, AND I'M HOPING THAT I CAN GET A FEW MORE DETAILS ABOUT WHAT THAT MEANS.

THE SECOND WAS BROUGHT ABOUT BECAUSE A NUMBER OF THE PATRONS OF THE POOL HAVE ASKED TO START A PETITION TO KEEP THE CURRENT POOL IN OPERATION AS A MEMBER OF THE COMMUNITY.

I KNOW WHEN SOMEBODY COMES BEFORE THE COUNCIL, YOU CAN'T ANSWER THEM, BUT, MY GOD, IT'S BEEN EIGHT MONTHS NOW AND I HAVE NOT GOT A RESPONSE. WHAT'S GOING ON? YOU'RE SUPPOSED TO RESPOND TO PEOPLE WHEN THEY COME AND TELL YOU OF A NEED.

YOU EITHER SAY, YES, WE CAN HELP YOU OR NO, WE CAN'T.

THE DAV, IT WAS FORMED IN 1920 OUT OF NECESSITY.

PURPLE HEART STANDS FOR A DISABILITY.

WE SEE APPROXIMATELY 150 VETERANS A MONTH, AND WE DO THEIR PAPERWORK AND NO COST, AND IT'S GETTING TO THE POINT WE'RE PROBABLY GOING TO HAVE TO CLOSE DOWN THE CHAPTER FOUR, AND THEN WHERE ARE THESE PEOPLE GOING TO GO TO? ALL WE'RE ASKING IS FOR YOU TO PAY THE RENT, AND I GAVE EACH COUNCILMEMBER, I GAVE THEM THE CONTRACT THAT WE SIGNED FOR FIVE YEARS, AND YOU GOT THE AMOUNT OF RENT.

SO IF THIS COUNCIL DOESN'T WANT TO HELP US, IF WE GO DOWN, YOU'RE GOING TO HAVE ALL THESE WIDOWS COMING TO THE COUNCIL SAYING, WHY DIDN'T YOU HELP AN ORGANIZATION THAT EXISTED? WE WANT YOUR HELP, PLEASE.

YOUR BUSINESS COMMUNITY, CITIZENS SUPPORT OF VETERANS AND VETERANS ISSUES HAS LED TO NUMEROUS VETERANS OBTAINING HELP FOR DISABILITIES.

PTSD ISSUES, FINANCIAL PROBLEMS, AND HOMELESSNESS.

THANK YOU FOR YOUR COMMUNITY FOR HELPING VETERANS AND THEIR FAMILIES DURING THE TIME OF NEED, AND MR. MOORE, OUR ADJUTANT.

HE WAS THE FIRST DISTRICT WEBMASTER WITH SCHOOL DISTRICT WEBMASTER, SO HE'S BEEN AROUND A WHILE TOO, BUT I'D LIKE TO SAY A COUPLE OF THINGS, IF YOU'LL FORGIVE ME. I CAME TO MARANA IN 1974, AND A BLOCK FROM HERE, THE YAQUI VILLAGE KIDS LIVED ON DIRT FLOORS.

THE BIG FARMS. MR. KAI, ONE OF HIS FARMS. THERE WERE A FEW HOUSING DEVELOPMENTS, BUT THERE WASN'T MUCH.

IT WAS A GREAT COMMUNITY, AND IT ALWAYS HAS BEEN A VERY SUPPORTIVE AND SUPPORTIVE AND CONSERVATIVE, AND THEY CARE ABOUT VETERANS AND VETERANS NEEDS.

I PERSONALLY HAVE HAD I CAN'T TELL YOU HOW MANY YOUNG MEN AND WOMEN I HAD IN CLASS, AND WHAT KILLS ME IS SOME, LIKE MR. POST, HAVE RETIRED AND BUT HAVE BEEN IN THE SERVICE AND THEY LIVE IN THIS AREA, BUT THE MAIN AREA HAS ABOUT 70,000 VETERANS, AND THIS IS THE MOST SUPPORTIVE COMMUNITY THAT THERE'S EVER BEEN, AND IT'S BEEN THAT WAY THAT I KNOW OF SINCE 1974 BECAUSE OF FAMILIES LIKE THE CAYCE, THE WONGS, THE POST, THE MARANA STOCKYARD, THE POTTERS.

YOU KNOW, I CAN'T NAME THEM ALL, BUT THIS TOWN IS SUPPORTIVE OF VETERANS, AND WE APPRECIATE IT AND THAT IS ONE OF THE REASONS WHY I THINK THAT THIS IS APPROPRIATE FOR THIS TO BE A PURPLE HEART TOWN, AND YOU AGREE, OBVIOUSLY, BECAUSE YOU'RE GOING TO RENEW THE PROCLAMATION, AND I JUST LET YOU KNOW ABOUT THE MILITARY ORDER OF THE PURPLE HEART CHAPTER 442.

LIKE I SAID, THERE ARE ABOUT 70,000 VETERANS IN THE TUCSON AREA.

IN OUR CHAPTER, WE HAVE ABOUT BETWEEN 100 AND 200 VETERANS STILL LIVING.

OUR ORGANIZATION IS A SHRINKING ORGANIZATION, NOT LIKE ALL THE OTHER SERVICE ORGANIZATIONS THAT TAKE CARE OF VETERANS.

WE SHRINK, AND YOU KNOW WHY? BECAUSE WE'RE DYING OFF AND WE'RE GETTING OLDER, BUT WE'VE DONE A LOT.

WE'VE DONE A LOT OF GOOD THINGS FOR VETERANS.

THIS ORGANIZATION HAS RAISED ABOUT $700,000 IN IN TEN YEARS.

NOW THROUGH FIRST IT STARTED WITH OUR PURPLE HEART GOLF CLASSIC.

WE CAN'T DO THAT ANYMORE BECAUSE ALL THE ACTIVE MEMBERS ARE HERE, AND THAT'S NOT ENOUGH TO RUN A PURPLE HEART GOLF TOURNAMENT, AND SO WE GO AROUND AND WE REQUEST AND GET DONATIONS, AND SO THAT'S ONE THING TO THINK ABOUT.

SO BUT WE WITH WE DON'T HAVE WE DON'T HAVE SALARIES, WE DON'T HAVE BUILDINGS, WE DON'T HAVE ANYTHING.

WE RAISE MONEY AND HELP VETERANS.

WE KEEP MOMS AND KIDS IN THEIR HOUSE.

WE HELP PCC VETERANS STAY IN SCHOOL AND HELP THEM, AND WE YOU CAN'T BELIEVE HOW MANY PCC VETERANS, PIMA COMMUNITY COLLEGE VETERANS ARE IN NEED OF HELP, AND WE HELP THEM ALL THE TIME AND WE HELP AT CHRISTMAS TIME AND THANKSGIVING, AND THEN WHEN A VETERAN IS IN NEED OF HELP, WE'RE THERE.

WE GIVE THEM MONEY OR WHATEVER THEY NEED, AND LIKE I SAID, WE'VE KEPT FAMILIES IN THEIR HOMES, WE HELP OTHER SERVICE ORGANIZATIONS.

THIS IS NOT A DONE DEAL OR ANYTHING, BUT IT'S A PHENOMENAL ORGANIZATION THAT IS TRYING TO ELIMINATE RECIDIVISM FOR PEOPLE GETTING OUT OF THE PRISON SYSTEM.

THEY EDUCATE THEM.

THEY HELP THEM FIND JOBS, AND THEY DO ALL THAT KIND OF STUFF.

SO IT WAS A VERY REWARDING MEETING THIS MORNING.

I MEAN, THAT'S ALL THEY HAVE SO FAR.

LET'S SEE. MR. ROZEMA AND I MET WITH GENERAL MAXWELL, THE CHAIRMAN OF THE RTA, AND TALKING ABOUT THINGS WE'RE DOING AT THE RTA. IT'S A BUMPY ROAD, FOLKS, YOU KNOW, AND WE'RE TRYING TO GET SOMETHING DONE THAT WILL HELP THE ENTIRE REGION, BUT WE'RE ALSO NOT WANTING TO DO SOMETHING THAT WILL HALF CENT SALES TAX THE TOWN OF MARANA MIRANDA CITIZENS FOR 20 YEARS.

IF WE DON'T GET A BENEFIT LONG TERM OUT OF THAT.

SO HAD THE PRIVILEGE OF GOING TO THE RITZ FOR KIND OF A BREAKFAST WITH THE NEW TEACHERS IN MIRANDA SCHOOL DISTRICT, THERE WERE 85 OF THEM, AND I GOT A CHANCE TO ADDRESS THE GROUP ALONG WITH SOME OTHER PEOPLE, AND, YOU KNOW, IT WAS REALLY INTERESTING.

I SAID, I LOOK AT A LOT OF THOSE TEACHERS AND I THINK THEY SHOULD BE IN HIGH SCHOOL, NOT TEACHING, BUT I AM GETTING OLDER AND IT WAS REALLY REWARDING AND A GREAT EVENT. WENT TO THE LEAGUE OF CITIES FRIDAY AND TALKING ABOUT DIFFERENT THINGS THAT ARE GOING ON IN OUR STATE.

THERE'LL BE SOME CHANGES IN THE LEGISLATURE THIS NEXT LEGISLATIVE SESSION, AND WE DON'T KNOW WHAT'S GOING TO GO ON.

I CAN TELL YOU THE LEAGUE IS LOOKING AT GETTING OUT IN FRONT OF SOME OF THESE ZONING THINGS THAT HAVE COME UP, YOU KNOW, BASICALLY TO WHERE YOU HAVE NO CONTROL OVER ZONING AND, YOU KNOW, A LOT OF PEOPLE ON ONE SIDE ARE LOOKING FOR AFFORDABLE HOUSING, AND ON THE OTHER SIDE ARE LOOKING FOR BUILDING MORE HOUSES ON THE PROPERTY THEY HAVE.

SO, YOU KNOW, YOU KIND OF GET IT FROM BOTH SIDES, AND I CAN UNDERSTAND BOTH OF THOSE.

MAYOR, VICE MAYOR, MEMBERS OF COUNCIL OUR SINGLE FAMILY RESIDENTIAL UPDATE.

WE HAD 108 FOR THE MONTH OF JULY AND 74 IN 2023.

SO STILL KEEPING AHEAD OF PACE FROM WHERE WE WERE LAST YEAR, AND OBVIOUSLY ENTERING THE NEW FISCAL YEAR IT HAS BEEN A MONTH SINCE WE LAST MET, AND DURING THAT TIME WE DID HAVE A ONE OF OUR MAJOR EVENTS, THE STAR SPANGLED SPECTACULAR.

IT WAS INDEED SPECTACULAR, ATTENDED BY SOMEWHERE BETWEEN 8 AND 10,000 PEOPLE.

REALLY SAFE EVENT POLICE DEPARTMENT PARKS AND RECS STREETS.

ALL THE TEAM DID JUST A PHENOMENAL JOB OF PUTTING ON THAT EVENT AND AGAIN, WAS VERY POPULAR WITH OUR COMMUNITY.

JUST A COUPLE OTHER PROJECT UPDATES, THE CAL PORTLAND PROJECT.

I KNOW EVERYBODY'S BEEN KIND OF WAITING FOR THAT TO OPEN, AND ALTHOUGH WE ANTICIPATED POTENTIALLY THE END OF JULY, IT'S LOOKING LIKE IT'LL BE LATER THIS MONTH WITH POTENTIALLY A RIBBON CUTTING ON SEPTEMBER THE 7TH.

THAT'S WHAT WE'RE SHOOTING FOR RIGHT NOW, AND WE'LL CERTAINLY KEEP YOU UPDATED AS WE GET CLOSER TO THAT.

I JUST WANT TO HIGHLIGHT THE FACT THAT WE'VE HAD A NUMBER OF PRETTY SIGNIFICANT STORMS THIS YEAR AND A LOT OF TREES DOWN, AND THE STAFF IN THE PARKS AND REC DEPARTMENT AND STREETS.

PEOPLE OF THE PEOPLE IN PUBLIC WORKS STREETS HAVE ALSO HELPED THEM OUT WITH THAT.

IT PUT US BEHIND ON SOME OF THE OTHER STUFF, BUT JUST A HUGE AMOUNT OF WORK HAS HAD TO GO INTO DEALING WITH ALL THE DOWNED TREES AND DAMAGE FROM THE STORMS. LAST THING I WANT TO HIGHLIGHT REAL QUICK, ACTUALLY, TWO THINGS REAL QUICK.

ONE IS THE DINE AND DISCOVER SUMMER CHALLENGE.

WE DID THAT LAST YEAR FOR THE FIRST TIME.

SOMETHING THAT STEPHANIE BO KIND OF KICKED OFF LAST YEAR AND WAS VERY SUCCESSFUL.

IT'S UP AND RUNNING AGAIN AND IS ALREADY MORE SUCCESSFUL THAN IT WAS LAST YEAR.

A LOT OF PEOPLE PARTICIPATING, MORE RESTAURANTS IT'S A GREAT PROGRAM WHERE IT ENCOURAGES PEOPLE THROUGHOUT THE SUMMER TO ESSENTIALLY GET OUT THERE AND EAT IN LOCAL RESTAURANTS. HERE IN MARANA, YOU GET A LITTLE CARD, YOU GET GO TO FOUR DIFFERENT ESTABLISHMENTS IN THE TOWN OF MARANA, AND YOU CAN BRING THAT INTO THE MARANA VISITOR INFORMATION CENTER FOR SOME MERCHANDISE.

SO THE CHAMBER AND THE TOWN ARE KIND OF PARTNERING UP ON THAT CHAMBER OF COMMERCE AND DISCOVER MARANA.

SO GET OUT THERE, GET TO RESTAURANTS AND GET SOME MERCHANDISE, AND LASTLY WE'VE BEEN WORKING ON THE TRANSPORTATION MASTER PLAN. WE JUST ACTUALLY DID A PODCAST KIND OF TALKING ABOUT THAT, PUBLICIZING IT TO THE COMMUNITY, TRYING TO GET AS MUCH PUBLIC FEEDBACK ON THE FINAL DRAFT, WHICH WE'LL BE BRINGING TO THE COUNCIL HERE IN THE BEGINNING OF SEPTEMBER.

RESOLUTION NUMBER 2024-074 RELATING TO DEVELOPMENT, APPROVING AND AUTHORIZING THE MAYOR TO EXECUTE THE FIRST AMENDMENT TO THE DEVELOPMENT AGREEMENT FOR THE SAGUARO BLOOM DEVELOPMENT PROJECT.

THIS ITEM IS THE FIRST AMENDMENT TO THE SAGUARO BLOOM DA WHICH WAS ORIGINALLY ENTERED INTO IN JULY OF 2011.

REGARDING THE SAGUARO BLOOM DEVELOPMENT PROJECT.

UNDER THE ORIGINAL DA, THE DEVELOPER HAS A NUMBER OF OBLIGATIONS RELATED TO THE CONSTRUCTION OF TRANSPORTATION IMPROVEMENTS, BUT THE ORIGINAL DA ALSO INCLUDED A PROVISION THAT ALLOWED THE PARTIES TO ENTER INTO A PAYMENT IN-LIEU AGREEMENT AT A FUTURE DATE, WHEREBY THE TOWN COULD CONSTRUCT SOME OF THOSE TRANSPORTATION IMPROVEMENTS AND THE DEVELOPER WOULD PAY FOR THEIR COSTS.

THE DEVELOPER'S OBLIGATION WAS TO PAY FOR THE DESIGN OF THE PROJECT AND TO RECONSTRUCT TWIN PEAKS ROAD FROM TO ONE HALF OF ITS FOUR LANE ARTERIAL ROAD CROSS SECTION ALONG THE ENTIRE BOUNDARY OF SAGUARO BLOOM AND THEN TO ALSO DESIGN AND CONSTRUCT A THREE LEGGED TRAFFIC SIGNAL AT THE INTERSECTION OF TWIN PEAKS ROAD AND SAGUARO PEAKS BOULEVARD AT THIS POINT.

WELL, ACTUALLY, A COUPLE YEARS AGO, THE TOWN DECIDED THAT WE WERE READY TO PROCEED WITH THE WHOLE PROJECT, AND THE TOWN WANTED TO CONSTRUCT IT, RATHER THAN HAVING THE DEVELOPER CONSTRUCT AND HAVE COMPETING CONSTRUCTORS OUT THERE.

SO WE BEGAN TALKING TO D.R.

HORTON, THE CURRENT DEVELOPER, ABOUT PAYMENT IN LIEU PROVISIONS AND WHAT OVER THE LAST COUPLE OF YEARS, WE'VE BEEN WORKING ON PUTTING IT OUT TO BID AND NAILING DOWN THE PRICE FOR THE PROJECT, AND SO WE ARE HERE NOW WITH THOSE NUMBERS, AND WE CAN PROCEED WITH THE DA AMENDMENT AS THE PAYMENT IN-LIEU AGREEMENT.

THE WAY IT WILL WORK IS THAT THE TOWN WILL CONSTRUCT THE ENTIRE PROJECT.

THE DESIGN HAS ALREADY BEEN DONE AND WAS PAID FOR BY D.R.

HORTON, BUT THE TOWN WILL CONSTRUCT THE ENTIRE ROAD PROJECT AND THE TRAFFIC SIGNAL, AND D.R.

HORTON WILL PAY FOR ITS PORTION OF THE COST, WHICH IS CURRENTLY ESTIMATED TO BE ABOUT $14.1 MILLION FOR THE D.R.

HORTON PORTION.

THE WAY THAT WE'VE STRUCTURED THE AGREEMENT IS THAT D.R.

HORTON CAN CHOOSE EITHER TO PROVIDE A CASH DEPOSIT FOR HALF OF THEIR COSTS OR A LITTLE OVER $7 MILLION, OR THEY CAN DEPOSIT WITH THE TOWN A LETTER OF CREDIT FOR THE FULL AMOUNT, IF THEY CHOOSE THE CASH DEPOSIT OPTION.

WHEN WE GET TO 50% COMPLETION OF THE PROJECT, THEY WOULD BE REQUIRED TO POST THE SECOND CASH DEPOSIT FOR THE REMAINING HALF.

IF THEY CHOOSE THE LETTER OF CREDIT OPTION, WE WILL HOLD THE LETTER OF CREDIT AND ISSUE MONTHLY INVOICES FOR THEIR PORTION OF THE PROJECT AS IT PROCEEDS, BASED ON THE PROGRESS OF THE PROJECT, AND WE WOULD BE ABLE TO DRAW ON THE LETTER OF CREDIT IF THEY DON'T PAY THEIR MONTHLY INVOICES, AND I SHOULD NOTE THAT THE TOWN HAS ALREADY SELECTED THE CONTRACTOR.

IT IS A CONSTRUCTION MANAGER AT RISK CONTRACT.

SO WE'VE GOT A PRETTY SOLID NUMBER.

THOSE NUMBERS DON'T TYPICALLY CHANGE A WHOLE LOT WHEN YOU USE THE CMAR TYPE OF CONSTRUCTION PROJECT.

THERE IS ALSO THE ISSUE OF DEVELOPMENT IMPACT FEE CREDITS.

WHEN WE ORIGINALLY ENTERED INTO THE 2011 AGREEMENT, THIS PROJECT WAS NOT IN OUR TRANSPORTATION IIP, ALTHOUGH IT WAS ANTICIPATED THAT IT MIGHT BE ADDED AT A FUTURE DATE, AND THE AGREEMENT STATED THAT IF ANY OF THE TRANSPORTATION IMPROVEMENTS WERE ULTIMATELY ADDED TO THE IIP, THEN THE DEVELOPER WOULD RECEIVE AN IMPACT FEE, CREDITS, OR REIMBURSEMENT AS REQUIRED BY STATE LAW.

SO WE HAVE CALCULATED WHAT THAT IMPACT FEE CREDIT SHOULD BE BASED ON THE NUMBER THAT THE PERCENTAGE OF THE PROJECT THAT IS ACTUALLY INCLUDED WITHIN THE IIP AND THE WAY IT WORKS OUT IS THAT DR HORTON WOULD BE ENTITLED TO 631,000, GIVE OR TAKE, FOR THEIR THE WORK THEY'VE ALREADY DONE, WHICH IS THE DESIGN THAT THEY PAID FOR AND FOR THE RIGHT OF WAY THAT THEY DEDICATED FOR THE PROJECT.

SO THAT $631,000 WOULD BE REIMBURSED TO DR.

HORTON WITHIN 30 DAYS OF THE EFFECTIVE DATE OF THIS AGREEMENT, BECAUSE THAT HAS ALREADY OCCURRED AND THEY'VE ALREADY PAID IMPACT FEES THAT WOULD COVER THAT.

IN FACT, THEY'VE PAID A LITTLE OVER $6.5 MILLION IN IMPACT FEES TO DATE FOR THE PROJECT.

AS FOR THE CREDIT THAT THEY'RE ENTITLED TO FOR THE PAYMENT IN LIEU.

SO IF THEY PAY THE PAYMENT IN LIEU, IT'S THEIR FULFILLMENT OF THEIR OBLIGATION TO, TO PAY THE PAYMENT IN LIEU FOR THE CONSTRUCTION OF THE ROAD.

IT'S A LITTLE OVER $2.7 MILLION.

THE WAY WE'VE STRUCTURED THE AGREEMENT, THEY WOULD WE WOULD PAY THEM 1.3 HALF OF IT AT THE TIME OF 50% COMPLETION, IF THEY HAVE PAID THEIR 50% UP TO THAT POINT, AND THEN AT THE END OF THE PROJECT, WE WOULD GIVE THEM THE FINAL $1.3 MILLION IN IMPACT FEE REIMBURSEMENTS, AGAIN CONTINGENT UPON THEM FULFILLING THEIR OBLIGATIONS TO PAY THE PAYMENT IN LIEU, BECAUSE THAT'S WHAT MAKES THEM ELIGIBLE FOR THE IMPACT FEE CREDITS.

SO THAT IS ESSENTIALLY WHAT THE DEAL COVERS.

OTHER THAN THAT, THE ORIGINAL 2011 DA STAYS IN PLACE, AND WITH THAT, I'D BE HAPPY TO ANSWER ANY QUESTIONS. COUNCILMEMBER, DID YOU HAVE ANY? I HAD A QUESTION. OKAY.

IF WE HAVE OKAY, IF WE HAVE THAT, THEN, YOU KNOW, WE WILL GET THE DEVELOPER'S CONSENT TO APPROVE AND THEY MAY NOT UNREASONABLY WITHHOLD IT IF IT'S A CHANGE IN SCOPE OF WORK THAT INCREASES THE THEIR PORTION OF THE PROJECT, AND IF THAT CHANGE IN THE SCOPE OF WORK IS NECESSARY TO ENSURE THE SAFETY OF THE TRAVELING PUBLIC, OR IS NECESSARY BECAUSE OF ENGINEERING REQUIREMENTS TO PROPERLY CONSTRUCT THE ROADWAY AND THE STORM DRAINAGE SYSTEM TO THE TOWN STANDARDS, THEN THEY CANNOT WITHHOLD THEIR CONSENT.

THEY CAN'T UNREASONABLY WITHHOLD THEIR CONSENT.

THEY HAVE TO CONSENT AND THEY WILL BE RESPONSIBLE FOR IT.

IF IT'S A CHANGE OF SCOPE OUTSIDE THAT PARAMETER OF BEING NECESSARY TO ENSURE SAFETY, OR THAT IT'S NOT AN ENGINEERING REQUIREMENT, THAT'S WHERE THEY HAVE THE ABILITY TO NEGOTIATE WITH US ON IT.

MORE OR LESS. THEY ARE NOT REQUIRED TO APPROVE THAT SCOPE OF WORK CHANGE.
