GOOD EVENING HONORABLE, HONORABLE MAYOR AND MEMBERS OF THE COUNCIL.

MY NAME IS BRENDAN LYONS, I SERVE AS THE GOVERNMENT AFFAIRS DIRECTOR FOR THE SOUTHERN ARIZONA HOMEBUILDERS ASSOCIATION.

I'M HERE TO SPEAK ABOUT AN ISSUE THIS MORNING THIS EVENING ON WE'RE APPRECIATIVE OF THE OUTREACH FROM THE TOWN STAFF TO TAKE INTO CONSIDERATION THE INPUT FOR THE THE DRAINAGE MANUAL SET BEFORE YOU ON THE AGENDA ITEM THIS EVENING.

I'M NOT HERE THIS EVENING TO TAKE A POSITION FOR OR AGAINST THE UPDATE.

INSTEAD, REGARDLESS OF YOUR ACTION THIS EVENING WE WOULD LIKE TO CONTINUE TO WORK WITH STAFF TO BETTER UNDERSTAND HOW COMMENTS WERE OR WERE NOT INCORPORATED INTO THE FINAL DOCUMENT. WE TRULY SEEK AN OPPORTUNITY TO DEVELOPING COLLABORATIVE POLICIES AND REGULATIONS THAT ADDRESS TOWN PRIORITIES AND CREATE AN ENVIRONMENT FOR OUR MEMBERS TO EFFICIENTLY AND COST EFFECTIVELY MEET THE HOUSING NEEDS FOR MARANA'S FUTURE RESIDENTS.

[ MAYOR AND COUNCIL REPORTS: SUMMARY OF CURRENT EVENTS]

YEAH. MAYOR, I HAD A COUPLE OF REPORTS THIS TIME, AND ONE OF THEM IS THAT JOHN JOHN OFFICER AND I ATTENDED THE ALMA VIDA OPEN HOUSE THROUGH THE MARANA CHAMBER OF COMMERCE AND TALKED TO THE OWNERS OF THAT, AND THEY TOLD ME THAT THEY WERE REALLY HAPPY WORKING WITH THE TOWN OF MARANA FROM START TO FINISH.

THEY THOUGHT IT WAS A GREAT PROJECT AND REALLY LOVED WORKING WITH THE TOWN.

AND THEY WERE, IT WAS A GREAT LITTLE CELEBRATION THERE OF OPENING THAT UP FOR THE FIRST TIME.

NUMBER TWO THING I WANT TO PRESENT IS THAT I WAS GOING DOWN SCENIC DRIVE, WHICH IS NORTH OF SILVERBELL, A LITTLE TOO LATE, AND IT GOES UP TOWARD SAFFORD PEAK.

AND THERE WAS A CITIZENS AND PICKING UP TRASH, MAINLY LITTLE BITS OF STYROFOAM THAT WERE BLOWING ALL OVER THE PLACE, THEY WERE JUST GETTING IT. I LET THEM KNOW AND I STOPPED AND TALKED TO THEM, AND I LET THEM KNOW WE APPRECIATE THEM BEING GOOD CITIZENS, PICKING UP TRASH ON THAT SCENIC DRIVE.

AND I TOLD THEM WHO I WAS AND THEY SAID, WELL, I'D LIKE TO TALK TO YOU.

AND SO THEY COMMENCED TO TELLING ME ABOUT SOMETHING THAT I'M AWARE OF, AND IT'S THE ABSOLUTE UNBELIEVABLE EXCESSIVE SPEEDS ON SCENIC DRIVE, WHICH IS POSTED AT 25 MILES AN HOUR.

THEY SAY THAT THERE'S PEOPLE GOING DOWN THAT STREET IN THE MORNING, 60 MILES AN HOUR, THREE TIMES THE SPEED LIMIT.

SO I JUST WANT TO PUT THAT ON THE RECORD THAT WE NEED TO BE AWARE OF, THAT MAYBE SOME MORE POLICE PRESENCE THERE.

YOU KNOW, WE NEED TO KEEP IT SAFE.

AND THEY WOULD SAY IF YOU JUST PUT UP A DEER CROSSING SIGN BECAUSE I'VE SEEN DEER CROSSING THERE IN THE EVENING GOING 25 MILES AN HOUR.

THERE'S A FAMILY OF DEER THAT GO BY BACK AND FORTH ON A REGULAR BASIS.

AND IF WE COULD JUST PUT UP A DEER CROSSING SIGN, SLOW DOWN, DEER CROSSING, THEY WOULD BE HAPPY WITH THAT.

AND LASTLY, I THINK IS COUNCIL MEMBER OFFICER AND I AND SOME OF THE OTHER STAFF ATTENDED THE RTA MEETING LAST NIGHT THAT [INAUDIBLE] IS GOING AROUND AND I SHOULDN'T SAY IT LIKE THAT [INAUDIBLE] IS CIRCULATING AND TELLING PEOPLE TO VOTE, COME OUT AND VOTE FOR [INAUDIBLE] FOR RTX, RTX IN NOVEMBER.

SO I THINK OUR FRIEND STEVE HUFFMAN WAS THERE.

FARHAD MOGAMI. I THOUGHT THEY DID A GOOD JOB ON PRESENTING IT.

SO ANYBODY THAT HAS NOT DONE THE SURVEY, PLEASE, FOLKS, MARANA FOLKS, YOU NEED TO DO THAT SURVEY.

THEY'RE MADE IT VERY CLEAR THAT THEY WANT YOUR FEEDBACK ON THE TRANSPORTATION FOR RTA NEXT.

AGAIN, YOU'LL BE VOTING ON THAT IN NOVEMBER OF 2025.

IT'S A HALF CENT SALES TAX THAT WOULD CONTINUE FROM THE ONE THAT HAS NOW WILL STOP AND IT WILL START AGAIN.

AND I THINK MOST OF US KNOW THAT IN THE TOWN OF MARANA, THAT MONEY HELPED US SO MUCH ON TANGERINE, FIRST PART OF TANGERINE DOVE MOUNTAIN OVER TO THE BORDER OF ORO VALLEY.

SO WE'RE LOOKING TO GET SOME MONEY, HOPEFULLY FOR CORTARO.

I WAS GOING TO REPORT THAT AS WELL, AND ALSO GOT A CALL FROM CARL WINTER'S DAUGHTER THAT CARL PASSED AWAY AS WELL.

CARL HAD HAD DEMENTIA AND BEEN PRETTY ILL FOR A LONG TIME.

GREAT GUY THAT DID A LOT OF THINGS WITH MARANA IN THE EARLY DAYS.

SO, YOU KNOW, WE LOST TWO, A MARANA CITIZEN AND A CITIZEN THAT WORKED REALLY HARD TO HELP MARANA, YOU KNOW, FOR THESE TWO INDIVIDUALS. I WANT TO TALK A LITTLE.

DID I ASK YOU IF YOU HAD ANYTHING? NO, BUT I DON'T HAVE ONE.

SO KEEP ON GOING, BECAUSE I DON'T WANT YOU TO GET ON ME.

IT'S KIND OF LIKE WHAT THE GUY SHOT AT AND MISSED.

THOSE PEOPLE ARE NOT COUNCIL MEMBER ZIEGLER SUPPOSED TO SAY WE NEED YOU TO VOTE FOR IT.

WHAT THEY'RE REALLY TRYING TO DO, BECAUSE THERE'S THINGS IN THAT PLAN THAT VIRTUALLY NOBODY ON THE BOARD WOULD SUPPORT IS TRYING TO NARROW IT DOWN TO THE ITEMS THAT THEY LIKE OR DISLIKE.

AND, YOU KNOW, WE'RE WE'RE HAVING A LOT OF ISSUES.

I MET WITH FARHAD AND JOE WINFIELD AND TOM MURPHY YESTERDAY.

AND, YOU KNOW, IT'S IT'S IT'S NOT A DONE DEAL.

AND WHAT ALL THREE OF THE THREE MAYORS AND MR. RAHIMI WERE THERE. BUT THE THREE MAYORS KIND OF AGREED UPON.

IT HAS TO BE SOMETHING THAT'S GOOD FOR US AS WELL.

IT CAN'T JUST BE FOR THE CITY.

AND WE REALIZE THE CITY GETS THE BIGGEST PART.

ONE OF THE ISSUES WE'RE HAVING RIGHT NOW, AND WE WERE COMPARING IT TO THE ONE IN PHOENIX, WHICH PASSED BY 70% IN THIS LAST ELECTION, BUT IT'S VERY REGIONAL IN PHOENIX.

A LOT OF PEOPLE THAT A LOT OF THE CITIES IN PHOENIX, THE ACTUAL CONSTRUCTION WILL NOT BE IN THEIR CITY, BUT IT HELPS THEM MOVE AROUND THE

VALLEY OR WHATEVER AND GET TO WORK OR SCHOOL OR WHATEVER THEY'RE DOING.

THE 101, 202, 303 AND THAT TYPE OF STUFF.

WE DON'T REALLY HAVE THAT HERE AND WE'RE KIND OF ARGUING OVER WHO GETS THE MOST.

AND I'M SAYING THAT IT NEEDS TO BE REGIONAL, YOU KNOW, THE INTERCHANGE AND THE AND THE TWIN PEAKS INTERCHANGE THAT WE GOT IN RTA ONE BENEFITED US IMMENSELY, BUT IT ALSO HELPED OTHER COMMUNITIES IN THE COUNTY AS WELL.

YOU KNOW, IT WAS A REGIONAL PROJECT.

SO WE'RE I WOULD ENCOURAGE YOU, LIKE COUNCIL MEMBER ZIEGLER SAID, IS TO GO TO THE WEBSITE, LOOK AT THE MATERIAL IF THERE'S THINGS YOU LIKE, PUT SOMETHING ON THERE.

IF THERE'S THINGS YOU DON'T LIKE, PUT SOMETHING ON THERE.

BUT WE'RE TRYING TO MAKE IT WORK.

YOU KNOW, AND IT'S IT'S BEEN A PRETTY HARD CHARGE, BUT WE'RE WE'RE TRYING TO GET GET IT DONE IF WE CAN.

[ MANAGER’S REPORT: SUMMARY OF CURRENT EVENTS]

MR. MAYOR, VICE MAYOR, MEMBERS OF COUNCIL FOR THE MANAGER REPORT, WE HAVE THE SINGLE FAMILY RESIDENTIAL UPDATE SO FAR THIS MONTH, WE HAVE 27.

LAST YEAR FOR THE MONTH OF NOVEMBER, THE ENTIRE MONTH WE HAD 85.

JUST A REMINDER THAT SAGUARO BLOOM COMMUNITY PARK CONTINUES TO PHASE ONE, CONTINUES TO MOVE ALONG.

I KNOW IT'S BEEN A LONG AWAITED PROJECT, BUT IT IS FINALLY GOING.

I BELIEVE THEY'RE STILL ON TRACK TO BE DONE BY THE END OF THIS CALENDAR YEAR.

SO END OF DECEMBER AND THE PLAYGROUND EQUIPMENT SHOWED UP THIS WEEK, SO THEY'RE MOVING RIGHT ALONG.

SO WE CERTAINLY ARE EXCITED ABOUT THAT.

AND I'M SURE THE RESIDENTS OF SAGUARO BLOOM ARE AS WELL.

I'M SURE MANY OF YOU HAVE SEEN THE WORK THAT'S BEING DONE ON THE AQUATIC CENTER THAT IS MOVING RIGHT ALONG.

IN FACT, SO MUCH SO THAT THEY'VE GAINED SOME A FEW WEEKS ON THEIR SCHEDULE AND ARE GIVING US AN ANTICIPATED COMPLETION DATE OF IN APRIL NOW IN THE LATTER PART OF APRIL.

SO WE'RE PRETTY EXCITED ABOUT THAT AS WELL.

AND IF YOU'LL NOTICE, THEY'VE GOT FRAMES IN THE WINDOWS AND GLASS WILL BE COMING IN TO BE PLACED INTO THOSE WINDOWS HERE IN THE NEXT COUPLE OF WEEKS.

SO SOME OF THOSE THINGS REALLY BEGINNING TO TAKE SHAPE FOR OUR COMMUNITY AND AQUATIC CENTER.

THIS PAST WEEKEND, WE HAD A COUPLE OF THINGS GOING ON.

WE HAD THE TURKEY TROT. THAT'S AN ANNUAL EVENT THAT PARKS AND RECS HAS BEEN PUTTING ON FOR SOME TIME NOW.

I HAD 260 REGISTERED PARTICIPANTS.

THEY HAD A 5K, A 10K, AND ALSO INTRODUCED A HALF MARATHON THIS YEAR.

SO VERY WELL ATTENDED NOT ONLY BY THE PARTICIPANTS, BUT BY SPECTATORS AND PEOPLE CHEERING ON THEIR RESPECTIVE FAMILY MEMBERS AND LOVED ONES.

RIGHT AROUND THE CORNER HERE ON DECEMBER THE 7TH, PROBABLY, IF NOT OUR BIGGEST EVENT, OUR SECOND BIGGEST EVENT, OUR CHRISTMAS TREE LIGHTING EVENT THAT WILL TAKE PLACE ON DECEMBER THE 7TH FROM 2:00 UNTIL 9:00.

THE TREE LIGHTING CEREMONY ITSELF WILL TAKE PLACE AT 6 P.M., WITH AN ENCORE AGAIN AT 08:30.

SO I'M SURE YOU'VE SEEN MANY OF THE DECORATIONS THAT HAVE BEEN GOING UP THE TREES FULLY OUT THERE.

AND SO VERY EXCITING TIME FOR FOR ALL OF US.

AND THEN NORTHWEST FIRE THIS PAST WEEK HAD A AN AWARD CEREMONY, AND THEY ENDED UP GIVING NOT ONLY AWARDS TO A LOT OF THEIR STAFF, BUT THEY GAVE A COUPLE OF AWARDS TO TOWN OF MARANA STAFF FOR THEIR COMMUNITY PARTNER COMMENDATIONS.

THEY DID SO TO A NUMBER OF PEOPLE IN THE PARKS AND REC DEPARTMENT AS WELL AS THE POLICE DEPARTMENT, SO IT WAS NICE TO BE A PART OF THEIR CEREMONY.

AND THAT COMPLETES MY REPORT, MR. MAYOR. THANK YOU.

TERRY, I SENT YOU A TEXT THIS AFTERNOON, BUT I THINK YOU WERE BUSY WHEN I ASKED ABOUT I WONDERED IF YOU COULD IF WE WERE GOING TO HAVE A REPORT ON THE TOWER.

THERE WAS SOMEBODY OVER THERE ON SUNDAY PEEKING THROUGH THE WINDOWS AT THE COMMUNITY CENTER AND AQUATIC CENTER, TRYING TO SEE WHAT WAS GOING ON.

WE'RE NOT GOING TO SAY IT WAS ME, BUT THE GUY KIND OF LOOKED LIKE ME AND THE POLICE DIDN'T COME AND GET ME.

I WAS GOING TO ASK IF IT WAS A GRAY HAIRED MAN WITH A BEARD.

HOW IMPRESSIVE, HOW IMPRESSIVE.

I LEARNED SOMETHING, I DIDN'T REALIZE THE BASKETBALL COURTS WERE GOING TO BE THREE FEET HIGHER THAN THE OUTSIDE GROUND LEVEL, AND, BUT ALL THE FLOORS ARE POURED IN THERE.

I DID NOT GO IN.

I DIDN'T TOUCH ANYTHING.

DON'T CALL THE POLICE.

BUT ANYWAY, WHAT AN IMPRESSIVE.

WENT AROUND AND LOOKED AT ONE OF THE THE POOLS AND YOU KNOW, THAT'S SOMETHING WE'RE GOING TO BE REALLY PROUD OF.

BUT AS YOU WELL KNOW, THESE THINGS EBB AND FLOW, AND WE HAVE TWO VERY LARGE DEVELOPMENTS THAT ARE COMING ONLINE HERE WITH MONARCH RIGHT ACROSS THE STREET HERE ON THE SOUTH SIDE OF BARNETT, AS WELL AS MANDARINA ON THE EAST SIDE OF I-10.

THE REQUEST IS TO MODIFY A REZONING CONDITION OF ORDINANCE 2021.016 OF THE SILVER RIDGE SUBDIVISION.

THE LOCATION IS SILVERBELL ROAD, APPROXIMATELY ONE QUARTER MILE SOUTH OF INA ON THE WEST SIDE, AND THE LOCATION MAP IS OVER THERE ON THE RIGHT.

SOME BACKGROUND, ONE THING I DID WANT TO NOTE IS A REQUEST LIKE THIS TYPICALLY GOES TO PLANNING COMMISSION.

HOWEVER, BEING THAT THIS WAS EXPLICITLY MENTIONED IN THE REZONING ORDINANCE IS WHY IT'S IN FRONT OF YOU GUYS TONIGHT.

ORDINANCE 2021.016 WAS ADOPTED ON AUGUST 17TH, 2021 AND ESTABLISHED THE SILVERBELL RIDGE SUBDIVISION.

WITHIN THAT ORDINANCE, CONDITION NUMBER 15 REQUIRED ALL OF THE UTILITIES WITHIN THE SUBDIVISION TO BE LOCATED UNDERGROUND.

THESE WOULD BE ALL UTILITIES OUTSIDE OF THE WAPA EASEMENT.

THIS MODIFICATION IS TO EXEMPT THE EXISTING TEP OVERHEAD ELECTRICAL LINE FROM UNDERGROUNDING, AND TO CLARIFY THAT ALL NEW UTILITIES WILL BE LOCATED UNDERGROUND.

THIS IS DUE TO TWO REASONS.

THE FIRST REASON BEING SUMMER MONSOON DAMAGE.

SO TEP RECENTLY UPGRADED THE TRADITIONAL WOODEN POLES TO TALLER STEEL POLES AS A RESPONSE TO THAT DAMAGE, AND ALSO UNDERGROUNDING THESE LINES WOULD CREATE CONFLICT WITH THE OPEN SPACE COVENANT, WHICH WAS REQUIRED AS PART OF THE ORIGINAL REZONING ORDINANCE.

IN THIS EXHIBIT HERE, PROVIDED BY THE CLIENT, YOU CAN SEE THE ELECTRICAL UTILITY EASEMENT.

THE WAPA EASEMENT IS SHOWN IN BLUE.

SILVERBELL ROAD IS ON THE RIGHT.

AND THEN THAT LITTLE LIME SLIVER IS THE TEP EASEMENT, WHICH IS IN QUESTION TONIGHT.

IN BLACK IS THE OPEN SPACE AREA THAT WAS DEDICATED TO THE TOWN AND IS COVERED BY THAT OPEN SPACE COVENANT.

ON THE LEFT YOU CAN SEE THE EXISTING WAPA LINE THAT'S EXEMPT FROM THE UNDERGROUNDING.

IN THE FAR BACK YOU CAN SEE THE OLD WOODEN TEP POLES WHICH WERE IN THE PROCESS OF BEING REMOVED AT THE TIME.

AND THEN JUST IN THE FOREGROUND OF THAT, YOU CAN SEE THOSE NEW 65 FOOT TALL TALL TEP STEEL POLES.

STAFF RECOMMENDATION IS STAFF RECOMMENDS APPROVAL OF THE REZONING CONDITION, MODIFICATION AND ADOPTION OF ORDINANCE NUMBER 2024.024.

FIRST TIME PRESENTING BEFORE THE COUNCIL.

AND AFTER TWO YEARS OF DEVELOPMENT, WE ARE FINALLY ABLE TO BRING THE DRAINAGE MANUAL BEFORE YOU GUYS FOR APPROVAL.

OKAY. SO THE TOWN HAS PREPARED THIS MANUAL TO ADDRESS DRAINAGE WITH OUR TOWN WITHIN OUR TOWN.

HISTORICALLY, THE TOWN HAS RELIED ON THE OTHER JURISDICTIONS AROUND US.

THEIR DRAINAGE MANUALS, THEIR POLICIES, THEIR STANDARDS HAVE BEEN USED TO DEVELOP THE LAND WITHIN OUR JURISDICTION.

AFTER LOOKING AT THIS, THE STAFF MADE A DECISION THAT WE NEEDED TO COME UP WITH A MANUAL FOR THE TOWN SO THAT WE COULD DEVELOP THIS MANUAL SO IT ALIGNED WITH OUR TOWN CODE, OUR CULTURAL VALUES, AND OUR TOPOGRAPHY.

THE CURRENT PRACTICES, AS I SAID, IS WE RELY ON THESE OTHER JURISDICTIONS PIMA COUNTY, CITY OF TUCSON.

AND WHAT WE'VE EXPERIENCED IS ONE DEVELOPMENT WILL USE THE PIMA COUNTY METHOD.

THE OTHER DEVELOPMENT WILL USE THE CITY OF TUCSON METHOD.

AND THERE'S INCONSISTENCIES BETWEEN THESE TWO METHODS.

ADDITIONALLY, PIMA COUNTY AND CITY OF TUCSON, THEY DEVELOPED THESE METHODS AND THESE PROCEDURES AND THESE STANDARDS FOR THEIR JURISDICTIONS.

AND WHEN THEY DEVELOPED THEM, THEY WEREN'T THINKING OF US.

SO WHAT WE DID WITH OUR MANUAL IS WE LOOKED AT ALL OF THOSE STANDARDS ACROSS THE REGION.

WE DECIDED WHICH ONES WERE BEST FOR US, AND THEN WE PACKAGED THEM UP UNDER THE MANUAL THAT WE BROUGHT IN FRONT OF YOU.

AND WHAT THIS DOES FOR US IS THIS POSITIONS US AS A COMMUNITY TO BE ABLE TO CONTROL HOW THE DRAINAGE.

I WON'T SAY CONTROL HOW THE DRAINAGE WILL BE DESIGNED WITHIN OUR COMMUNITY.

AND THEN AS THESE OTHER JURISDICTIONS START CHANGING THOSE POLICIES, IT'S NOT GOING TO IMPACT US BECAUSE WE HAVE OUR OWN MANUAL.

WE HAVE DECIDED WHICH VERSIONS WE'RE GOING TO USE AND WHICH VERSIONS ARE GOING TO BE USED TO GUIDE OUR DEVELOPMENT GOING FORWARD.

AND IF THEY MAKE A DECISION AND THEY CHANGE A POLICY THAT WE DON'T AGREE WITH, WE'RE NOT RELYING ON WHATEVER THE LATEST VERSION THEY HAVE IS BECAUSE WE'VE GOT OUR OWN MANUAL. FOR THE DEVELOPMENT OF THE MANUAL WE'VE EVEN WORKED WITH AN OUTSIDE CONSULTANT, AND AFTER THE MANUAL WAS EFFECTIVELY SUBSTANTIALLY COMPLETE.

WE THEN WENT IN AND PULLED A POOL OF STAFF RESOURCES THAT WENT THAT RANGED FROM MEMBERS OF CIP, PUBLIC WORKS, ENVIRONMENTAL, AND DEVELOPMENT SERVICES, MAINLY DEVELOPMENT ENGINEERING AND INCLUDED, WE ALSO INCLUDED THE TOWN ENGINEER IN THAT.

AND THAT POOL REVIEWED THIS MANUAL FOR TWO FULL ROUNDS.

AFTER WE COMPLETED BOTH OF THOSE ROUNDS, WE DECIDED AND ASKED THE QUESTION, ARE WE READY TO SEND THIS OUT FOR AN EXTERNAL REVIEW? AND WHEN WE REACHED THAT POINT, WE THEN LOOKED AT ALL OF THE PROJECTS THAT HAVE BEEN DONE ACROSS THE TOWN.

WE IDENTIFIED THE ENGINEERS THAT HAVE DONE REPEAT PROJECTS WITH THE TOWN, AND WE PICKED A SELECT GROUP OF PEOPLE, AND WE SENT THE MANUAL TO THEM FOR AN EXTERNAL REVIEW.

ADDITIONALLY, WE ALSO DID SEND A COPY OF THE MANUAL TO SAHBA.

AFTER WE STARTED THAT REVIEW PERIOD, WE THEN HELD TWO ADDITIONAL QUESTION AND ANSWER SESSIONS THAT WERE OPEN TO ANYONE THAT WANTED TO ATTEND WANTED TO ATTEND.

THE FIRST ONE WAS A WEEK AFTER WE HAD STARTED THE INITIAL REVIEW, AND THEN THE OTHER ONE WAS THE WEEK BEFORE WHEN THE COMMENTS WERE FINALLY DUE.

AND THAT WAY THEY COULD GET THROUGH THE MANUAL, THEY COULD BRING THEIR QUESTIONS, WE COULD ANSWER THEM, AND THEN WE COULD DOCUMENT THEM AFTER.

OH, ONE LAST THING.

THERE WAS ONE OTHER PIECE THAT WE DID AS FAR AS OUTREACH IS, WE ALSO ATTENDED THE REGIONAL FLOOD CONTROL MEETING, AND WE HAD A MEETING WITH SAHBA WHERE WE WHERE WE EXPLAINED WHAT OUR INTENT WAS WITH THE MANUAL, AND THE INTENT WITH OUR MANUAL WAS NOT TO REINVENT THE WHEEL ON THIS.

WE TOOK THE STANDARDS THAT HAD BEEN APPLIED ACROSS THE TOWN OVER THE LAST 15 YEARS WITHOUT THE MANUAL, AND PUT THEM INTO THE MANUAL.

WE'RE NOT LOOKING TO CHANGE.

WE'RE ONLY LOOKING TO DOCUMENT AND ESTABLISH A MINIMUM STANDARD FOR THE TOWN.

OUT OF THAT REVIEW, THERE WAS, IN FACT ONE SIGNIFICANT COMMENT THAT EMERGED, AND WE WANT TO BRING THAT BEFORE YOU GUYS.

AND THAT WAS THE REGIONAL RAINSTORM VERSUS THE NON REGIONAL RAINSTORM.

THE CURRENT TOPOGRAPHY OF OUR TOWN IS A LOT OF OPEN FARMLAND AND OPEN DESERT AREA.

AND WITH THAT TOPOGRAPHY, THE NON REGIONAL RAINSTORM IS THE RAINSTORM THAT NEEDS TO BE USED WHEN WE ARE DESIGNING THIS DRAINAGE INFRASTRUCTURE.

IT GIVES US BETTER INFORMATION, IT ALLOWS THE ENGINEERS TO DESIGN INFRASTRUCTURE THAT'S GOING TO CAPTURE THOSE WATERS, CONVEY THEM AND RELEASE THEM AS THEY NEED TO BE RELEASED SO THAT WE CAN PROTECT THOSE NEW DEVELOPMENTS FROM FLOODING.

IT IN ADDITION TO THAT, IN 2020, THE TOWN DID A SITE, A TOWN WIDE DRAINAGE STUDY FOR THE TORTOLITA FAN.

AND IN THAT STUDY, THERE WAS THREE CHANNELS THAT HAD BEEN IDENTIFIED THE BARNETT CHANNEL, THE MARANA ROAD CHANNEL, AND THE 10.5 CHANNEL, WHICH IS UP AROUND THE HARDIN ROAD AREA.

AS SOON AS WE ARE ABLE TO BUILD THOSE CHANNELS STAFF DOES FULLY INTEND TO SCHEDULE AND COMPLETE AN ADDITIONAL EVALUATION OF THE DRAINAGE ACROSS THE TOWN, WITH THE INTENT OF BEING ABLE TO REMOVE THE NON-REGIONAL REQUIREMENT IN CERTAIN AREAS OF THE TOWN AND ALLOW THEM TO SWITCH TO A REGIONAL EVENT.

BUT WE NEED THOSE CHANNELS TO PROVIDE CONNECTIVITY FROM I-10, WHERE THE WATER CROSSES UNDER ALL THE WAY THROUGH THE TOWN AND BE ABLE TO RELEASE IT INTO THE SANTA CRUZ. AND ONCE WE HAVE THOSE PATHWAYS, THEN WE PLAN TO REEVALUATE THOSE AREAS.

THE OTHER COMMENT THAT CAME OUT OF THE NON-REGIONAL RAINSTORM IS, THIS RAINSTORM IS GOING TO PRODUCE LARGE DRAINAGE STRUCTURES, AND THAT'S NOT ENTIRELY ACCURATE.

THIS NON-REGIONAL RAINSTORM IS BETTER INFORMATION, AND IT'S GOING TO ALLOW US TO DESIGN ACCURATE DRAINAGE INFRASTRUCTURE.

AND HAVING THAT HIGHER LEVEL OF ACCURACY ON THE NON-REGIONAL STORM, THIS GAVE US THE ABILITY TO LOOK AT THE RISK AND REALLY DECIDE THAT, YOU KNOW WHAT, WE CAN LOWER THE SAFETY FACTORS ON SOME OF THESE CHANNELS.

SO WE PROVIDED RELIEF WHERE WE COULD, KNOWING THAT WE HAVE BETTER INFORMATION GOING INTO THE FRONT END OF THE DESIGN.

BUT THE WHOLE THE WHOLE GOAL OF THIS MANUAL WAS TO PROTECT THE TOWN'S INTEREST, PROTECT THE RESIDENTS, FOSTER DEVELOPMENT WITHIN THE TOWN, AND MAKE SURE THAT WE CONTINUE TO GROW.

ON SEPTEMBER 19TH OF LAST YEAR, THE TOWN COUNCIL ADOPTED THE TOWN OF MARANA'S PUBLIC ART POLICY.

AND SINCE ITS ADOPTION, THE MARANA PUBLIC ART REVIEW COMMITTEE, AS WELL AS STAFF, HAVE IDENTIFIED CERTAIN SECTIONS OF THE POLICY THAT WOULD BENEFIT FROM REVISIONS JUST FOR BETTER CLARITY AND STRUCTURE OF THE POLICY.

SO TONIGHT, I'LL BE GOING OVER A FEW CHANGES THAT WE ARE PROPOSING FOR TOWN COUNCIL APPROVAL.

SO THE FIRST AMENDMENT RELATES TO THE PUBLIC ART REVIEW COMMITTEE STRUCTURE.

CURRENTLY, THE POLICY DOES STATE THAT THE MARANA PUBLIC ART REVIEW COMMITTEE SHALL CONSIST OF THE TOWN OF MARANA'S PUBLIC WORKS DIRECTOR, TOWN ENGINEER, DEVELOPMENT SERVICES DIRECTOR, COMMUNICATIONS MANAGER, PARKS AND RECREATION DIRECTOR, AND TWO MEMBERS OF THE LOCAL ART COMMUNITY, TOTALING TO A SEVEN MEMBER COMMITTEE. WE ARE PROPOSING THAT THE LANGUAGE NOW READ THAT THE PUBLIC ART REVIEW COMMITTEE WILL CONSIST OF SEVEN MEMBERS THAT ARE DIVIDED INTO TWO DIFFERENT CATEGORIES.

SO FOR THE TOWN REPRESENTATIVES, ADDING THE DEPUTY ROLE TO THE COMMITTEE.

SO THAT EITHER THE DIRECTOR OR DEPUTY OF DEVELOPMENT SERVICES DIRECTOR OR DEPUTY OF PARKS AND RECREATION AND DIRECTOR OR DEPUTY OF PUBLIC WORKS CAN ATTEND THE THE COMMITTEE MEETING.

SO NOT BOTH OF THEM, JUST EITHER OF THEM.

SO ADDING THAT AS WELL AS CHANGING THE TOWN ENGINEER AND REPLACING THAT TO AN APPOINTEE DESIGNATED BY THE TOWN MANAGER.

CURRENTLY OUR TOWN ENGINEER IS ALSO THE PUBLIC WORKS DIRECTOR.

SO ONE PERSON GETS TWO VOTES.

SO THAT DOESN'T REALLY MAKE SENSE.

SO JUST CHANGING IT TO AN APPOINTEE DESIGNATED BY THE TOWN MANAGER.

THE OTHER CATEGORY OF MEMBERS IS TWO MEMBERS OF THE LOCAL ART COMMUNITY.

SO CURRENTLY THE ART POLICY DOES NOT ESTABLISH A TERM FOR THE TWO MEMBERS OF THE PUBLIC THAT ARE PARTICIPATING IN THE COMMITTEE. SO WE ARE PROPOSING ESTABLISHING A FOUR YEAR TERM FOR THESE PUBLIC MEMBERS.

AND THIS IS CONSISTENT WITH OTHER TOWN BOARDS AND COMMISSIONS.

THE NEXT SECTION THAT WE ARE ALSO PROPOSING MAKING AN AMENDMENT TO IS THE CIP CONTRIBUTIONS SECTION.

SO CURRENTLY THE POLICY DOES STATE THAT ALL TOWN OF MARANA CAPITAL IMPROVEMENT PROJECTS, WITH AN ESTIMATED BUDGET OF $500,000 OR MORE, SHALL INCLUDE 1% OF THE TOTAL PROJECT COST AS A CONTRIBUTION TO THE MARANA PUBLIC ART FUND.

HOWEVER, SOME OF THESE CAPITAL IMPROVEMENT PROJECTS ARE FUNDED THROUGH A RESTRICTED FUNDING SOURCE THAT DOES NOT PERMIT EXPENDITURES FOR PUBLIC ART.

SO THIS IS IMPACT FEES, GRANTS AS WELL AS LOANS.

SO WE ARE PROPOSING ADDING LANGUAGE TO CLARIFY THAT CAPITAL IMPROVEMENT PROJECTS THAT ARE FUNDED THROUGH A RESTRICTED FUNDING SOURCE, AGAIN, SUCH AS IMPACT FEES, GRANTS AND LOANS, NOT BE REQUIRED TO CONTRIBUTE TO THE PUBLIC ART FUND.

SO THAT DOES CONCLUDE THE AMENDMENTS THAT WE ARE PROPOSING.

STAFF DOES RECOMMEND APPROVAL OF THE AMENDED TOWN OF MARANA PUBLIC ART POLICY, BUT HAPPY TO ANSWER ANY QUESTIONS REGARDING EITHER OF THE SECTIONS. ANY QUESTIONS? I HAD A QUESTION. BUT DEPENDING ON WHATEVER THE PROJECT IS, THERE IS AN AMOUNT THAT THEY THE PRIVATE DEVELOPMENT THEN CONTRIBUTES INTO THE SAME PUBLIC ART FUND, SO THEY DON'T NECESSARILY HAVE TO PUT IT OUTSIDE IN THEIR BUILDING, BUT THEY ARE CONTRIBUTING TO THAT PUBLIC ART FUND THAT WILL THEN BE USED FOR PUBLIC ART PROJECTS THROUGHOUT THE COMMUNITY.

OF MARANA REQUEST FOR PROPOSALS OR RFP FOR A LEASE AND DEVELOPMENT OF TOWN OWNED PROPERTY LOCATED AT MARANA MAIN STREET AND CIVIC CENTER DRIVE, AND POSSIBLE DIRECTION TO STAFF TO COMMENCE NEGOTIATIONS FOR A LEASE AGREEMENT, MR. AND WE WERE PROBABLY AS CLOSE TO REALIZING THAT VISION AS WE HAVE EVER BEEN.

AND I'M HERE TO TALK A LITTLE BIT ABOUT WHERE WE'RE AT WITH THAT.

AS YOU WELL KNOW, WE PUT OUT AN RFP BACK IN, I WANT TO SAY APRIL ISH AND LOOKING FOR SOMEBODY TO PARTNER WITH US ON THAT LAND THAT WE OWN THE 20, ALMOST 20 ACRES, I'M GOING TO CALL IT 20 ACRES, EVEN THOUGH IT'S JUST SHY OF 20 ACRES.

THAT 20 ACRES TO PARTNER WITH US, TO BEGIN TO DEVELOP THAT AND CREATE A TRULY DESTINATION TYPE OF A DOWNTOWN.

SO THAT RFP WENT OUT.

IT WAS AVAILABLE TO ANYBODY WHO WANTED TO PARTNER WITH US, AND WE GOT ONE PERSON THAT WANTED TO DO THAT WITH US.

I THINK YOU ALL KNOW WHY WE'RE WORKING TO DEVELOP A DOWNTOWN, BUT PERHAPS FOR OUR AUDIENCE, FOR THE RESIDENTS OF OUR COMMUNITY WHO MAY BE LISTENING AND PEOPLE IN THE AUDIENCE WHO MAY NOT BE AWARE, HAVING A DOWNTOWN IS SOMETHING THAT'S INTEGRAL TO A COMMUNITY AND IT SPURS ECONOMIC DEVELOPMENT STIMULATING AND ALLOWING FOR ADDITIONAL EMPLOYMENT OPPORTUNITIES AND ADVANCEMENTS. IT COMPLEMENTS THE THE NEARBY ACTIVITIES, WHETHER IT'S THE ACADEMIC AND MAYBE SOMEDAY, I'VE ACTUALLY BEGUN TO REACH OUT ON THIS.

WE'LL HAVE A SATELLITE CAMPUS, COLLEGE CAMPUS NEAR OUR DOWNTOWN.

I CAN CERTAINLY ENVISION THAT.

OUR RESIDENTS HAVING A PLACE TO GO, COMPLEMENTING THE RETAIL IN THIS AREA.

WE GOT A NEW FRY'S. WE HAVE, YOU KNOW, LOTS OF FAST FOOD NEARBY.

BUT THIS IS SOMETHING THAT'S GOING TO BE MUCH DIFFERENT THAN THAT AND WILL SERVE AS A TREMENDOUS COMPLIMENT TO ALL OF THOSE THINGS.

AND THEN EXPANDING JUST THE ENTERTAINMENT AND DINING OPTIONS AND OPPORTUNITIES.

I KNOW THAT'S SOMETHING THAT THE COUNCIL HAS BEEN TALKING ABOUT FOR A VERY LONG TIME, ESPECIALLY FOR PEOPLE HERE IN NORTH MARANA.

ANYTHING REALLY NORTH OF TWIN PEAKS AND EAST OR WEST OF THE I-10, THERE ISN'T A RESTAURANT THAT'S OPEN PAST 2:00 FOR PEOPLE TO GO TO AND HAVE A SIT DOWN MEAL. SO ALL OF THESE THINGS ARE REASONS THAT WE'RE DOING THIS AND GOALS THAT WE HOPE TO ACCOMPLISH IN ADDITION, OF COURSE, TO GENERATING A SIGNIFICANT AMOUNT OF SALES TAX FOR OUR COMMUNITY.

SO THIS I WANT TO KIND OF TAKE YOU THROUGH THE CONCEPT PLAN HERE.

AND THIS IS A RENDERING OF WHAT THIS WILL HOPEFULLY LOOK LIKE ON OUR 20 ACRES.

YOU ALSO NOTICE IN HERE, AND I REALLY LOVE WHEN WE LOOK HERE AT THE, THE VISIONING AND WHAT WAS KIND OF THE INSPIRATION FOR WHAT THE DEVELOPERS CAME UP WITH AND PRESENTED TO US.

YOU'LL SEE SOME THINGS THAT REALLY STAND OUT IN TERMS OF THIS IS REALLY MARANA, IT REALLY SPEAKS TO OUR COMMUNITY, TO OUR HERITAGE, TO OUR CULTURE. AND ONE OF THOSE THINGS IS A POSSIBLE RODEO RINK THERE.

AND THEY GOT OUT THERE AND THEY THEY TOOK A SHOT AT RIDING A BULL, NONE OF THEM WERE VERY SUCCESSFUL, BUT THEY ALL TOOK A SHOT AT IT.

AND SO THEY HAD THE MECHANICAL BULL.

THEY HAD ALL KINDS OF OTHER ENTERTAINMENT TYPE STUFF TO DO THERE.

IT WAS REALLY A VERY ENTERTAINING, WONDERFUL THING.

AND THIS YELLOW AREA THAT'S HIGHLIGHTED IS THE FIRST PHASE WOULD INVOLVE TWO BUILDINGS THAT SERVE AS RESTAURANTS, A BREWERY AND A RESTAURANT, AS WELL AS THE ICONIC SIGN AND THE BRICK ROADWAY LEADING INTO THEIR PART OF THE COMMON EVENT SPACE AREA FOR GATHERING.

AND FOR PARKING RATHER THAN BUILDING THE FULL PARKING LOT, WHICH WOULD BE QUITE A DISTANCE FROM THESE TWO BUILDINGS, WE WOULD BUILD A TEMPORARY PARKING WHERE THE HOTEL WOULD GO.

AND SIMILAR TO IF YOU THINK ABOUT WHAT WE HAD, WHERE THE COMMUNITY CENTER AQUATIC CENTER WAS LOCATED OR IS LOCATED NOW, THAT WAS A LARGE PARKING LOT THAT WE USED FOR ALL OF OUR EVENTS, AND IT WOULD BE A VERY SIMILAR PARKING SPACE THERE THAT WE WOULD USE SO THAT WE WOULDN'T HAVE TO TEAR UP ASPHALT.

AND OF COURSE, YOU HAVE TO HAVE AN ICONIC SIGN THAT ATTRACTS PEOPLE.

AND I DON'T KNOW THAT WE'LL GET AWAY WITH USING THE MARLBORO MAN, BUT AT SOME POINT WE'LL HAVE TO DEVELOP SOME SORT OF SIGN THAT IS OUT THERE BY THE I-10 THAT REALLY LETS PEOPLE KNOW THAT IF YOU DRIVE PAST HERE, YOU'RE GOING TO MISS SOMETHING THAT'S TRULY ICONIC, AND WE DON'T WANT THEM TO DO THAT.

WE NEED TO HAVE SOMEBODY WHO KNOWS WHAT THEY'RE DOING OPENING RESTAURANTS AND RUNNING RESTAURANTS AND THINGS OF THAT NATURE, AND THAT'S WHAT THAT LEASE WILL COVER.

THE DEVELOPER, OF COURSE, WILL BE THE ONE THAT'S RESPONSIBLE FOR SECURING THE LONG TERM TENANTS AND LEASES FOR THE VARIOUS RESTAURANTS AND ENTERTAINMENT VENUES. AND WE WILL HAVE A LEASE THAT REQUIRES THIS INITIATIVE TO BE COMPLETED WITHIN A REASONABLE AMOUNT OF TIME. NOW, THE QUESTION WOULD PROBABLY BE, WHAT'S A REASONABLE AMOUNT OF TIME? AND THAT'S SOMETHING THAT WE'RE ASKING FOR YOUR APPROVAL TO BEGIN NEGOTIATIONS ON.
