DO WE HAVE ANYBODY THAT WOULD LIKE TO ADDRESS THE COUNCIL TONIGHT? NO CARDS. WHAT ARE YOU HERE TO SPEAK ABOUT? WELL, COME ON UP. RIGHT THERE. MARIA [INAUDIBLE] 8485 NORTH ROMAN RIVER DRIVE. THANK YOU. SO I WAS OBVIOUSLY LATE PAYING A BILL, I HONESTLY FORGOT TO PAY IT ONE MONTH. AND THEN WHEN I CALLED [INAUDIBLE] I COULDN'T AFFORD THE LATE FEE, AND SHE TOLD ME THAT IF I COULDN'T PAY THE LATE FEE THAT LATE FEES, I'D GET LATE FEES ON TOP OF LATE FEES. SO I HAVE LATE FEES AT LEAST TWICE. SO I CAN'T AFFORD TO PAY. WELL, I THINK WE HAVE A PROGRAM FOR THAT, MR. ROZEMA. IS THAT NOT THE CASE? VICE MAYOR POST, I THINK OUR WATER DIRECTOR IS HERE, AND HEIDI CAN TALK TO YOU OUTSIDE, IF YOU'D LIKE IN THE LOBBY. SO PROGRAM TO PAY THE LATE FEES. I SHE WOULD BE A BETTER PERSON TO TALK TO ABOUT THAT BUT I'M SURE THAT WE CAN FIGURE THIS OUT. ALL RIGHT. OKAY. ALL RIGHT. THANKS. THANK YOU VERY MUCH. AND GOOD LUCK. THANK YOU. IS THERE ANYBODY ELSE THAT WOULD LIKE TO SPEAK TONIGHT? HEARING NONE, WE WILL MOVE ON TO PROCLAMATIONS. WE DON'T HAVE ANY TONIGHT, THAT'S. MAYOR AND COUNCIL REPORTS. [ MAYOR AND COUNCIL REPORTS: SUMMARY OF CURRENT EVENTS] COUNCIL MEMBER OFFICER. NO REPORT MAYOR. COUNCILMEMBER ZIEGLER. NO REPORT MAYOR. COUNCILMEMBER KAI. NO REPORT. COUNCIL MEMBER CAVANAUGH. I HAVE ONE REPORT AND THIS IS GOING TO BE A LITTLE INTERESTING BECAUSE I'M A CYCLIST, AND I MET ANOTHER CYCLIST ON THE LOOP, AND I TALKED TO HER AND ABOUT HOW MUCH SHE ENJOYS THE LOOP THAT MARANA BUILT FOR ALL OF US. AND IT'S QUITE NICE. I'M RIDING IT, TOO. HERE'S HER VOICE ON THE LOOP. SHE RODE DOWN FROM DOVE MOUNTAIN AND JUST EIGHT SECONDS. OKAY. DO WE ALLOW THAT VICE MAYOR? I DON'T FORESEE IT BEING A PROBLEM. I DON'T HAVE HER. I'M NOT EVEN MENTIONING HER NAME. OKAY. I WAS JUST A LITTLE BIT OUT OF LINE. OKAY. THANK YOU. OKAY, WELL, IF IT'S OUT OF LINE, I WON'T DO IT. I MEAN, IS IT OKAY? YEAH. I DON'T, IT'S JUST REAL SIMPLE. YEAH. I LOVE THE LOVE THE NEW EXTENSION ON THE LOOP. WE CAN GO FROM OUR HOUSE TO THE END OF THAT AND GET 50 MILES IN A DAY, AND THAT'S FABULOUS. LOTS OF POTTYS TOO. OKAY, SO THAT'S HER VOICE AND SHE LOVES IT. AND INSTEAD OF ME JUST SAYING IT, THERE'S THIS TOWN CITIZEN ENJOYING THE LOOP. THANK YOU, THANK YOU, THANK YOU, THANK YOU. COUNCILMEMBER COMERFORD. NO, I DON'T HAVE A REPORT EITHER. MR. ROZEMA. [ MANAGER’S REPORT: SUMMARY OF CURRENT EVENTS] MR. VICE MAYOR AND MEMBERS OF COUNCIL. A FEW THINGS TO UPDATE YOU ON. SOME OF THEM YOU ARE AWARE OF. BUT FOR OUR AUDIENCE AND PEOPLE WHO ARE WATCHING ONLINE, AS ALWAYS, OUR SFR REPORT FOR THE MONTH, WE HAD 55 FOR THE MONTH OF DECEMBER COMPARED TO 2023S NUMBER OF 83. UPDATE ON SAGUARO BLOOM COMMUNITY PARK. PHASE ONE OF THAT CONTINUES TO MOVE ALONG RATHER WELL. THE BATHROOMS ARE IN PLACE. IS MY TIME UP ALREADY. I FELT LIKE I JUST GOT STARTED DAVID, I. ALL RIGHT. THE CONTRACTORS HAVE BEEN FOCUSING ON GETTING THE PLAYGROUNDS. [00:05:05] THOSE HAVE BEEN DELIVERED. SO THEY'RE GETTING THE LITTLE KIDS PLAYGROUND AND THE LARGE PLAYGROUND, THE SHADE STRUCTURES INSTALLING THE TURF. WE'RE PROBABLY ABOUT A MONTH, MONTH AND A HALF AWAY FROM BEING COMPLETE WITH PHASE ONE. AND THEN WE'LL MOVE INTO THANK YOU. LIFEGUARD TRAINING. THE TOWN'S LIFEGUARD TRAINING PARTNERSHIP WITH MUSD BEGAN TODAY. AND THIS IS A CLASS THAT WE'RE ACTUALLY COMBINING WITH MUSD ON AND MUSD ON. AND SOME OF OUR STAFF IS HELPING TO TEACH THIS CLASS, AND WE HAVE, I BELIEVE, 30 OR 25 STUDENTS FROM MARANA HIGH SCHOOL THAT ARE PARTICIPATING IN THAT. A GREAT IDEA FROM OUR PARKS AND REC STAFF IN PARTNERSHIP WITH MUSD, BECAUSE WE'RE GOING TO NEED A LOT OF LIFEGUARDS, AS YOU JUST SAW, HAVING BEEN OVER AT THE TOUR OF THE NEW MARC. AND WHEN THAT OPENS UP AND THOSE POOLS ARE OPEN, WE'RE GOING TO MAKE GOOD USE OF THOSE 25 STUDENTS WHO ARE GOING THROUGH THIS LIFEGUARD TRAINING RIGHT NOW AT THE HIGH SCHOOL. ON DOVE MOUNTAIN BOULEVARD STARTING JANUARY 8TH THROUGH THE 15TH A NEW TRAFFIC SIGNAL WILL BE INSTALLED AT THE INTERSECTION OF DOVE MOUNTAIN BOULEVARD AND MOORE ROAD. I KNOW THAT THE PEOPLE IN DOVE MOUNTAIN HAVE BEEN WAITING FOR THAT FOR SOME TIME, SO THERE WILL BE SOME LANE RESTRICTIONS ON THAT DURING THAT TIME PERIOD. AND AS YOU ARE ALL AWARE, BASED ON THE INFORMATION, PRELIMINARY INFORMATION WE RECEIVED YESTERDAY WITH FORMAL NOTIFICATION BEING MADE THIS COMING FRIDAY, WE RECEIVED A RECEIVED A GRANT. STAFF DID AN OUTSTANDING JOB, AND I COULDN'T EVEN BEGIN TO COUNT ALL THE PEOPLE THAT WERE INVOLVED IN PUTTING THAT TOGETHER. BUT A GRANT WAS SUBMITTED TO THE FEDERAL GOVERNMENT FOR THE FEDERAL RAILROAD CROSSING ELIMINATION GRANT, AND WE RECEIVED $20.4 MILLION TO HELP US WITH THE CORTARO INTERCHANGE. DOES THAT MEAN WE GET TO GET RID OF THE RAILROAD? NO, JUST THE RAIL CROSSING. SO WE'LL GO OVER THE TOP OF IT. THE RAILROAD WILL STILL GO UNDERNEATH IT. THEY GAVE US PERMISSION TO GO OVER THE TOP OF THE RAILROAD. NO, THIS IS JUST MONEY THAT WILL HELP TO BUILD BUILD THE INTERCHANGE THAT GOES OVER IT. AND SO WE HAVE QUITE A WAYS TO GO YET, BUT $20.4 MILLION IS A SIGNIFICANT CHUNK OF MONEY FOR THE TOWN, AND WE'RE VERY APPRECIATIVE OF THAT. AND I'D LIKE TO TAKE A MINUTE OF COURSE, SINCE OUR LAST MEETING, WE HAD OUR MEMORIAL SERVICE AND CELEBRATION OF LIFE CEREMONY FOR MAYOR HONEA, AND I WANTED TO TAKE A MINUTE TO THANK THE DEPARTMENTS THAT WERE INVOLVED. AGAIN, I CAN'T EVEN BEGIN TO COUNT THE NUMBER OF PEOPLE THAT WERE DIRECTLY INVOLVED WITH THIS. BUT THE PARKS AND REC DEPARTMENT, THE PD, THE AIRPORT PUBLIC WORKS COMMUNICATIONS TEAM, VOLUNTEERS LIKE, I CAN'T EVEN COUNT THE NUMBER OF PEOPLE THAT HELPED US IN VOLUNTEERING. NORTHWEST FIRE, MUSD, ALL OF THEM MADE THAT POSSIBLE. AND I WILL GIVE A SHOUT OUT TO ANDREA DE LA CRUZ, BECAUSE SHE WAS THE ONE THAT RAN POINT ON THAT AND JUST DID A PHENOMENAL JOB OF COORDINATING ALL OF THE DIFFERENT DEPARTMENTS AND STAFF AND, CREATING REALLY WHAT WAS A, I BELIEVE, A WONDERFUL AND RESPECTFUL CELEBRATION OF OUR DEARLY DEPARTED MAYOR HONEA. AND THAT CONCLUDES MY REPORT, MR. MAYOR. YOU KNOW, THANK YOU TERRY. I APPRECIATE THAT, AND I WAS BLAZING THROUGH THIS AGENDA SO QUICKLY. I ALSO WANTED TO MENTION THAT THAT WAS SUCH A MOVING TRIBUTE TO ED HONEA. IT WAS JUST ABSOLUTELY FANTASTIC. I COULDN'T HAVE PICTURED IT HAPPENING ANY BETTER THAN WHAT IT DID. AND OUR STAFF, YOU'RE RIGHT. THEY DID JUST A TREMENDOUS JOB, YOU KNOW. AND WHY I ALSO FORGOT THIS ITEM IT JUST HAPPENED AN HOUR AGO, BUT THE MARC IS JUST UNBELIEVABLE. I AM JUST BLOWN AWAY. I MEAN, AND IF YOU EVER GET A CHANCE TO TOUR IT, TAKE JIM WITH YOU, BECAUSE HE JUST IS SO PROUD OF IT AND HE LOVES IT. AND IT'S JUST AN AMAZING IT'S GOING TO BE SUCH A HUGE THING FOR OUR COMMUNITY. I'M JUST SUPER EXCITED. AND THE LAST THING, AND ACTUALLY THE MOST IMPORTANT THING IS I WANTED TO WISH MY GRANDSON A HAPPY BIRTHDAY. [00:10:03] SO I KNOW HE'S WATCHING BECAUSE HIS MOTHER ALWAYS WATCHES. SO I WANT TO WISH MY GRANDSON A HAPPY BIRTHDAY, REED HAPPY BIRTHDAY. YEAH. HE'S FOUR. IT'S MY SON'S BIRTHDAY. HAPPY BIRTHDAY DONOVAN. WAIT A MINUTE. THAT'S MY GRANDSON. LET ME BACK UP. JEFFREY 48 TODAY. CONSENT AGENDA. COUNCIL'S PLEASURE. [ CONSENT AGENDA The Consent Agenda contains items requiring action by the Council which are generally routine items not requiring Council discussion. A single motion and affirmative vote will approve all items on the Consent Agenda, including any resolutions or ordinances. Prior to a motion to approve the Consent Agenda, any Council member may remove any item from the Consent Agenda and that item will be discussed and voted upon separately.] MOTION TO APPROVE. SECOND. ALL THOSE IN FAVOR? AYE. ITEM PASSES. COUNCIL ACTION A1, DAVID. [ PUBLIC HEARING: Ordinance No 2025.001: Relating to Development; approving a rezoning of approximately five acres of land located at 13049 N. Coyote Howl Road, approximately one-quarter mile north of the intersection of Moore Road and Coyote Howl Road, from AG (Agricultural) to R-36 (Single-Family Residential) (Scott S. Radden)] ITEM A1 PUBLIC HEARING. ORDINANCE NUMBER 2025.001 RELATING TO DEVELOPMENT. APPROVING A REZONING OF APPROXIMATELY FIVE ACRES OF LAND LOCATED AT 13049 NORTH COYOTE HOWL ROAD, APPROXIMATELY ONE QUARTER MILE NORTH OF THE INTERSECTION OF MOORE ROAD AND COYOTE HOWL ROAD FROM AG AGRICULTURAL TO R-36 SINGLE FAMILY RESIDENTIAL. GOOD EVENING SCOTT. MR. VICE MAYOR, COUNCIL MEMBERS, GOOD EVENING. TONIGHT WE'VE GOT ORDINANCE 2025.001. IT IS, I GUESS ARE WE OPENING THE PUBLIC HEARING? YES, WE ARE IN PUBLIC HEARING. OKAY. THE APPLICANT IS LAZARUS AND SYLVYN. THEY'RE REPRESENTING CYNTHIA COLEMAN AND ROXANNE HAMPTON, WHICH ARE THE OWNERS. THE REQUEST IS FOR A NON SITE ANALYSIS REZONE FROM AG TO R-36. IT IS APPROXIMATELY FIVE ACRES, AND IT'S GENERALLY LOCATED ABOUT A QUARTER MILE NORTH OF MOORE AND COYOTE HOWL INTERSECTION. THE GENERAL PLAN HAS THAT AS RURAL RESIDENTIAL, AND AS YOU CAN SEE ON THESE MAPS HERE, WE'VE GOT THE GENERAL PLAN AND THE ZONING. THE INTENT IS TO SPLIT THIS PARCEL INTO THREE SEPARATE LOTS CONTINUING AS A CONSISTENT USE WITHIN THE 2040 GENERAL PLAN. AS YOU CAN SEE HERE, WE'VE ALREADY GOT ONE R-36 SPOT SITTING DOWN HERE. I DON'T KNOW HOW THAT GOT IN THERE, BUT IT'S THERE. AND THEN ACROSS THE STREET WE'VE GOT SOME OF THE LOWER DENSITY RESIDENTIAL AREAS, TORTOLITA 30 IS RIGHT ACROSS THE STREET. WITH THAT BEING SAID, THE PLANNING COMMISSION CONSIDERED THIS REQUEST AT THE DECEMBER 11TH, 2024 MEETING FROM A VOTE OF 7 TO 0 TO RECOMMEND APPROVAL TO THE TOWN COUNCIL, SUBJECT TO THE RECOMMENDED CONDITIONS. THIS IS A DISCRETIONARY ITEM FOR THE TOWN COUNCIL, AND SHOULD THE COUNCIL CHOOSE TO APPROVE THIS ITEM. STAFF RECOMMENDS APPROVAL BE SUBJECT TO THE CONDITIONS SET FORTH IN THE DRAFT ORDINANCE. THANK YOU. ARE THERE ANY QUESTIONS FOR SCOTT? I HAD A QUESTION. IS THIS IS THIS GOING TO BE JUST SIMPLY DIVIDED UP IN RESIDENTIAL HOMES BUILT ON IT, OR IS IT GOING TO BE STILL RURAL, 36 WITH LIVESTOCK? MR. VICE MAYOR, COUNCILMAN CAVANAUGH TONIGHT WE DO HAVE A REPRESENTATIVE OF THE APPLICANTS IF YOU WOULD LIKE TO ASK THEM DIRECTLY, THEY MIGHT BE ABLE TO EXPAND A LITTLE BIT MORE ON IT. BECAUSE IT DIDN'T REALLY SAY HERE ON THIS, ON THE PRESENTATION. SURE. THANK YOU SCOTT. EVENING, MR. MAYOR. AND MEMBERS OF THE COUNCIL. I'M RORY JUNEMAN, WITH LAZARUS AND SILVYN, WE'RE REPRESENTING THE PROPERTY OWNERS HERE. COUNCILMEMBER CAVANAUGH, THIS IS A KIND OF A SMALL SCALE PROJECT, BUT NOT SMALL TO THE PROPERTY OWNERS. THEY'RE GOING TO DIVIDE THIS INTO THREE LOTS. THEY'RE GOING TO KEEP IT IN THE FAMILY. THERE'S ONE OF THE FAMILY MEMBERS LIVES THERE RIGHT NOW. AND THEN THEY'RE GOING TO DIVIDE THIS INTO THE THREE PARCELS. AND THE PLAN IS FOR JUST FAMILY MEMBERS TO LIVE ON THE PROPERTY. ANY OTHER QUESTIONS? [INAUDIBLE] I WAS JUST GOING TO SAY YOUR FIRM ALWAYS DOES A FANTASTIC JOB. I LOVE TO GET YOUR STUFF BECAUSE YOU LEAVE NOTHING TO BE ASKED. SO SYLVYN IS [INAUDIBLE] IS ALWAYS BANGING. SO THANK YOU GUYS FOR THAT, IT'S EASY WHEN YOU GET THROUGH HERE. AND YOU GUYS PICKED A GOOD FIRM, I GUESS YOU KNOW THAT. WE APPRECIATE THAT. YEAH. ANYBODY ELSE FROM THE PUBLIC THAT WOULD WISH TO SPEAK ON THIS ITEM TONIGHT? HEARING NONE, I'M GOING TO CLOSE THE PUBLIC HEARING. [00:15:01] COUNCIL'S PLEASURE. I'LL MAKE A MOTION. MAYOR COUNCILMEMBER ZIEGLER I SECOND IT. I DIDN'T MAKE THE MOTION YET. OKAY, THAT'D BE A GOOD IDEA. WELL, YOU KNOW WHAT I DON'T HAVE IT IN FRONT OF ME, BUT I'LL JUST MOVE TO APPROVE. GREAT. WE HAVE A SECOND. I'LL SECOND. ALL THOSE IN FAVOR? AYE. CONGRATULATIONS. A2. ITEM A2, PUBLIC HEARING ORDINANCE NUMBER 2025.002 RELATING TO LAND DEVELOPMENT. [ PUBLIC HEARING: Ordinance No. 2025.002: Relating to Land Development; adopting amendments to Marana Town Code Title 17 “Land Development”; amending sections 17-4-2 (Use matrix) and 17-4-3 (Use conditions matrix) to allow up to 6 chickens to be kept on a single-family detached residential lot that is one-half acre or less in size and prescribing development regulations related to the keeping of chickens; amending section 17-6-7 (Animal-keeping) to add additional animal-keeping requirements for chickens; approving the housing impact statement pertaining to this ordinance; and designating an effective date (Matt Taylor) Resolution No. 2025-002: Relating to Land Development; declaring as a public record filed with the Town Clerk the amendments adopted by Ordinance No. 2025.002, revisions to Title 17 "Land Development" of the Marana Town Code, including amending sections 17-4-2 (Use matrix) and 17-4-3 (Use conditions matrix) to allow up to 6 chickens to be kept on a single-family detached residential lot that is one-half acre or less in size and prescribing development regulations related to the keeping of chickens; and amending section 17-6-7 (Animal-keeping) to add additional animal-keeping requirements for chickens (Matt Taylor) ] ADOPTING AMENDMENTS TO MARANA TOWN CODE TITLE 17, LAND DEVELOPMENT, AMENDING SECTIONS 17-4-2 USE MATRIX AND 17-4-3 USE CONDITIONS MATRIX TO ALLOW UP TO SIX CHICKENS TO BE KEPT ON A SINGLE FAMILY DETACHED RESIDENTIAL LOT THAT IS ONE HALF ACRE OR LESS IN SIZE, AND PRESCRIBING DEVELOPMENT REGULATIONS RELATING TO THE KEEPING OF CHICKENS. AMENDING SECTION 17-6-7 ANIMAL KEEPING TO ADD ADDITIONAL ANIMAL KEEPING REQUIREMENTS FOR CHICKENS. APPROVING THE HOUSING IMPACT STATEMENT PERTAINING TO THIS ORDINANCE AND DESIGNATING AN EFFECTIVE DATE. AND RESOLUTION NUMBER 2025-002 RELATING TO LAND DEVELOPMENT DECLARING IS A PUBLIC RECORD FILED WITH THE TOWN CLERK. THE AMENDMENTS ADOPTED BY ORDINANCE NUMBER 2025.002. I KNEW THIS WAS ON THE AGENDA, BUT HEARING YOU READ WAS JUST... I DECLARE THIS A PUBLIC HEARING. WE ARE NOW OPEN. MR. TAYLOR. THANK YOU, MR. VICE MAYOR AND MEMBERS OF THE COUNCIL. MY NAME IS MATT TAYLOR. THIS IS THE FIRST TIME I'VE BEEN BEFORE YOU. BUT IT'S A PLEASURE. WELCOME. THANK YOU. I'M HERE TONIGHT TO PRESENT PROPOSED REVISIONS TO TITLE 17 REGARDING THE BACKYARD FOWL REGULATIONS RELATED TO CHICKENS. I WOULD LIKE TO SAY THAT ATTORNEY TOWN ATTORNEY FAIRALL DID PREPARE THESE REVISIONS WHY I'M HERE TONIGHT, PRESENTING IS BECAUSE I DID THE PRESENTATION TO THE PLANNING COMMISSION WHEN SHE WAS AWAY, SO. AND I DO APOLOGIZE ON THAT TITLE PAGE, I SEE THAT I FORGOT TO CHANGE TO 2025, BUT HAPPY NEW YEAR AS WELL. SO A LITTLE A LITTLE BACKGROUND ON THIS. HOUSE BILL 2325 WAS PASSED IN THE LAST LEGISLATIVE SESSION AND IT BECAME LAW IN SEPTEMBER. THE BILL MANDATED THAT CITIES AND TOWNS ALLOW THE KEEPING OF UP TO SIX CHICKENS ON ANY LOT WITH A SINGLE FAMILY DETACHED RESIDENCE UNDER A HALF ACRE. MARANA TOWN CODE CURRENTLY ALLOWS UP TO 40 CHICKENS PER ACRE ON LARGER LOTS TO RANCHETTE ZONED AND THE AGRICULTURAL ZONED LOTS. BUT THE KEEPING OF CHICKENS ON LOTS LESS THAN 6,000FT² IS CURRENTLY PROHIBITED IN THE IN THE MARANA TOWN CODE. SO THE REVISIONS PREPARED BY TOWN ATTORNEY FAIRALL WOULD BRING BRING THE MARANA TOWN CODE INTO COMPLIANCE WITH STATE LAW. THE PROPOSED CHANGES ALLOW THE KEEPING OF CHICKENS ON LOTS LESS THAN 6,000FT², THAT INCLUDES LOTS THAT MIGHT BE ZONED COMMERCIAL OR MULTI-FAMILY, BUT HAVE A SINGLE FAMILY RESIDENCE ON THAT LOT. THEY'RE AS ALLOWED BY LAW OR AS REQUIRED BY LAW, I SHOULD SAY. THERE IS A LIMIT. THERE'S A PROPOSED LIMIT ON THE HEIGHT OF A HENHOUSE OR SIMILAR ENCLOSURE, AND IT HAS TO BE LOWER THAN THE FENCE LINE, AND ON SMALLER LOTS THAT MAXIMUM HEIGHT IS EIGHT FEET. SO THE CHANGE ALSO INCLUDES RESTRICTIONS RELATED TO SIZE, LOCATION AND SETBACKS OF THE ENCLOSURES FOR CHICKENS, WHICH ARE OPTIONAL UNDER THE LAW, BUT THEY WERE INCLUDED IN THIS PROPOSAL. LASTLY, THE PROPOSED REVISIONS THERE WOULD BE PROPOSED REVISIONS TO BE MADE TO SECTION 17-6-7 OF THE MARANA TOWN CODE REGARDING ANIMAL KEEPING, AND THIS IS REALLY DESIGNED TO ESTABLISH A FEW BEST MANAGEMENT PRACTICES FOR KEEPING KEEPING POULTRY, KEEPING CHICKENS ON SMALLER LOTS. THE PLANNING COMMISSION HELD A HEARING ON DECEMBER 11TH AND VOTED 7 TO 0 TO RECOMMEND TO TOWN COUNCIL APPROVAL OF THIS, THESE PROPOSED REVISIONS. I DO WANT TO NOTE THAT THE WHAT WAS PRESENTED TO THE PLANNING COMMISSION ON DECEMBER 11TH INCLUDED TWO MINOR CHANGES TO DEFINITIONS, AND THOSE CHANGES HAVE SINCE BEEN WITHDRAWN AFTER FURTHER REVIEW BY STAFF. IT WAS DETERMINED THAT THEY REALLY WOULD BE UNNECESSARY. SO JUST A FEW THINGS OF NOTE. THESE PROPOSED CHANGES DON'T AFFECT ANY LAND GOVERNED BY A SPECIFIC PLAN. HOMEOWNERS ASSOCIATIONS WOULD HAVE THE SAME RIGHTS TO REGULATE THESE USES THAT THEY DO CURRENTLY. AS IT CURRENTLY STANDS, THE KEEPING OF ROOSTERS AND OTHER FOWLS, OTHER FOWLS WILL ONLY BE ALLOWED IN THE AGRICULTURAL AND RANCHETTE ZONES ON LARGER LOTS OVER 80,000FT². [00:20:03] AND AS YOU ALL KNOW, THE TOWN CANNOT ADOPT STANDARDS THAT ARE MORE STRINGENT THAN THOSE SPECIFIED IN THE STATUTE. THIS IS THE LEGISLATURE IS BASICALLY MANDATING THIS CHANGE. SO WITH THAT, THAT CONCLUDES MY PRESENTATION. THE STAFF DOES RECOMMEND ADOPTION OF OF THESE PROPOSED AMENDMENTS, AS WELL AS THE PLANNING COMMISSION RECOMMENDS ADOPTION AS WELL. ARE THERE ANY QUESTIONS FOR STAFF? COUNCILMEMBER COMERFORD. SO WHEN YOU SAY THAT REVISIONS WOULD ALSO BE MADE IN ITS ANIMAL KEEPING TO ESTABLISH SEVERAL BEST MANAGEMENT PRACTICES, DO YOU HAVE THAT SPELLED OUT MORE IN THE ACTUAL CODE? SURE. YES. IT IS IN THE ORDINANCE THAT I THINK YOU RECEIVED IN YOUR PACKET. BUT JUST TO LIST THE THE BEST MANAGEMENT PRACTICES. THERE'S THERE'S FIVE OF THEM, ACTUALLY. ANIMAL KEEPING IS COMPLETELY ENCLOSED WITHIN A FENCE CAPABLE OF CONTAINING THE ANIMALS. CONSTRUCTION MATERIALS HAVE TO BE NONTOXIC. ANIMAL KEEPING CAN'T CREATE A NUISANCE FOR SURROUNDING PROPERTIES. THE GENERATION OF DUST HAS TO BE MINIMIZED. AND LASTLY, OUTDOOR LIGHTING. CAN'T CAST A GLARE TOWARDS THE STREET OR ADJACENT PROPERTIES. EXPENSIVE RIGHT NOW IN THE STORE. BUT MY ONLY CONCERN IS THAT, YOU KNOW, WHATEVER CLEANED OUT KIND OF ON A NORMAL BASIS BECAUSE THEY CAN GET... VICE MAYOR POST COUNCILMEMBER COMERFORD THIS ORDINANCE ACTUALLY WHAT IT ADDS TO SECTION 17-6-7 ANIMAL KEEPING IS THESE PROVISIONS. AND IT'S IT'S IN THE PACKET. IT'S ENCLOSURES SHALL BE MAINTAINED AND MANURE PICKED UP AND DISPOSED OF OR COMPOSTED AT LEAST TWICE WEEKLY. AND THAT'S WHAT THE STATE LAW ALLOWS US TO DO. AND THEN COMPOSTED MANURE SHALL BE KEPT IN A WAY THAT PREVENTS MIGRATION OF INSECTS. WATER SOURCES SHALL HAVE ADEQUATE OVERFLOW, DRAINAGE AND FEED SHALL BE STORED IN INSECT PROOF AND RODENT PROOF CONTAINERS. SO THAT'S ACTUALLY WHAT WHAT MR. TAYLOR SAID WAS WHAT'S CURRENTLY ALREADY THERE. THESE ARE THE ADDITIONS THAT WE'RE PROPOSING. YEAH. COUNCIL MEMBER CAVANAUGH. YEAH. I DON'T KNOW IF WE ARE GOING TO BE PART OF THIS BECAUSE THIS HAS THIS. THIS IS ONLY ALLOWED IN AG AND RA ZONES. CORRECT? NO. IT ACTUALLY COVERS SMALLER LOTS, BUT IT DOESN'T INCLUDE LAND THAT WOULD BE ZONED AS A SPECIFIC PLAN. SO HOAS WOULD STILL HAVE THE SAME AUTHORITIES. IF CHICKENS AREN'T ALLOWED IN A SPECIFIC PLAN AREA, THEY WOULD MAKE THAT DECISION ALOUD. OKAY. THANK YOU. WOULD ANYBODY FROM THE PUBLIC LIKE TO TALK ABOUT CHICKENS? HEARING NONE, I DECLARE THE PUBLIC HEARING OVER. COUNCIL'S PLEASURE. ALL RIGHT, I'LL DO IT. COUNCILMEMBER COMERFORD. THANK YOU. I MOVE TO APPROVE PUBLIC HEARING ORDINANCE NUMBER 2025.002. AND RESOLUTION NUMBER 2025-002 APPROVING CHICKENS IN LOTS. I'LL SECOND THAT. I HAVE A MOTION AND A SECOND. ALL THOSE IN FAVOR? AYE. ITEM PASSES A3. [ Relating to Mayor and Council; appointment of a Council member to fill the vacancy in the mayor's position (Jane Fairall)] ITEM A3 RELATING TO MAYOR AND COUNCIL. APPOINTMENT OF A COUNCIL MEMBER TO FILL THE VACANCY IN THE MAYOR'S POSITION. MISS FAIRALL. VICE MAYOR POST, MEMBERS OF MEMBERS OF THE COUNCIL, PURSUANT TO STATE LAW AND TOWN CODE AFTER THE PASSING OF MAYOR HONEA, AS YOU ALL KNOW, IT WAS EARLY IN HIS TERM AFTER HE HAD JUST BEEN SWORN INTO THE NEW FOUR YEAR TERM. SO WHAT NEEDS TO OCCUR AT THIS POINT IS THAT THE MAYOR AND COUNCIL CHOOSE A COUNCIL MEMBER SEATING CITY COUNCIL MEMBER WHO IS WILLING TO RESIGN FROM THEIR COUNCIL MEMBER POSITION TO ASSUME THE POSITION OF MAYOR FOR THE NEXT COUPLE OF YEARS UNTIL WE HAVE OUR NEXT PRIMARY AND GENERAL ELECTION, WHICH IS IN 2026. NORMALLY THE MAYOR POSITION WOULD BE UP AT THAT TIME, BUT WE WILL NEED TO HAVE A SPECIAL ELECTION FOR MAYOR TO SERVE FOR THE FINAL TWO YEARS UNTIL 2028, AT WHICH POINT WE WOULD BE BACK ON OUR NORMAL SCHEDULE. [00:25:06] BUT FOR TONIGHT THE WAY THIS WOULD HAPPEN IS JUST TO ANY COUNCIL MEMBER CAN MAKE CAN MAKE A MOTION TO APPOINT ONE OF THE OTHER COUNCIL MEMBERS TO BE MAYOR, AND IT'S JUST A SIMPLE MOTION. SECOND AND VOTE. AND WITH THAT, I'D BE HAPPY TO ANSWER ANY QUESTIONS. THANK YOU. COUNCILMEMBER COMERFORD. OKAY. I'D LIKE TO APPOINT COUNCIL MEMBER, VICE MAYOR JON POST TO FILL THE POSITION OF MAYOR. THANK YOU. I HAVE A MOTION AND A SECOND. THANK YOU ALL FOR THAT. ALL THOSE IN FAVOR? AYE. OPPOSED? ITEM PASSES. CONGRATULATIONS. THANK YOU VERY MUCH. YOU KNOW, I STILL EVERY DAY THINK OF ED. YOU KNOW, I NEVER I LOVED BEING SECOND BEHIND ED. IT WAS IT WAS ONE OF THE THE BEST TIMES OF MY LIFE. I THOUGHT I WAS ALWAYS GOING TO JUST BE JUST BE RIGHT BEHIND ED. IT WAS A VERY GREAT PLACE TO BE. I DIDN'T EVER TRULY HAVE ASPIRATIONS TO TO BE MAYOR, BECAUSE ED DID SUCH A GREAT JOB THAT HE MADE IT SUCH A GREAT PLACE TO SERVE. AND SO WITH HIS PASSING, I APPRECIATE THE COUNCIL PUTTING THEIR TRUST IN ME TO MOVE THE TOWN FORWARD AND I WON'T LET YOU DOWN. THANK YOU. THANK YOU. ITEM D1. ITEM D1 RELATING TO MAYOR AND COUNCIL SELECTION OF THE VICE MAYOR. [ Relating to Mayor and Council; selection of the vice mayor (David L. Udall)] DAVID, IS THIS ON YOU? MAYOR POST, MEMBERS OF THE COUNCIL. THIS ITEM WAS ADDED TO TONIGHT'S AGENDA IN THE EVENT THAT THERE WAS A VACANCY IN THE VICE MAYOR POSITION. SINCE THAT HAS HAPPENED THE TOWN CODE PROVIDES THAT PROVIDES THAT COUNCIL MEMBERS MAY CHOOSE A VICE MAYOR FROM AMONG THEIR MEMBERSHIP BY MAJORITY VOTE. KIND OF SIMILAR TO WHAT WAS ALREADY DONE. IF YOU HAVE ANY QUESTIONS, I'D BE HAPPY TO ANSWER. THANK YOU, MR. UDALL. YOU'RE WELCOME. COUNCILMEMBER KAI. THANK YOU. MAYOR, I'D LIKE TO NOMINATE COUNCIL MEMBER ROXANNE ZIEGLER TO SERVE AS OUR VICE MAYOR FOR THE TOWN OF MARANA. I HEAR A SECOND. SECOND. GOT ONE. MOTION AND A SECOND. ALL THOSE IN FAVOR? AYE. CONGRATULATIONS. THANK YOU FOR THAT. NEVER THOUGHT I WOULD GET TO VICE MAYOR AT ALL, TO TELL YOU THE TRUTH. AND UNFORTUNATELY ON WHAT HOW I DID GET HERE, FIRST OF ALL, THANK YOU COUNCIL, FOR YOUR SUPPORT AND CONFIDENCE IN ME. IT'S HARD FOR ME TO TALK ABOUT THE MAYOR, SO I'LL KEEP IT SHORT, BUT I DIDN'T REALLY WANT TO GET HERE THAT WAY, BUT IT LEFT A GREAT VISION FOR US. AND WE'RE GOING TO WE'RE GOING TO KEEP PROMISES WE MADE IN THE VISION THAT WE HAVE. YOU'LL BETWEEN JON AND I, WE'RE A LITTLE BIT DIFFERENT THAN VICE MAYOR. I'M SORRY, MAYOR HONEA, SO THAT MAY TAKE SOME GETTING USED TO. BUT ANYWAY, THANK YOU VERY MUCH FOR THE VOTE. THANK YOU. THANK YOU HERB. MISS FAIRALL, CAN WE SWAP D3 AND D2? THAT'S WHAT I WAS JUST GOING TO ASK. MAYOR MAYOR POST I WAS GOING TO SAY VICE MAYOR, BUT MAYOR POST. YES, WE CAN, WE CAN DO THAT. D3, PLEASE. ITEM D3, RELATING TO DEVELOPMENT AND PUBLIC WORKS UPDATE DISCUSSION AND POSSIBLE DIRECTION REGARDING PUBLIC AND PRIVATE PROJECTS AND [ Relating to Development and Public Works; update, discussion, and possible direction regarding public and private projects and development applications on the Town’s Marana Current and Proposed Projects internet site (Jason Angell)] DEVELOPMENT APPLICATIONS ON THE TOWN'S MARANA CURRENT AND PROPOSED PROJECTS INTERNET SITE. MR. ANGELL. MAYOR POST, VICE MAYOR ZIEGLER, COUNCIL, AS WE DO THE FIRST MEETING OF EVERY MONTH, AND IT'S BEEN A LITTLE WHILE SINCE WE'VE DONE THIS. WE DO UPDATES, BUT I'LL CONTINUE MY PROMISE ONLY GOOD NEWS WHEN WE DO THIS. SO JUST A COUPLE OF THINGS YEAH. NOT MUCH. DECEMBER IS USUALLY A QUIET MONTH FOR US, SO THERE'S NOT MUCH TO REPORT ON HERE. TO THE VICE MAYOR'S REQUEST, THE FIRST ITEM WE'LL TOUCH ON IS ACTUALLY A RESTAURANT. IT'S WELL, IT'S TACO BELL. THIS IS THE ONE THAT, THIS IS PART OF THE DEVELOPMENT THAT'S OVER AT TANGERINE AND I-10 GOING UP ADJACENT TO WHERE THE STARBUCKS IS CURRENTLY TAKING SHAPE OVER THERE. SO YOU'LL HAVE THE STARBUCKS, THE TACO BELL, ACE HARDWARE WILL BE BEHIND THAT STARBUCKS THERE, AND THE CAR WASH IS A LITTLE BIT OUT THE WAY. [00:30:05] NO NEW RESIDENTIAL PROJECTS. WE HAVE A NUMBER OF PROJECTS THAT CONTINUE TO WORK THROUGH THIS MIDDLE PROCESS. THERE IS ONE LAND USE APPLICATION THAT I WANTED TO TOUCH ON IF IT'LL LOAD HERE. AND THIS IS ACTUALLY A 39 ACRE ANNEXATION OFF OF LINDA VISTA. JUST TO THE EAST OF THE AMERICAN HOMES FOR RENT DEVELOPMENT THAT IS GOING UP OVER THERE. SO 39 ACRE RESIDENTIAL MIXED SINGLE FAMILY RESIDENTIAL AND MULTI-FAMILY RESIDENTIAL IS WHAT IS BEING PROPOSED AS PART OF THE PROJECT. BUT WE'LL HAVE TO DO IT IN THE TWO STEPS OF GOING THROUGH AN ANNEXATION. TRANSLATION REZONE FROM WHAT IT IS IN THE COUNTY TO WHAT IT TRANSLATES HERE. THEN THEY'LL DO THE REZONING AS PART OF THE DEVELOPMENT. SO I WOULD SAY WITHIN THE NEXT COUPLE OF MONTHS THAT ANNEXATION REQUEST WILL BE BEFORE THIS BODY FOR CONSIDERATION. COMMERCIAL PERMITS? NOT MUCH. YES. COUNCILMEMBER COMERFORD. YEAH. I MAY HAVE NOT HEARD IT. DID THEY SAY WHAT THEY WANT TO DO? MAYOR POST, VICE MAYOR ZIEGLER, COUNCILMEMBER COMERFORD. I'M GOING TO WALK. YOU'RE DOING GOOD. IT'S JUST YOU GET IN THAT ROUTINE. YEAH. THEY HAVEN'T SPELLED OUT SPECIFIC THE TOTAL NUMBER OF UNITS. BUT WHAT THEY'RE LOOKING AT IS A MIXTURE OF SINGLE FAMILY, RESIDENTIAL, STANDARD, SINGLE FAMILY, WHICH IS SHOWN IN THE IMAGE HERE IN THE LIGHT YELLOW. AND THEN THE DARKER BROWN IS WHAT THEY'RE PROPOSING AS BEING MULTIFAMILY IN THAT AREA. THEY HAVE NOT PRESENTED ANY CONCEPTUAL SITE PLAN THAT LAYS OUT THE UNIT COUNTS OR ANYTHING LIKE THAT, AND THEY HAVEN'T REPRESENTED WHAT TYPE OF UNITS WOULD BE IN THERE. SO THAT WOULD COME AS PART OF THE REZONING PROCESS. THIS IS JUST THE ANNEXATION REQUEST. YES, YES. I WON'T GO INTO THE INDIVIDUAL PERMITS. TOWN MANAGER HAD ALREADY TOUCHED ON THE SINGLE FAMILY PERMIT. WHAT WE HAVE IS THE EXISTING PROJECTS, WHICH ARE ALL LISTED HERE IN TOTAL, 2,100 UNITS APARTMENTS THAT ARE UNDER CONSTRUCTION, WE HAVE 01,600 UNITS THAT ARE UNDER CONSTRUCTION. GLADDEN FARMS. THAT IS MOVING QUITE NICELY. I THINK THERE'S SIX BUILDINGS THAT ARE UNDER CONSTRUCTION THERE, SO ABOUT HALF OF THE TOTAL THAT WILL BE CONSTRUCTED. BUT THEN YOU'VE GOT THE SAFFORD APARTMENTS, THE ALEXANDER WHICH IS THE ALEXANDER IS THE ONE BEHIND TARGET. WELL, THAT'S BEEN UNDER CONSTRUCTION FOREVER. YEAH. THEY'VE THEY'VE HIT QUITE A FEW SNAGS WITH THAT PROJECT, BUT THEY'RE STILL MOVING FORWARD. AND WE'VE BEEN IN RECENT CONVERSATIONS WITH THEM AS TO THE STATUS OF THINGS. MR. SEARS, DAWN SEARS IS THE DEVELOPER OF THAT ONE. [INAUDIBLE] NO, NO, NO, I JUST WANTED TO. HOW MANY JUST DO WE HAVE THAT ARE WE HAVE 1,600 THAT ARE UNDER CONSTRUCTION RIGHT NOW, JUST OVER 1,600. YEAH. WE TALKED ABOUT IT NOT TO GET OFF THE PATH. WE WOULD TYPICALLY SEE ONE APARTMENT PROJECT EVERY 3 TO 5 YEARS. WE'VE DONE 1,800 UNITS IN THE LAST THREE YEARS HERE. EACH ONE OF THEM IS ROUGHLY 250 TO 300. WE DO KNOW THAT THERE WAS A YOU MAY RECALL RECENTLY THE SOUTHWEST CORNER OF INA AND SILVERBELL. SO KITTY CORNER FROM THE AMAZON FACILITY WAS A REZONING THAT WAS APPROVED BY THE COUNCIL A SHORT WHILE AGO, AND THAT WAS TO ALLOW FOR APARTMENTS TO BE CONSTRUCTED IN THERE AS WELL AS POTENTIALLY APARTMENTS AS ONE OF THE USES. THAT DEVELOPER IS THE SAME ONE THAT DID THE SILVERBELL GATEWAY APARTMENTS JUST TO THE NORTH OF THE AMAZON FACILITY, AND HE HAS SINCE TOLD US THAT THE MARKET IS TOO SATURATED RIGHT NOW, THAT PROJECT IS NOT GOING TO MOVE FORWARD, SO. WE'RE DOWN SIMILAR TO THE SFR. [00:35:03] SO WE'RE DOWN TO 222 TOTAL PERMITS. WE TYPICALLY DO ABOUT 400 A MONTH. BUT LIKE I SAID, DECEMBER, AS YOU SEE OVER THE YEARS, DECEMBER IS USUALLY A QUIETER MONTH FOR US. CAN I ASK YOU TO SPEAK UP? I DON'T, FOLKS IN THE BACK CAN'T HEAR YOU. YEAH, I'M HAVING TROUBLE, BUT THE FOLKS IN THE BACK. OKAY. THANK YOU. YEP. COUNCILMEMBER COMERFORD. DID YOU HAVE A QUESTION? YEAH, I JUST HAVE A QUESTION ABOUT A PROPERTY. OH. I'M SORRY, I'M SORRY. I'M JUST NOT THINKING REAL CLEAR. SO THERE'S A PROPERTY ON INA, THAT'S BEEN UNDER CONSTRUCTION, I DON'T KNOW, THREE YEARS, MAYBE FOUR YEARS NOW THAT'S SUPPOSED TO BE A MARKET. OH, YEAH. YEAH. NOW THEY'RE REALLY MOVING FORWARD. WELL, SORRY. I MEAN, NO, I MEAN, I JUST, I, YOU KNOW, PEOPLE ASK AND PEOPLE ASK AND I'M LIKE, I DON'T KNOW.
