Revisions to the agenda appear in italics. Marana Planning Commission Welcome to this public meeting of the Marana Planning Commission. The Commission consists of seven citizens who are appointed by the Town Council and serve without pay. For the most part, the Commission acts in an advisory capacity to the Town Council on matters related to land use planning and zoning. Citizens are encouraged to address the Commission with their concerns on agenda items during the public testimony portions of the meeting, or other issues at the Call to the Public. Meeting Times Regular Commission meetings are usually held on the last Wednesday of each month at 6:00 PM at the Marana Municipal Complex, although the date or time may change and additional meetings may be called at other times and/or places. Speaking at Meetings If you are interested in speaking to the Commission during the Call to the Public or Public Hearings, you must fill out a speaker card (located inside the Council Chambers) and deliver it to the Planning Commission Secretary prior to the convening of the meeting. All persons attending the Commission meeting, whether speaking to the Commission or not, are expected to observe the Commission rules, as well as the rules of politeness, propriety, decorum and good conduct. Any person interfering with the meeting in any way, or acting rudely or loudly will be removed from the meeting and will not be allowed to return. THERE WERE 280FT FROM EACH SIDE AND THEN 67FT FROM THE FRONT.
AND LIKE I SAID, WE'RE SITTING BACK BEHIND THAT SHOPPING CENTER THERE.

I'M FEELING BETTER, BUT I'M A LITTLE CONGESTED STILL, SO I MIGHT SOUND A LITTLE FUNNY. BUT I'M HERE TONIGHT BEFORE YOU TO DISCUSS AMENDING THE LAND DEVELOPMENT CODE TITLE 17 TO ADD REGULATIONS RELATED TO MIDDLE HOUSING. THIS SLIDE WILL PROBABLY SEEM PRETTY FAMILIAR BECAUSE WE'VE DONE THIS A FEW TIMES NOW AS THE LEGISLATURE KEEPS PASSING BILLS EVERY SESSION THAT REQUIRES CITIES AND TOWNS TO THEN PASS AN ORDINANCE THAT ADDRESSES THE THINGS THE LEGISLATURE WANTS YOU TO PASS.
IN THIS PARTICULAR CASE, HOUSE BILL 2721 WAS ADOPTED IN THE 2024 LEGISLATIVE SESSION.
BUT WE ARE BRINGING IT FORWARD NOW BECAUSE THE REQUIREMENT IN THIS PARTICULAR BILL WAS THAT ALL ARIZONA MUNICIPALITIES WITH A POPULATION OVER 75,000 HAVE TO ADOPT REGULATIONS ALLOWING MIDDLE HOUSING, WHICH IS DUPLEXES, TRIPLEXES, FOURPLEXES AND TOWNHOMES ON CERTAIN AREAS OF THE TOWN. AND IT HAS A SECTION SIMILAR TO SOME OF THE OTHERS THAT WE'VE DISCUSSED, LIKE THE ACCESSORY DWELLING UNIT ORDINANCE WE PASSED LAST YEAR, THAT IF THE MUNICIPALITY DOES NOT ADOPT THE REGULATIONS REQUIRED BY THIS SECTION ON OR BEFORE JANUARY 1ST, 2026. SO THIS BILL GAVE US A COUPLE OF YEARS TO COMPLY, RATHER THAN JUST GETTING IT DONE BY JANUARY OF 2025, LIKE THE ADA ONE DID. BUT IF WE DON'T ADOPT SOMETHING BY THAT DATE, MIDDLE HOUSING SHALL BE ALLOWED ON ALL LOTS IN THE MUNICIPALITY ZONED FOR SINGLE FAMILY RESIDENTIAL WITHOUT ANY LIMITATIONS. SO WE WANTED TO GET SOMETHING IN OUR CODE.
AND WE DIDN'T WANT TO HAVE A SITUATION WHERE WE HAVE NO LIMITS ON MIDDLE HOUSING IN THE TOWN.
SO WE'RE PROPOSING TO ADOPT THESE REGULATIONS.
HOWEVER, WE ARE PROPOSING THAT WE MAKE THESE REGULATIONS EFFECTIVE JANUARY 1ST, 2026, EVEN THOUGH WE'RE NOT AT THE 75,000 POPULATION THRESHOLD YET. TOWN STAFF HAS DISCUSSED IT, AND WE BELIEVE THAT IT'S A GOOD THING TO HAVE TO PROMOTE HOUSING DIVERSITY IN THE TOWN. THAT'S SOMETHING THAT WE'VE BEEN TALKING ABOUT FOR THE LAST FEW YEARS WITH YOU ALL AND WITH THE COUNCIL, THAT WE NEED DIFFERENT PRODUCTS AVAILABLE TO FIRST TIME BUYERS AND YOU KNOW, RETIREES AND THINGS LIKE THAT.
AND SO WE DIDN'T SEE ANY REASON TO WAIT ON THIS ONE.
SO THERE IS A NEW SECTION IF THIS IS APPROVED BY THE COUNCIL, A NEW SECTION 17 615 ENTITLED MIDDLE HOUSING WILL BE INCLUDED IN THE TOWN CODE. IT INCLUDES ALL THE REQUIREMENTS OF HB 2721.
I'VE PUT ON THIS SLIDE JUST SOME OF THE KEY DEFINITIONS.
THOSE ARE VERBATIM OF WHAT IS IN THE STATE STATUTE NOW, THE DEFINITION OF MIDDLE HOUSING, THE DEFINITION OF IT'S A PERMITTED USE AND THE DEFINITION OF CENTRAL BUSINESS DISTRICT, WHICH WE'LL TALK ABOUT A LITTLE BIT MORE IN A COUPLE MORE SLIDES HERE.
SO THE CODE WILL ESTABLISH MIDDLE HOUSING AS A PERMITTED USE ON ANY LOT ZONED FOR SINGLE FAMILY RESIDENTIAL USE WITHIN ONE MILE OF THE TOWN'S CENTRAL BUSINESS DISTRICT, AND ON AT LEAST 20% OF A NEW DEVELOPMENT OF MORE THAN TEN CONTIGUOUS ACRES.
THAT'S WHAT THE STATUTE REQUIRES. SO THE PREVIOUS SLIDE TALKED ABOUT A CENTRAL BUSINESS DISTRICT, AND IT TELLS YOU WHAT THE ELEMENTS OF A CENTRAL BUSINESS DISTRICT ARE.
BUT WE CAN DETERMINE WHAT OUR CENTRAL BUSINESS DISTRICT IS.
AND OUR PROPOSAL IS THAT THE TOWN'S DOWNTOWN MARANA OVERLAY DISTRICT.
THE DO DISTRICT, WHICH IS ESTABLISHED IN TOWN CODE IN MARANA ORDINANCE THAT WAS ADOPTED IN 2018 THAT WE CALL THAT OUR CENTRAL BUSINESS DISTRICT FOR PURPOSES OF THIS PARTICULAR ORDINANCE.
THE NEW SECTION ALSO REQUIRES, AS THE STATUTE ALLOWS US TO, THAT THE TOWN, IN ORDER TO APPROVE THIS MIDDLE HOUSING, ONCE WE GET AN APPLICATION ON ONE OF THESE LOTS, WHERE IT'S A PERMITTED USE, THE TOWN HAS TO DETERMINE THAT THERE'S SUFFICIENT PUBLIC WATER

AND SEWER SERVICES AND ADEQUATE URBAN SERVICES THAT ARE AVAILABLE TO SERVE THE DEVELOPMENT.SO THERE IS AN ABILITY FOR THE TOWN TO AT LEAST REVIEW IT, AND IF WE FIND THAT THOSE THINGS AREN'T ADEQUATE FOR THAT DEVELOPMENT, TO DENY THE APPLICATION ADMINISTRATIVELY. THIS IS THE DOWNTOWN OVERLAY DISTRICT, THE DO.
SO IN 2018, WE ADDED THIS ZONING PROVISION TO THE LAND DEVELOPMENT CODE, AND AS PART OF THAT ORDINANCE, THIS MAP THAT'S ON THE SLIDE WAS THE EXHIBIT THAT DEFINED THE DO AREA.
LOWER RIGHT HAND CORNER IS BASICALLY THE TOWN HALL.
AND THEN GOES UP FROM THERE TOWARDS I-10 AND MARANA ROAD.
SO YOU CAN SEE WHAT WE'RE TALKING ABOUT HERE AS BEING OUR CENTRAL BUSINESS DISTRICT.
THE ORDINANCE WILL ALSO MAKE OTHER JUST CONFORMING AMENDMENTS TO THE ZONING CODE, TO ALLOW MIDDLE HOUSING IN THE APPROPRIATE ZONING DISTRICTS TO COMPLY AND SUBJECT TO THE APPLICABLE DEVELOPMENT STANDARDS AND REQUIREMENTS OF THE ZONING DISTRICT WHERE THE MIDDLE HOUSING IS LOCATED. THIS PARTICULAR SCREENSHOT IS OUR USE MATRIX THAT SHOWS ALL OF OUR ZONING DISTRICTS AND WHAT USES ARE ALLOWED. YOU CAN SEE WE ALREADY HAD DUPLEX AND TOWNHOUSE PERMITTED AND A FEW OF THE ZONES WHERE THE P´S ARE LOCATED. THESE ADDED U´S MEAN THAT IT'S ALLOWED AS LONG AS YOU MEET THE CONDITIONS, AND THE NEXT SLIDE WILL SHOW YOU WHAT THE CONDITIONS ARE.
SO THOSE ARE ADDED NOW, OR WOULD BE IF THIS IS ADOPTED.
NOW, REFERRING TO THAT U THEN MEANS YOU GO TO THE SECOND TABLE, CONDITIONS PER USE.
AND IT'S JUST SHOWING THAT THEY'RE ALLOWED IN THOSE ZONING DISTRICTS IF YOU MEET THE REQUIREMENTS OF 17 615, WHICH IS WHAT I JUST WENT OVER WITH YOU ALL. FURTHER CONFORMING AMENDMENTS IN THE CODE ARE GOING INTO OUR MIXED USE ZONING DISTRICTS, WHICH WE DON'T SEE A WHOLE LOT OF, THOSE ARE THE DISTRICTS THAT WERE ADDED ALONG WITH THE DO IN 2018.
THESE DID ALLOW FOR DUPLEX, TRIPLEX AND TOWNHOUSES, DIDN'T HAVE FOURPLEXES.
SO WE'VE ADDED THAT AND WE'VE MADE THE DUPLEX, TRIPLEX, TOWNHOUSE A LITTLE BIT MORE PERMISSIVE.
WE ALSO HAVE TO DO A HOUSING IMPACT STATEMENT, WHICH YOU MIGHT REMEMBER ALSO FROM THE ADU ORDINANCE.
REQUIRES THE TOWN A DIFFERENT STATUTE, REQUIRES THE TOWN TO CONSIDER HOUSING IMPACT STATEMENT REGARDING THE IMPACT OF ANY ZONING ORDINANCE, TEXT AMENDMENT OF GENERAL APPLICABILITY. AND IT IS OUR FINDING THAT THE ORDINANCE IS NOT ANTICIPATED TO HAVE ANY IMPACT ON THE AVERAGE COST TO CONSTRUCT HOUSING IN MARANA. IF ANYTHING, IT WOULD SEEM THAT THE MIDDLE HOUSING UNITS, THAT THIS MORE PERMISSIVE ALLOWANCE OF MIDDLE HOUSING UNITS IN SOME AREAS WILL HAVE THE EFFECT OF MAKING HOUSING MORE ATTAINABLE IN MARANA, AT LEAST THAT'S THE HOPE.
AND WITH THAT, THE STAFF'S RECOMMENDATION IS THAT THE PLANNING COMMISSION RECOMMENDED TO TOWN COUNCIL APPROVAL OF THE ORDINANCE, AND I'D BE HAPPY TO TAKE ANY QUESTIONS. COMMISSIONER FLINT.
FIRST OF ALL, ON THE CENTRAL DESIGNATION OF THE CENTRAL BUSINESS DISTRICT, WHEN THEY SAY WITHIN A MILE OF THE CENTRAL BUSINESS DISTRICT, DOES THAT PROVIDE FOR THE EXEMPTION OF SUCH CORRIDORS AS I-10, OR IS THAT TAKEN INTO ACCOUNT IN THE ONE MILE CALCULATION? AN ORDINANCE THAT WE HAVE TO ADOPT BY JANUARY 1ST.I'M PRESENTING A PROPOSED AMENDMENTS TO THE MARANA TOWN CODE THAT WOULD PROVIDE FOR AN ADMINISTRATIVE REVIEW PROCESS FOR VARIOUS LAND DEVELOPMENT APPLICATIONS AS REQUIRED BY THE NEW STATE LAW.
AND JUST TO GIVE A LITTLE BACKGROUND, THIS PAST LEGISLATIVE SESSION, HOUSE BILL 2447 WAS ADOPTED AND SIGNED BY GOVERNOR HOBBS. THE BILL MANDATES THAT CITIES AND TOWNS ESTABLISH AN ADMINISTRATIVE REVIEW AND APPROVAL PROCESS FOR CERTAIN DEVELOPMENT APPLICATIONS. AND WAS BECAME PART OF ARIZONA LAW.
SO JUST TO BE CLEAR, MOST OF THE LAND DEVELOPMENT PROCESSES THAT WE HAVE HERE IN MARANA ARE ADMINISTRATIVE NOW. THIS NEW LEGISLATION PRIMARILY AFFECTS FINAL PLATS WHICH THEY GO TO COUNCIL FOR A HEARING, BUT THERE ARE A FEW OTHER THINGS THAT ARE AFFECTED.
AND I'LL JUST RUN THROUGH THESE. SO OUR DEVELOPMENT REVIEW PROCESS RIGHT NOW, REVIEWING COMMERCIAL AND MULTIFAMILY DEVELOPMENTS IS AN ADMINISTRATIVE PROCESS. IT ISN'T INCORPORATED INTO THE MARANA TOWN CODE.
WE RELY ON OUR CHECKLIST TO ESTABLISH THE PROCESS.

AND THE BULK OF THE CHANGES ARE ACTUALLY IN SECTION 17-5, 17 5-2, WHICH ADDRESSES SUBDIVISION PROCEDURES. AND THESE CHANGES WOULD ESTABLISH AN ADMINISTRATIVE REVIEW AND APPROVAL PROCESS FOR FINAL PLATS, WHICH AGAIN, THEY GO TO TOWN COUNCIL. NOW THEY'RE USUALLY PUT ON THE CONSENT AGENDA.
LIKEWISE, THERE IS A NEW SECTION PROPOSED IN THE ORDINANCE THAT JUST CLARIFIES THAT LOT LINE ADJUSTMENTS, LOT SIZE AND LOT COMBINATIONS COULD ALSO BE APPROVED ADMINISTRATIVELY.
AND THAT'S AGAIN REQUIRED BY THIS NEW LEGISLATION.
LASTLY, AND THIS THIS DOES AFFECT HEARINGS THAT THE PLANNING COMMISSION.
