I SAY THAT HAVING SPENT DECADES WORKING WITH IMMIGRANTS AND REFUGEES AS SOMEONE WHO RELIES UPON FACTS INSTEAD OF LIES, AND AS A FOLLOWER OF THE ACTUAL TEACHINGS OF A MIDDLE EASTERN JEWISH PEASANT, NAMED JESUS. THAT'S THE STANDARD OF HUMAN DECENCY I'M GOING TO TALK ABOUT FOR THE NEXT MOMENT, HOW THE BIBLE AND JESUS TELL US TO TREAT IMMIGRANTS. IT'S CLEAR TO ME THAT THE SO CALLED CHRISTIAN NATIONALISTS DRIVING THIS HORROR PAY MORE ATTENTION TO WHAT STORYTELLERS WHO NEVER MET JESUS SAY ABOUT HIM THAN THEY DO TO THE LIFE AND TEACHINGS OF JESUS HIMSELF. WE HAVE A KNOWN QUANTITY WITH THIS MANAGEMENT AND TRAINING CORPORATION, AND I'D LIKE TO SUBMIT THIS INFORMATION SHEET, IF POSSIBLE, INTO THE MINUTES. BUT I WANT TO SAY THAT THE ARIZONA THAT I LOVE IS MULTICULTURAL, RESPECTFUL. IT IS NOT A PLACE WHERE WE TERRORIZE OTHER PEOPLE. WE HAVE OVER 30% OF THE NATIVE PEOPLE OF ARIZONA HAVE HISPANIC BLOOD. WE WANT TO CREATE A COMMUNITY WHERE EVERYBODY THRIVES, NOT WHERE THEY'RE AFRAID, TO GO TO CHURCH, TO GO TO THE GROCERY STORE. ALSO I SPEAK AS A RETIRED CHAPLAIN. AT THE END OF LIFE, MORAL INJURY REALLY PLAYS HARD ON PEOPLE'S CONSCIENCES. WHEN YOU ARE PART OF SOMETHING THAT IS CRUEL, THAT IS MORALLY REPUGNANT, YOU CARRY IT WITH YOU TO YOUR COMMUNITY, AND TO YOUR FAMILY. IT DOES NOT BREED A FREEDOM OF CONSCIENCE OR A POSITIVE WAY TO CONTRIBUTE TO THE COMMUNITY. I STRONGLY URGE YOU TO DO EVERYTHING POSSIBLE TO PREVENT THIS PRISON FROM BECOMING A DETENTION CENTER. ON ICE, I KNOW THERE'S A LIMITED AMOUNT THAT THE COUNCIL HAS CONTROL OVER. BUT THE THINGS I WOULD LIKE TO SEE THE COUNCIL DO IF THIS DOES COME TO PASS, UNFORTUNATELY, IS TO PROHIBIT MARANA POLICE FROM WORKING IN OFF TIME FOR ICE AS AGENTS, WHICH HAS HAPPENED IN OTHER TOWNSHIPS. [00:10:03] NOT ALLOW THE POLICE TO TAKE PART IN ARRESTING GOVERNMENT OFFICIALS ATTEMPTING TO DO THEIR LEGAL OVERSIGHT IN UNANNOUNCED VISITS. THEY HAVE SHOT PEPPER BALLS AT A PASTOR WHO IS PRAYING. THEY'VE ARRESTED OVER 170 CITIZENS MISTAKENLY, AND SO I HAVE PULLED PEOPLE TO THE GROUND WHO ARE ENGAGED IN PEACEFUL PROTEST, HALLOWEEN, CHILDREN'S PARADE, TEAR GAS. I'D LIKE TO SEE THE MARANA POLICE BE COMMITTED TO ARRESTING ICE OFFICERS WHO ARE IN VIOLATION OF OTHER PEOPLE'S CONSTITUTIONAL RIGHTS. I THINK MARANA, WE ALL VALUE THE CONSTITUTION, AND THERE'S A LOT MORE TO THE CONSTITUTION THAN JUST THE SECOND AMENDMENT. IF GOVERNMENT OFFICIALS ARE VIOLATING RIGHTS, AS I UNDERSTAND IT, THE MARANA POLICE WOULD HAVE A ROLE IN ARRESTING THOSE OFFICERS. LIKE THE PAST WHO SPOKE BEFORE, PART OF THIS IS THE TESTIMONY OF MY FAITH. THE UNITED METHODIST CHURCH HAS LISTED PRIVATE PRISONS AS ONE OF THE THREE OR FOUR SUCH IMMORAL WAYS OF MAKING MONEY THAT THEY HAVE PROHIBITED ANY UNITED METHODIST CHURCH INVESTMENTS TO GO TO PRIVATE PRISONS. I URGE YOU ALL TO READ THE ARTICLE IN THE MARANA NEWS IF YOU HAVEN'T ALREADY, WHICH GOES INTO A LOT MORE DETAIL ON ALL THESE THINGS. I KNOW IT'S NOT THE TOPIC OF TONIGHT, BUT I'D ALSO LIKE TO ADDRESS THE POSSIBILITY OF THE PROJECT BLUE DATA CENTER. I URGE YOU TO GET IN WRITING THAT THIS WOULD BE AIR COOLED AND NOT WATER COOLED. I APPRECIATE THE FACT THAT THE COUNCIL ALREADY TOOK STRONG ACTION IN NOT ALLYING POTABLE WATER, BUT EVEN GRAY WATER OR REUSED WATER IS PROBABLY SOMETHING WE'RE GOING TO END UP HAVING TO DEPEND ON IN THE NEAR FUTURE FOR DRINKING WATER. THERE ARE ONLY TWO WAYS THAT THE ENERGY INFRASTRUCTURE CAN HAPPEN TO COVER THE EXTRA NEEDS THAT A DATA CENTER BRINGS. EITHER THEY PAY FOR IT OR WE ALL PAY FOR IT. I WOULD LIKE TO SEE THE COUNCIL TAKE THE POSITION THAT ANY ADDITIONAL INFRASTRUCTURE HAS TO BE PAID FOR BY THEM UPFRONT BY CONTRACT. THAT THERE BE A MONTH BETWEEN ANY ACTION THAT THE COUNCIL TAKES ON THE DATA CENTER TO GIVE THE PUBLIC CHANCE TO RESPOND, SEE THAT PUBLISHED IN THE NEWSPAPER OR OTHERWISE, AND GIVE THEIR INPUT ON ANY ACTIONS BY THE COUNCIL FOR THAT DATA CENTER. I WOULD LIKE TO SEE THIS COMMUNITY STAY SAFE AND FAMILY ORIENTED FOR BOTH MY DAUGHTERS AND THEIR IMMIGRANT FRIENDS AND THEIR FAMILIES. ICE COMING THROUGH AND THREATENING OUR NEIGHBORS AND KIDNAPPING THEM IS NOT GOING TO CONTINUE TO KEEP OUR COMMUNITY SAFE. I'M SURE A LOT OF US ARE AWARE OF THE ABUSES COMMITTED BY ICE AND BORDER PATROL, AS WELL AS THE HORRENDOUS CONDITIONS IN THEIR DETENTION FACILITIES. I DON'T WANT TO SEE THOSE ATROCITIES AFFLICTED ON ANYBODY IN THIS COMMUNITY, ESPECIALLY OUR IMMIGRANT NEIGHBORS WHO ARE ALSO VALUABLE MEMBERS OF OUR COMMUNITY. [NOISE] MTC IS A PRIVATE COMPANY LOOKING TO MAXIMIZE PROFITS AT THE EXPENSE OF OUR COMMUNITY. A LOT OF PRIVATE PRISONS, THEY DON'T REALLY CARE WHO GETS SWEPT UP AS LONG AS THEY'RE FILLING THEIR PRISONS TO MAXIMIZE THEIR PROFITS. LET'S NOT FORGET HOW MANY RESOURCES WOULD GO TO A FACILITY LIKE THIS, WHICH WOULD DRAIN FROM OUR COMMUNITY, WATER AND ELECTRICITY, NOT TO MENTION THE MILLIONS OF DOLLARS THAT WOULD BE USED TO FUND THE KIDNAPPING OF OUR NEIGHBORS. THESE RESOURCES, INCLUDING THE MONEY THAT WOULD BE SPENT, COULD BE USED TO SERVE OUR COMMUNITY IN BETTER WAYS, HOUSING OUR HOMELESS NEIGHBORS, PROVIDING EDUCATION, HEALTH CARE FOR OUR NEIGHBORS, AND NOT TO MENTION JUST THE STAIN IT WOULD LEAVE OVERALL IN OUR COMMUNITY. IT'S VERY DISHEARTENING THAT WE ALL HAVE TO SHOW UP HERE TO EXPRESS OUR OPPOSITION TO MTC AND THIS FACILITY, [NOISE] AND OPPOSE THIS SYSTEM THAT HAS CREATED THIS PROBLEM FOR ALL OF US IN MARANA AND OTHER AREAS OF THE COUNTRY. WHAT I WANT FOR MY FAMILY AND WHAT I WANT FOR EVERYONE'S FAMILY IS TO BE IN A PLACE WHERE THEY NEVER SEE WHAT IT IS THAT ICE IS DOING TO THIS COUNTRY. WE'VE TALKED ABOUT THIS BEFORE. WHAT OUR COUNTRY IS DOING RIGHT NOW IS UNIMAGINABLE, SOMETHING AT 74 YEARS OLD, I WOULD NEVER HAVE THOUGHT THAT THIS COUNTRY WOULD DO THIS TO OUR OWN PEOPLE, LET ALONE PEOPLE WE LOVE, OUR NEIGHBORS, OUR IMMIGRANT PEOPLE. THIS IS THEIR LAND ANYWAY TO BEGIN WITH. IT'S NOT OUR LAND. IT WAS THEIR LAND TO BEGIN WITH. THESE PEOPLE WHO ARE HERE, WHO HAVE COME ACROSS THE BORDER. THERE'S AN OLD SAYING, "WE DIDN'T CROSS THE BORDER; THE BORDER CROSSED US." MY POINT ABOUT MTC. MTC IN 2015, WHEN THEY SOLD THAT TERRIBLE, UGLY PRISON, THEY SOLD IT FOR 150,000. THEY BOUGHT IT FOR 150 MILLION. NOW, LET'S JUST THINK ABOUT THAT, THOSE OF YOU WHO ARE IN ECONOMICS. WHY WOULD I SELL IT FOR 150,000, AND NOW I'M GOING TO BUY IT FOR 150 MILLION BECAUSE I KNOW I'M GOING TO MAKE THREE TIMES THAT MONEY, AND I'M GOING TO BE MAKING THAT MONEY OFF THE BACKS OF HUMAN BEINGS. WE HAVE TO THINK ABOUT THAT. THAT'S WHO'S GOING TO BE MAKING THIS MONEY. THESE FOR-PROFIT PRISONS. THEY DON'T CARE ABOUT ANYONE. I DON'T KNOW IF YOU KNOW THE HISTORY. IN 2015, WHEN THEY CLOSED DOWN THAT PRISON, THE REASON THEY CLOSED IT, THERE WAS A HUGE RIOT. NOBODY GOT HURT IN THAT RIOT, BUT THERE WAS A RIOT. THE MAN WHO STARTED THAT RIOT HE WAS A PRISON GUARD. WITHIN TWO WEEKS OF HAVING THAT PRISON SHUT DOWN, HE COMMITTED SUICIDE. THERE WERE ATROCITIES THAT WERE OCCURRING IN THAT PRISON FOR OVER TWO-AND-A-HALF YEARS. UNBELIEVABLE ATROCITIES. THERE'S PEOPLE HERE. I DON'T KNOW IF THEY'RE GOING TO SPEAK TONIGHT WHO WERE IN THOSE PRISONS TO TELL YOU ABOUT THEIR UNCLES HAD BEEN IN THOSE PRISONS, THEIR FATHERS HAVE BEEN IN THOSE PRISONS. I HAVE LIVED MY WHOLE 25 YEARS IN MARANA. I WAS RAISED HERE. MY DAD WAS RAISED HERE. MY GRANDPA IMMIGRATED HERE. HE WAS AROUND 10 YEARS OLD BACK IN THE 50S WHEN HE CAME TO MARANA. I HAD LONG HISTORY HERE. I JUST WANT TO REFLECT ON MY TIME IN GROWING UP HERE AS IT HAS BEEN AN ABSOLUTE PRIVILEGE. I CRIED AT THE OPENING OF THE MARK. I TOLD MAYOR POST I WAS SO EXCITED FOR OUR FUTURE, AND I BELIEVE THAT THIS DETENTION FACILITY IT MAKES ME CRY IN SADNESS. I ONLY WANT TO CRY AND JOY FOR OUR TOWN. I HAVE SO MUCH FAMILY THAT HAS BEEN HERE, THAT CONTINUES TO GROW HERE, AND FOR GENERATIONS TO COME TO LIVE HERE. I AM SCARED FOR ME AND FOR MY FAMILY AND FOR MY FRIENDS AND NEIGHBORS. I WAS ALSO A FEDERAL LAW ENFORCEMENT OFFICER FOR THE BUREAU OF PRISONS FOR NEARLY 10 YEARS, WHICH I FULFILLED AN ARRAY OF POSITIONS, SUCH AS AN OFFICER, AN ADMINISTRATIVE ASSISTANT TO THE HEALTH SERVICES ADMINISTRATOR, AND A COMMISSARY WAREHOUSE FOREMAN. I'VE WORN MANY HATS. I'M OPPOSED TO THE ICE DETENTION CENTER. FROM MY PERSONAL AND PROFESSIONAL POINT OF VIEW OF THOSE THINGS, PEOPLE TEND NOT TO BE INVOLVED OR CARE ABOUT THE TREATMENT OF DETAINEES UNTIL IT IS THEIR PERSONAL INTEREST. A DETENTION FACILITY IN MARANA IS IN YOUR INTEREST. IT IS DEFINITELY SOMETHING YOU SHOULD BE CARING ABOUT. DETENTION IN ITSELF IN THE CAPACITY IS A LIFE OF HORROR. WE'VE HEARD OF THESE HORRORS. I HAVE WITNESSED THESE HORRORS. ABUSE, WHICH INCLUDES WITHHOLDING RESOURCES, INFORMATION, AND RIGHTS. INHUMANE TREATMENT AND CONDITIONS THROUGH WITHHOLDING FOOD, UNSANITARY CONDITIONS, LACK OF HEATING AND COOLING FACILITIES IN DISREPAIR. THERE'S VIOLENCE WITH REACTIVE ABUSE. HEALTH CARE AND LIVING CONDITIONS, MENTAL HEALTH IS NOT TREATED, OR IT IS PERFUNCTORY. IN MEDICAL CARE, THAT IS MALPRACTICE IN NATURE. MANY THINK THIS IS A ONE-SIDED ISSUE FOR THESE DETAINEES, BUT WHAT PEOPLE FAIL TO UNDERSTAND IS THAT THESE ARE ALSO THE HORRORS IN WHICH THE PEOPLE WHO WORK IN THESE INSTITUTIONS ALSO ENDURE. IT IS TRAUMATIC TO SEE PEOPLE TREATED THIS WAY. IT BROKE ME AFTER NEARLY 10 YEARS OF TRYING TO MAKE A CAREER IN CORRECTIONS. IF IT IS FOR JOBS WE'RE CREATING, THIS IS NOT THE ANSWER. JOBS AT DETENTION CENTERS THEMSELVES HAVE ISSUES WITH COMMUNITY MEMBERS WHO TAKE THEM ON, AND THEY WILL FACE THE BRUTAL REALITY THAT WILL EVENTUALLY BREAK YOU, LIKE ME. UNDERSTANDING, WHICH CREATES STRESS GIVES TO CORRECTIONAL FATIGUE. THERE'S TRAUMA, THERE'S VIOLENCE, ALL WITHIN THE CORRECTIONAL OFFICERS THEMSELVES. ADDITIONALLY, THE SUICIDE RATE FOR CORRECTIONAL WORKERS IS ESTIMATED TO BE 39 TO 40% HIGHER THAN THE GENERAL WORKING-AGE POPULATION. YOUR COMMUNITY WILL BE THE ONES THAT TAKE THAT ON. HOWEVER, IT'S NOT THE JOBS THAT WE ARE ARGUING TODAY FOR MARANA OR TUCSON IF WE'RE WANTING TO DETAIN CRIMINALS. BEING UNDOCUMENTED IS NOT CRIMINAL. IT'S A MISDEMEANOR. IT'S NOT VIOLENT. THERE'S ALREADY A UNIT, WHICH UNDOCUMENTED INDIVIDUALS WHO COMMIT CRIMES ARE ADMITTED TO WITH DUE PROCESS AT THE FEDERAL PRISON COMPLEX ON WILMOT. THAT'S MONITORED BY THE US MARSHALS AND THE BUREAU OF PRISONS. WE'RE TALKING ABOUT DISMANTLING COMMUNITIES, RACISM, AND ALLOWING THIS ADMINISTRATION TO PROFIT FROM THE UNFORTUNATE. FORTY ONE PERCENT 41 IS GROUNDWATER, 18 PERCENT IS IN STATE RIVERS, MOST OF THAT BEING THE SALT RIVER PROJECT WITH THE SALT RIVER AND THE VERDE RIVER, AND THEN FIVE PERCENT IS RECLAIMED WATER. THE COLORADO RIVER BASIN CONSISTS OF SEVEN STATES IN THE NORTHERN PORTION OF MEXICO. THE COLORADO RIVER SUPPLIES WATER TO ABOUT 40 MILLION PEOPLE, INCLUDING PEOPLE WHO LIVE OUTSIDE OF THE BASIN LIKE THE DENVER METRO AREA. THEIR RETURN FLOWS WILL NOT GO BACK OVER THE CONTINENTAL DIVIDE TO GET INTO THE COLORADO RIVER, AND LOS ANGELES IS ACTUALLY OUTSIDE OF THE COLORADO RIVER BASIN, EVEN THOUGH CALIFORNIA IS A BASIN STATE. WE HAVE 22 TRIBES IN ARIZONA OUT OF 30 THAT ARE IN THE GREATER SEVEN STATES. THE COLORADO RIVER ALSO IRRIGATES SOMEWHERE AROUND FIVE MILLION ACRES OF FARMLAND AND GENERATES CLEAN HYDROPOWER. THE RESERVOIRS ALONG COLORADO CAN STORE CLOSE TO 60 MILLION ACRE FEET OF WATER WHEN THEY'RE FULL, AND I'LL TALK A LITTLE BIT ABOUT THAT LATER ON IN THE PRESENTATION. THEN MOVING IT DOWN A LITTLE BIT TO THE CENTRAL ARIZONA PROJECT, WE ARE 336 MILE AQUEDUCT THAT STRETCHES FROM LAKE HAVASU. THE AQUEDUCT HAS ITS TERMINUS DOWN OFF OF PIMA MINE ROAD AND 919. WITH THAT, THERE IS A 3,000 FOOT LIFT OF THE WATER FROM LAKE HAVASU TO BASICALLY THE TOP OF STAR PASS WHERE WE DELIVER WATER INTO THE RESERVOIR THAT SERVES THE TUCSON AREA. [00:35:03] ALONG THE WAY, THERE ARE 10 SIPHONS, FOUR TUNNELS, LARGEST OF WHICH IS THE TUNNEL THAT STARTS THE WHOLE SYSTEM, AND THAT TUNNEL THROUGH THE BUCKSKIN MOUNTAINS IS 22 FEET IN DIAMETER AND SEVEN MILES LONG. IT'S A PRETTY BIG TUNNEL TO GET THAT WATER OUT OF LAKE HAVASU INTO THE CAP CANAL SYSTEM. THERE ARE MORE THAN 50, WHAT WE CALL TURNOUTS. A TURNOUT IS BASICALLY WHERE ONE OF OUR CUSTOMERS WOULD TAKE WATER OUT OF THE CANAL AND USE IT FOR WHATEVER THEIR PURPOSES ARE. SOME OF THEM ARE VERY LARGE, LIKE THE ONES THAT SERVE THE CITY OF PHOENIX, FOR INSTANCE, WHERE THEY GET ALL THEIR DRINKING WATER GOING THROUGH A COUPLE OF TREATMENT PLANTS. SOME ARE VERY SMALL THAT MIGHT SERVE ONLY A GOLF COURSE OR TWO GOLF COURSES, BUT THAT 50 TURNOUTS, AMONG THEM, THIS YEAR, WE'LL SERVE SOMEWHERE AROUND 900,000 ACRE FEET OF WATER. THAT'S SOMEWHERE AROUND 2.5 TRILLION GALLONS THAT WILL BE USED BY OUR CUSTOMERS. WE HAVE THE CAPACITY TO DELIVER 1.6 MILLION ACRE FEET AND FOR A LONG TIME IN THE '90S IN THE EARLY 2000S, WE WERE DELIVERING ALL THAT, THAT EXCESS WATER THAT WAS NOT USED BY CUSTOMERS, WE PUT IN RECHARGE PROJECTS. MARANA HAS SEVERAL RECHARGE PROJECTS WITHIN YOUR AREA. THEN ALONG WITH THE CANAL SYSTEM, A NEW DAM WAS BUILT ON LAKE PLEASANT, HIGHER DAM. THAT BECAME THE STORAGE OR REGULATORY RESERVOIR FOR CAP. ESSENTIALLY, WE PUMP WATER OFF THE RIVER WHEN PRICES FOR ELECTRICITY ARE LOW. WE CAN PUT IT INTO LAKE PLEASANT AND STORE THE WATER THERE UNTIL THE SUMMER MONTHS WHEN MORE WATER IS NEEDED AND PRICE OF ELECTRICITY IS VERY HIGH, SO WE CAN DRAFT IT OUT OF LAKE PLEASANT. IN FACT, THAT PUMPING PLANT ALSO SERVES AS A HYDROELECTRIC FACILITY SO WE CAN ACTUALLY GENERATE POWER COMING BACK OUT OF LAKE PLEASANT. OUR SERVICE AREA, THE THREE COUNTIES, MARICOPA, PIMA AND PINAL. WITHIN THOSE THREE COUNTIES, ABOUT 80 PERCENT OF ARIZONA'S POPULATION, AND SOMEWHERE AROUND SIX MILLION PEOPLE, SOMETHING LIKE THAT. WE ALSO SERVE 11 TRIBAL NATIONS. THEY HAVE ACCESS TO CAP WATER. IN FACT, CAP IS THE LARGEST ORGANIZATION, WE SERVE MORE TRIBAL NATIONS THAN ANY OTHER ORGANIZATION IN THE COUNTRY. WE USED TO DO A LOT OF DELIVERIES TO AGRICULTURE, PARTICULARLY IN PENAL COUNTY. THERE WERE A BUNCH OF IRRIGATION DISTRICTS THAT WERE TAKING WATER FROM US BUT AS WE WENT INTO SHORTAGE ALONG THE COLORADO RIVER AND HAD TO CUT BACK ON OUR DELIVERIES, AGRICULTURE HAS A LOWER PRIORITY THAN THE TRIBES AND MUNICIPALITIES DO, SO THEY WERE THE FIRST TO GET CUT BACK. WE'RE GOVERNED BY A 15 MEMBER BOARD OF DIRECTORS. EACH BOARD MEMBER SERVES A SIX YEAR UNPAID TERM. THE BOARD MEMBERS WERE VERY CLEAR THAT I HAD TO SAY UNPAID. WE DEFINITELY WANT TO MAKE THAT KNOWN BECAUSE YOU'RE NOT GOING TO GET RICH BEING A BOARD MEMBER OF CAP. THERE ARE 10 ELECTED IN MARICOPA COUNTY, ONE IN PINAL AND FOUR IN PIMA COUNTY. EVERY TWO YEARS, THEY'RE STAGGERED TERMS. EVERY TWO YEARS, WE HAVE AN ELECTION FOR FIVE OF THE SEATS, AND COMING UP NEXT YEAR IN NOVEMBER, WE WILL HAVE THE ELECTION FOR PIMA AND PINAL. THERE WILL BE FIVE SEATS ON THE BALLOT. IT'S ACTUALLY BEEN 12 YEARS SINCE IT'S BEEN ON THE BALLOT BECAUSE LAST TIME THERE WERE FOUR SEATS OPEN IN PIMA COUNTY AND ONE SEAT OPEN IN PINAL AND THERE WAS FOUR PEOPLE RUNNING FOR THOSE SEATS AND ONE PERSON RUNNING IN PINAL. BASICALLY TO SAVE MONEY, WE JUST HAD THE COUNTY SUPERVISORS OF BOTH COUNTIES DECLARE THOSE PEOPLE THE WINNERS OF AN ELECTION THAT DIDN'T HAVE TO TAKE PLACE. THAT SAVED CAP ABOUT [00:40:03] $250,000 BECAUSE WE DO PAY ALL THE COSTS FOR THE COUNTY TO RUN THOSE ELECTIONS. LET'S TALK ABOUT THE COLORADO RIVER SUPPLY NOW. THIS IS WHAT WE CALL A BUCKET CHART. IT'S SOMETHING THAT WE PRESENT TO OUR BOARD OF DIRECTORS AT THEIR MONTHLY MEETINGS. ESSENTIALLY, IT GIVES US A SNAPSHOT IN THIS CASE, AS OF OCTOBER 5TH, OF THE CONTENTS OF EACH OF THE MAJOR RESERVOIRS ALONG COLORADO RIVER.YOU CAN SEE BY THE SIZE OF THE RESERVOIRS, OBVIOUSLY, LAKE POWELL AND LAKE MEAD ARE THE TWO LARGEST RESERVOIRS. BETWEEN THEM, THEY CAN HAVE ABOUT 50 MILLION ACRE FEET WHEN THEY ARE CAPACITY, AND ALL THE REST OF THEM ARE MUCH SMALLER RESERVOIRS, 3.5 MILLION, BUT GOING ON DOWN TO REALLY ONLY 200,000 OR LESS THAN THAT ACRE FEET IN A RESERVOIR. WHAT YOU CAN SEE FROM LAKE MEAD AND LAKE POWELL IS THAT WE HAVE THE RED LINE. ON LAKE MEAD, THE RED LINE REPRESENTS BELOW 1075, WE ARE IN SHORTAGE ON THE RIVER. WE'RE IN A TIER 1 SHORTAGE. ON LAKE POWELL, CONVERSELY, IT SAYS MID ELEVATION RELEASE. THE WAY THAT THOSE TWO RESERVOIRS ARE OPERATED IS A CONJUNCTIVE BALANCING, SO THAT IF LAKE POWELL IS AT A CERTAIN ELEVATION AND LAKE MEAD IS AT A CERTAIN ELEVATION, THEN MANDATED A CERTAIN AMOUNT OF WATER WILL FLOW OUT OF LAKE POWELL THROUGH THE GRAND CANYON AND INTO LAKE MEAD, AND DEPENDING ON HOW THAT BALANCE IS STRUCTURED, THE WATER VOLUME GOES UP OR DOWN. REALLY, THE ELEVATION IN LAKE POWELL IS REALLY MORE ABOUT HOW MUCH WATER IS GOING TO BE RELEASED TO LAKE MEAD, WHEREAS THE ELEVATION IN LAKE MEAD IS REALLY ABOUT ARE WE IN A SHORTAGE AND IF SO, WHAT TIER OR WHAT LEVEL OF SHORTAGE WE'RE IN? THIS IS JUST A CHART THAT SHOWS BASICALLY FROM THE LATE 1990S WHEN WE WERE HAVING VERY WET YEARS AND HOW THE RESERVOIR SYSTEM, ALL OF THE RESERVOIRS THAT YOU SAW ON THE BUCKET CHART, HAD SOMETHING LIKE 94 PERCENT OF CAPACITY, AND THAT IT HAS GONE DOWN RELATIVELY STEADILY. THERE HAVE BEEN GOOD YEARS WHERE, IN 2011, WE GOT A REALLY GREAT SNOWFALL, AND SO THERE WAS A LOT OF RUNOFF. IT'S REALLY BEEN GOING DOWN BECAUSE WE ARE IN YEAR 25 OF A 25 YEAR DROUGHT ON THE SYSTEM. THE TABLE ON YOUR RIGHT OF THE SLIDE IS BASICALLY SHOWING THE EFFECT OF CLIMATE CHANGE. IN THIS CASE, WARMING TEMPERATURES ALONG THE ROCKY MOUNTAINS, HOW THAT'S IMPACTING WHATEVER THE SNOWFALL IS, HOW MUCH IS GOING TO MELT AND GET DOWN TO THE BEDROCK AND GO INTO THE COLORADO RIVER SYSTEM. WHAT YOU CAN SEE STARTING IN 2020, WE HAD A BETTER THAN AVERAGE YEAR. BY AVERAGE I MEAN, OVER THE LAST 30 YEARS, SO FROM 1990-2020, WE HAD 105 PERCENT OF SNOW PACK, AND YET WE ONLY GOT 61 PERCENT OF RUN OFF. AGAIN, THAT'S PRIMARILY BECAUSE WARMER TEMPERATURES, FIRST OF ALL, YOU HAVE DRIER SOILS, SO THEY ABSORB MORE OF THE WATER AS THE SNOW MELTS BEFORE IT GETS DOWN TO THE BEDROCK. YOU HAVE A LONGER GROWING SEASON, SO YOU'VE GOT TREES AND OTHER THINGS COMING OUT OF DORMANCY EARLIER, SO THEY'RE ABSORBING THAT WATER BEFORE IT CAN GET DOWN TO THE BEDROCK, AND YOU HAVE EVAPORATION OR SUBLIMATION OF SNOW. IF THE TEMPERATURE IS HOT ENOUGH, IT WON'T MELT, IT WILL JUST EVAPORATE. WHAT YOU CAN SEE IS OVER TIME, WE HAVE HAD RELATIVELY GOOD YEARS IN THE BIG SCHEME OF THINGS, 86 PERCENT, 90 PERCENT, 92 PERCENT, AND THEN A FEW YEARS THAT HAVE BEEN VERY HIGH IN SNOWFALL, BUT WE HAVE CONSISTENTLY BEEN LOWER ON THE RUNOFF GOING INTO THE COLORADO RIVER. YOU CAN SEE THIS LAST YEAR, AND THE WATER YEAR IS FROM OCTOBER 1ST TO SEPTEMBER 30TH, SO WE ARE NOW IN WATER YEAR 2026. BUT IN 2025, WE ONLY HAD WE HAD LESS THAN 50 PERCENT RUNOFF, EVEN THOUGH WE HAD 92 PERCENT OF THE 30 YEAR AVERAGE OF SNOW WATER EQUIVALENT. THIS IS ANOTHER CHART THAT TYPICALLY GOES ON A MONTHLY BASIS. ESSENTIALLY, WE'RE LOOKING AT LAKE POWELL. AS I MENTIONED, THE IMPORTANT ELEVATIONS IN LAKE POWELL, THEY ARE BASICALLY LOOKING AT WHAT KIND OF RELEASE DO THEY HAVE TO MAKE IN ORDER TO BALANCE THE TWO RESERVOIRS, [00:45:02] BUT THERE'S ANOTHER VERY IMPORTANT ELEVATION IN LAKE POWELL, AND THAT'S THE DASH LINE JUST BELOW 3,500 FEET IN ELEVATION. THAT'S AT 3,490, AND THAT IS MINIMUM POWER POOL. LAKE POWELL WAS DESIGNED WHERE THE WATER CAN GO THROUGH THE PEN STOCKS TO GET INTO THE TURBINES. >> BUT IF IT'S BELOW 3490, IT CANNOT DO THAT. AND THERE IS NO OTHER WAY PAST GLEN CANYON DAM, EXCEPT BY USING THE EMERGENCY BYPASS SHOOTS. THE PROBLEM IS THAT THEY'VE DONE SOME EXPERIMENTS TO HELP DISTRIBUTE SEDIMENT ALONG THE GLEN CANYON TO HELP COOL THE WATER SO THAT NATIVE FISH HAVE A BETTER CHANCE OF SURVIVING IN THAT STRETCH OF THE RIVER. AND WHAT THEY FOUND IS THEY DAMAGED THOSE OVERSHOOTS. THEY'RE NOT MEANT TO TAKE FULL FLOW. SO IF IT GOES BELOW 3490, NOT ONLY DOES GLEN CANYON DAM STOP PRODUCING ELECTRICITY, BUT THE BUREAU SIMPLY CAN'T PUT THE NORMAL AMOUNT OF WATER THROUGH THOSE BYPASS TUBES. EVERY MONTH, THE BUREAU OF RECLAMATION LOOKS OUT TWO YEARS. THEY DO A 24-MONTH STUDY. THEY DO A MODEL, AND THEY LOOK AT A BUNCH OF DIFFERENT WHAT ARE CALLED TRACES, A BUNCH OF DIFFERENT POTENTIAL FUTURES. AND OF ALL OF THOSE POTENTIAL FUTURES, IS WELL OVER 100 OF THEM THAT THEY LOOK AT. THE RED LINE REPRESENTS THE 10TH PERCENTILE. IN OTHER WORDS ONLY 10% OF THOSE FUTURES ARE BELOW THAT RED LINE. THE GREEN LINE IS THE 50 PERCENTILE OR THE MOST LIKELY. AND THEN THE BLUE LINE AT THE TOP, THE BLUE DASH LINE IS THE MAXIMUM POTENTIAL, AND THAT IS THE 90TH PERCENTILE. SO 10%, THEORETICALLY, 10% OF THE TRACES FELL ABOVE THAT BLUE LINE. WE PAY MOST ATTENTION AND THE REGULATIONS THAT GOVERN HOW THE RIVER IS OPERATED ARE BASED ON THE GREEN LINE, FOR THE MOST PART. WHAT IS THE STANDARD? LAKE POWELL, THEY'RE LOOKING RIGHT NOW MID ELEVATION RELEASED HERE THAT'S RIGHT NEXT TO THE NUMBERS THERE, WHICH MEANS THEY WILL RELEASE 7.5 MILLION ACRE FEET ROUGHLY FROM LAKE POWELL INTO LAKE MEAD. THAT IS WHAT IS CONSIDERED A STANDARD RELEASE, BUT THEY ALSO THE UPPER BASIN HAS NOT BEEN RELEASING THEIR HALF OF THE 1.5 MILLION ACRE FEET OF COLORADO OF WATER THAT IS DELIVERED INTO MEXICO. SO IT REALLY SHOULD BE 8.25 MILLION ACRE FEET THAT THEY NEED TO BE DELIVERING FROM LAKE POWELL TO LAKE MEAD. BUT YOU CAN SEE THAT GREEN LINE, BASICALLY, THAT GREEN LINE EASILY STAYS ABOVE THAT 34 90. SO FOR THE NEXT 24 MONTHS, AT LEAST, THE BUREAU IS SAYING VERY LITTLE CHANCE, ONLY A 10% CHANCE OR LESS THAT WE'RE GOING TO BE BELOW THAT 3490 IN WHICH CASE, SPECIAL ACTIVITIES HAVE TO TAKE PLACE IN ORDER TO PROTECT THAT. THEY'RE NOT GOING TO LET IT GO BELOW THAT IF THEY CAN HELP IT. THIS IS THE SAME CHART LOOKING AT LAKE MEAD, BUT YOU NOTICE THAT THIS REALLY TALKS ABOUT THE LEVEL OF SHORTAGE WE'RE IN. THE LINE THAT IS AT 1090' IS UNDER THE DROUGHT CONTINGENCY PLAN THAT WAS PASSED IN 2019. IT'S AN OVERLAY OF THE 2007 GUIDELINES. UNDER THAT PLAN, IF THE ELEVATION OF LAKE MEAD IS PROJECTED TO BE BELOW 1090' ON DECEMBER 31 OF THE CALENDAR YEAR, THEN THAT WOULD PUT US IN A TIER ZERO SHORTAGE THE FOLLOWING CALENDAR YEAR. IF IT'S BELOW 1075, AS IT IS NOW, WE ARE IN A TIER 1 SHORTAGE. AND WHAT YOU CAN SEE BASED ON THE GREEN LINE THAT WE WILL VERY LIKELY STAY IN A TIER ONE SHORTAGE AT LEAST THROUGH MID 2027, AND BELOW 1050, ANOTHER LEVEL OF SHORTAGE, BELOW 1025, ANOTHER LEVEL OF SHORTAGE. 975, THE REMEMBER ON THE BOTTOM HERE IS DEADPOOL FOR LAKE MEAD, ESSENTIALLY, YOU CAN'T GET WATER PAST THE DAM AT THAT POINT. SO NOW, LET'S TALK ABOUT THE THING THAT'S BEEN IN THE PAPERS A LOT, THESE DISCUSSIONS THAT ARE GOING ON ABOUT THE POST 2026 GUIDELINES. IN 2007, THE SEVEN STATES AND THE FEDERAL GOVERNMENT GOT TOGETHER AND PUT TOGETHER A MANAGEMENT PLAN FOR THE RIVER THAT DETERMINED WHEN IS THE RIVER IN SURPLUS, WHEN IS THE RIVER IN SHORTAGE, WHAT ELEVATIONS IN LAKE MEAD WOULD BE USED TO SET THOSE LEVELS, THOSE TIERS OF SHORTAGE, [00:50:02] HOW THE TWO RESERVOIRS ARE BALANCED, HOW THE UPPER BASIN RESERVOIRS ARE USED IN ORDER TO PROTECT LAKE POWELL. AND SO ALL OF THOSE REGULATIONS THAT WE'VE BEEN LIVING UNDER FOR THE PAST ALMOST 20 YEARS, ARE GOING TO EXPIRE AT THE END OF NEXT YEAR. IT'S A 20-YEAR CONDITIONS, AND SO IT'S GOING TO EXPIRE. WHAT STARTED IN 2023 IS THAT THE BUREAU OF RECLAMATION SAID, WE'RE GOING TO START THIS PROCESS TO DO AN ENVIRONMENTAL IMPACT STATEMENT AND EVENTUALLY GET TO A RECORD OF DECISION THAT WOULD GOVERN HOW THE RIVER IS GOING TO BE MANAGED AFTER THOSE 2007 GUIDELINES EXPIRE. WE'RE CURRENTLY IN A PLACE WHERE THE BUREAU IS TAKING ALTERNATIVES. WE SUBMITTED WE BEING A LOWER BASIN STATES, SUBMITTED AN ALTERNATIVE AND HAVE CONSISTENTLY THROUGH THESE SEVEN BASIN STATES NEGOTIATIONS, BEEN GIVING A LOT UP. WE HAVE BEEN PROPOSING COMPROMISED POSITIONS FROM THE GET GO. ONE THING THAT'S IN COMMON FROM ALL OF WHAT WE PROPOSED, IS THAT THE LOWER BASIN STATES WOULD TAKE THE FIRST 1.5 MILLION ACRE FEET OF SHORTAGE, AND THE UPPER BASIN WOULD NOT HAVE TO GIVE UP ANYTHING IN THAT. IF THE SHORTAGE GOT WORSE AND MORE WAS CUT THAT THE BASINS WOULD EQUALIZE. THEY WOULD SHARE MAYBE NOT 5/50, BUT THEY WOULD SHARE IN MANDATORY CUTS IN ORDER TO PROTECT THE HEALTH AND STABILITY OF THE RIVER. RIGHT NOW, IT'S NOT ON THIS SLIDE, BUT THE BUREAU OF RECLAMATION, THE ACTING COMMISSIONER HAS SET A DEADLINE OF NOVEMBER 11TH, SO WE'RE VERY CLOSE TO THAT. FOR THE STATES TO COME UP WITH A COMPROMISE ALTERNATIVE, THAT'S PROBABLY NOT GOING TO HAPPEN. IN WHICH CASE, WHAT'LL HAPPEN IS THAT THE BUREAU WILL COME UP WITH THEIR OWN SET OF ALTERNATIVES TO STUDY AS PART OF THIS ENVIRONMENTAL IMPACT STATEMENT. WHAT THEY'VE SHOWN US IN THE PAST HAS NOT TAKEN INTO ACCOUNT THE CONCERNS OF THE LOWER BASIN. IT'S VERY PROTECTIVE OF LAKE POWELL'S POWER POOL ELEVATIONS, NOT SO MUCH OF LAKE MEAD IN TERMS OF HOW MUCH SHORTAGE THE LOWER BASIN WOULD HAVE TO TAKE. WE'RE NOT VERY HAPPY WITH THE ONES THEY'VE SHOWN US SO FAR. WE DON'T KNOW WHAT THEY'RE GOING TO COME UP WITH. IT'LL PROBABLY BE RELEASED IN DECEMBER AT THE COLORADO RIVER WATER USERS ASSOCIATION ANNUAL CONFERENCE IN LAS VEGAS. AND THEN IN THE SUMMER, THEY WILL FINALIZE THAT. WE'LL HAVE AN OPPORTUNITY, ALL THROUGH THIS PROCESS, TO COME UP WITH A COMPROMISED SOLUTION IF WE CAN. AND THEN THE FALL OF '26, THEY'LL HAVE A RECORD OF DECISION THAT HAS TO GO TO CONGRESS AND THE PRESIDENT TO APPROVE. AND AT THAT POINT, WE'LL HAVE NEW GUIDELINES FROM 2027, FOR HOWEVER LONG THOSE GUIDELINES ARE GOING TO LAST. WE DON'T KNOW IF IT'S GOING TO BE ANOTHER 20-YEAR OR IF IT WILL BE A FIVE YEAR, OR WE DON'T KNOW THAT YET. WE ARE TALKING TO THEM ON A WEEKLY BASIS, ALL SEVEN STATE REPRESENTATIVES. TOM BUSCHATZKE, WHO'S THE DIRECTOR OF THE ARIZONA DEPARTMENT OF WATER RESOURCES, IS THE STATE REPRESENTATIVE FOR ARIZONA, REPRESENTS THE GOVERNOR'S OFFICE. WE HAVE BEEN PROPOSING ADDITIONAL COMPROMISE SOLUTIONS, BECAUSE WE DON'T HAVE A COMPROMISE YET, THE FEDERAL GOVERNMENT HAS BEEN RELUCTANT TO START UP THE TALKS WITH MEXICO, BECAUSE MEXICO IN THE PAST, HAS BEEN VERY COOPERATIVE IN CUTTING DOWN THEIR OWN USAGE, LEAVING WATER BEHIND IN LAKE MEAD, AND SO WE NEED THAT. WE CAN'T GET ALONG WITHOUT THAT HELP FROM MEXICO. AGAIN, WE DON'T WANT TO GO TO LITIGATION, BUT IF THE FEDERAL GOVERNMENT DOES NOT PROTECT OUR WATER SUPPLY HERE IN ARIZONA AND IN THE LOWER BASIN STATES, IF IT'S ALL ABOUT PROTECTING LAKE POWELL, WE MAY HAVE TO GO TO LITIGATION WHICH GOES TO THE SUPREME COURT BECAUSE IT'S AN INTERSTATE LAWSUIT. AND THE LAST TIME WE DID THAT, IT WAS 20 YEARS BEFORE THE SUPREME COURT LAID DOWN THEIR DECISION. ARIZONA WON, BUT IT WAS COSTLY AND EXPENSIVE AND VERY TIME CONSUMING. ESSENTIALLY, THE BASICS OF OUR LATEST COMPROMISE SOLUTION. INSTEAD OF JUST SAYING WE'RE GOING TO GET THIS MANY MILLION ACRE FEET, WHAT THEY WERE SAYING IS THAT WE WOULD LOOK AT THE FLOW JUST BELOW GLEN CANYON DAM, [00:55:02] BELOW LAKE POWELL, AT LEE FERRY, WHICH IS THE DIVIDING LINE BETWEEN THE UPPER AND UPPER BASIN STATES AND THE LOWER BASIN STATES. WE WOULD LOOK AT A THREE-YEAR RUNNING AVERAGE, AND WE WOULD DIVIDE THE RIVER BY PERCENTAGE. IT COULD BE 50/50, IT COULD BE 60/40. WE DON'T KNOW. BUT HOWEVER THAT HAPPENS, WE STILL HAVE TO HAVE SOME MANDATORY CONSERVATION GOING ON IN THE UPPER BASIN, BECAUSE THE LOWER BASIN DOES NOT HAVE THE CAPACITY SINCE MOST OF THE COLORADO RIVER WATER IS USED FOR AGRICULTURE, YOU WOULD THINK, AND THE UPPER BASIN IS INSISTING THAT OUR AGRICULTURE IS WASTEFUL AND DOESN'T DO A GOOD JOB, AND THEY GROW VERY WATER INTENSIVE CROPS, AND THEY SHOULDN'T BE GROWING ANYTHING IN A DESERT ANYWAY. THAT THEIR POSITION IS THAT THEY DON'T FEEL THEY SHOULD TAKE ANYTHING BECAUSE THEY HAVEN'T GROWN INTO THEIR FULL ALLOTMENT, AND THE LOWER BASIN HAS, AND AS THOUGH IT'S SOMEHOW OUR FAULT FOR HAVING ECONOMIC DEVELOPMENT HAPPEN. AT FIRST, THE UPPER BASIN STATES WERE SAYING, WELL, THAT SOUNDS LIKE IT MIGHT WORK. AND THEN THEY SAID, BUT IT WON'T BECAUSE WE'RE NOT GOING TO GIVE UP WE'RE NOT TAKING ANY MANDATORY CUTS. WE'LL DO VOLUNTARY THINGS, BUT NO MANDATORY CUTS. THE PROBLEM, AND I'VE BEEN ADDRESSING IT. THERE'S THREE BASIC POINTS OF CONTENTION BETWEEN THE UPPER AND LOWER BASIN STATES. THE FIRST ONE IS HOW MUCH IS GOING TO BE RELEASED FROM POWELL. IF THE FEDERAL GOVERNMENT OPERATES GLEN CANYON DAM TO PROTECT LAKE POWELL AT THE EXPENSE OF LAKE MEAD, YOU LOOK AT THE RIGHT HAND CHART, AND YOU CAN SEE THAT WATER LEVELS IN LAKE MEAD COULD DROP PRECIPITOUSLY VERY QUICKLY. WHEREAS IF THEY DON'T DO THAT, IF THEY JUST RELEASE THE WATER AS IT STANDS, THEN IT'S GOING TO BE WE WANT TO BALANCE THOSE TWO RESERVOIRS. THAT'S WHAT THE LOWER BASIN IS SAYING. THE SECOND POINT OF CONTENTION IS, WHAT DOES THE 1922 COMPACT THAT ESSENTIALLY STARTED THE LAW OF THE RIVER, WHAT DOES THAT REQUIRE? AND THERE'S SOME DIFFERENCE OF OPINION. AS I MENTIONED, THEY RELEASED 7.5 MILLION ACRE FEET TO THE LOWER BASIN BECAUSE UNDER THE COMPACT, THE UPPER BASIN GETS 7.5 MILLION, LOWER BASIN GETS 7.5 MILLION ACRE FEET A YEAR. AND THEN THE REST OF THAT IS AVAILABLE TO THE BUREAU AND THE STATE TO REALLOCATE OVER TIME. AND THAT'S WHY MARANA WAS ABLE TO PUT IN FOR A COUPLE HUNDRED ACRE FEET, SOMETHING LIKE THAT OF NIA WATER. SO WHEN IT'S AVAILABLE YOU HAVE THAT THERE WHEN IT'S NOT AVAILABLE IN SHORTAGE. SO WHAT WOULD HAPPEN IF THE UPPER BASIN WAS TO AGREE THAT IN THAT STATIC REDUCTION ZONE, WE'LL TAKE AMONGST THE LOWER BASE IN STATES IN MEXICO, 1,500,000. WHAT YOU CAN SEE HERE IS THAT THE SHORTAGES START TO HIT THOSE HIGH PRIORITY CUSTOMERS,16% REDUCTION ON THE AMOUNT OF WATER WE CAN DELIVER TO THE TRIBES, AND A 20% REDUCTION ON WHAT WE CAN DELIVER TO MUNICIPAL AND INDUSTRIAL CUSTOMERS. THAT IT WOULDN'T AFFECT YOUR DRINKING WATER SUPPLY, SO TO SPEAK, BUT YOU WOULD HAVE LESS WATER TO RECHARGE. SO WHAT IS THE LOWER BASIN DOING? ONE OF THE THINGS THAT'S VERY CLEAR IS THAT THE UPPER BASIN IS MAKING THE PUBLIC CASE TO THE FEDERAL GOVERNMENT, TO THE CITIZENS OF THE UPPER BASIN STATES THAT ARIZONA IS WASTEFUL. CALIFORNIA USES TOO MUCH. YOU SHOULDN'T GROW CROPS IN THE DESERT. ALL OF THE CITIES IN ARIZONA, THE PHOENIX AREA CITIES AND THE TUCSON AREA CITIES AND TOWNS ARE ALL PROFLIGATE.
