I KNOW WHAT THE DIFFERENCE IS BETWEEN A STATE-RUN PRISON, A FEDERALLY RUN PRISON, A PRIVATE PRISON, AND A DETENTION CENTER. WHEN YOU'RE TALKING ABOUT A DETENTION CENTER, YOU'RE PRETTY MUCH TALKING THE LOWEST RUNG ON THE LADDER. STATE PRISONS PEOPLE THAT WORK THERE, AND IT'S RUN BY PROFESSIONALS. THIS MATTER AFFECTS EVERYONE IN SOUTHERN ARIZONA, WITH A MAJORITY OF THE COMMUNITY BEING A MINORITY BASE OF HISPANIC LATINO RESIDENTS. THE IMMIGRATION DETENTION CENTER ENFORCES POWERS HAVE EXPANDED OVER THE PAST YEAR, AND THEY'RE ONLY BECOMING MORE AND MORE DANGEROUS FOR EVERY CITIZEN. US CITIZENS AND LAWFUL PERMANENT RESIDENTS WILL BE AFFECTED, NOT ONLY LEGAL MIGRANTS. WHENEVER IF IT'S THE PLACE OF DETENTION CENTER OR PLACE IN THE MIDDLE OF OUR COMMUNITY, IT'S NOT A RESULT OF SAFETY, IT'S FEAR. I URGE YOU GUYS TO PLEASE PUT A CONTROL OVER THIS DETENTION CENTER. THE FATHER, BEING THE PROVIDER AND A PILLAR IN THE COMMUNITY, WAS TAKEN TO A DETENTION CENTER. LUCKILY, THE COMMUNITY RALLIED AROUND HIM AND PAID FOR A LAWYER, AND HE IS BACK OUT WITH HIS FAMILY. HIS CASE IS PENDING, THOUGH. THE SECOND, THE FATHER WAS PICKED UP. ICE HAS BEEN SAID TO HAVE OFFERED HIM TO STAY AND GET HIS WORK VISA EXTENDED IF HIS SON JOINS THE MILITARY. WHAT IS THIS WORLD COMING TO? YOU CAN'T JUST USE PEOPLE LIKE PAWNS. SO FAR, THEY'RE SAFE, BUT IF ICE IS ENCOURAGED TO COME TO PIMA COUNTY, THEY WON'T BE. THEY ARE TERRORIZING LOW-CRIME SUBURBAN COMMUNITIES JUST TO REACH THEIR DAILY QUOTA. NANNIES, LANDSCAPERS, CONSTRUCTION WORKERS, PEOPLE SHOWING UP FOR LEGITIMATE ASYLUM COURT HEARINGS, AND MORE ARE BEING SNATCHED WITHOUT REASON. THEY'VE USED TEAR GAS, RANDOMLY ATTACKING CLERGY, CIVILIANS, INCLUDING CHILDREN, WITHOUT WARNING. IS THIS WHAT WE WANT IN THE OLD PUEBLO, THE HOME OF LINDA RONSTADT, 23 MILES OF MEXICAN FOOD, AND A THRIVING HISPANIC POPULATION, WHICH HAS BEEN HERE SINCE BEFORE ARIZONA BECAME A STATE? THEY'RE GRABBING PEOPLE AT THEIR JOBS. CHILDREN ARE TERRIFIED THEY'LL COME HOME FROM SCHOOL AND HAVE THEIR PARENTS GONE. IN PLACES TARGETED BY ICE, COMMUNITIES HAVE STEPPED UP TO CREATE PATROLS TO ESCORT CHILDREN TO AND FROM SCHOOL AND ALERT THE NEIGHBORHOOD WHEN ICE IS PRESENT. RECENTLY, I HAD TO ATTEND A HEARING IN PIMA COUNTY. THE FIRST STATEMENT THE JUDGE MADE WAS, RARELY DOES HE SEE AN IMMIGRANT IN HIS COURTROOM. WHY? BECAUSE THEY'RE LAW-ABIDING, HARDWORKING FOLKS CONCENTRATING A BETTER LIFE FOR THEIR FAMILIES. SOMETHING WE SHOULD ALL BE ABLE TO UNDERSTAND. IF YOU BRING ICE TO PIMA COUNTY, YOU WILL HAVE PROTESTS, YOU WILL HAVE PEOPLE STANDING UP FOR THEIR FRIENDS AND NEIGHBORHOODS. MY DAUGHTER ASSISTS IN THE HARVEST EVERY YEAR. THE FOLKS THAT HELPED GET TO TAKE SOME POTATOES HOME, AND THE REST GOES TO THE FOOD BANK. THIS YEAR, SHE SAID THERE WERE A LOT LESS POTATOES BECAUSE THE FOLKS THAT NORMALLY PLANT THEM DIDN'T COME. SHE ALSO SAID THERE WERE NO WORKERS HARVESTING THIS YEAR. IT'S HAPPENING EVERYWHERE. THIS IS AN EGREGIOUS VIOLATION OF THE CONSTITUTION. IT IS ALSO A CANCER. LIKE A CANCER, IF IT'S NOT STOPPED, IT WILL SPREAD. IMAGINE YOURSELF OR A LOVED ONE ARRESTED BY A MASKED MAN, PUT INTO A DETENTION CENTER WITH HORRIFIC CONDITIONS, AND THEN SHIPPED OFF TO PERMANENT PRISON IN SOUTH SUDAN. THIS HAS TO STOP. IT HAS TO STOP AT THE NATIONAL LEVEL, BUT IT STARTS AT THE LOCAL LEVEL, RIGHT HERE IN MARANA. WHEN I'M IN THE MARINE CORPS, I TOOK AN OATH TO PRESERVE, PROTECT, AND DEFEND THE CONSTITUTION. THIS IS THE FUND THAT WE ARE GOING TO USE TO PAY OFF THE FINANCING THAT WE TOOK ON TO FINISH THE CONSTRUCTION OF THE MARK. THEN LIKEWISE, I'M ONLY GOING TO GO TO THE WATER OPERATING FUND, BUT IT'S A SIMILAR STORY FOR WASTE WATER. OUR CHARGES FOR SERVICES. THESE ARE OUR REVENUES THAT WE COLLECT FROM OUR USERS. THOSE ARE ALSO HITTING THE 24, 25% MARK, WHICH IS IN LINE WITH EXPECTATIONS AT THIS TIME OF YEAR. HAVING SAID THAT, AND BECAUSE I KNOW IT'S A QUESTION THAT MIGHT COME UP, WE DID LOOK AT SOME PRELIMINARY NUMBERS FOR THE MONTH OF OCTOBER. AS YOU KNOW, WE DID HAVE THE FEDERAL GOVERNMENT SHUT DOWN. EXCUSE ME. ONE OF THE THINGS WE LOOKED AT WAS HOW MUCH OF AN IMPACT DID THAT HAVE TO OUR SALES TAXES AND IT DID HAVE AN IMPACT. HOWEVER, EVEN AFTER LOOKING AT THAT IMPACT, WHERE WE SAW FOR SOME OF OUR SALES TAXES, RETAIL SALES TAX, THEY WERE IMPACTED AND A FEW OTHER CATEGORIES, INCLUDING SOME OF OUR HOTELS AND RESTAURANTS AND BAR SALES TAXES, WE DID SEE A DOUBLE DIGIT DROP, BUT OVERALL, WE SAW ABOUT 10-12% DROP IN MANY OF THOSE CATEGORIES. IN TOTAL, OUR REVENUES DROPPED BY ABOUT 12% FOR THE MONTH OF OCTOBER. HAVING SAID THAT, THOUGH, WHEN WE LOOK AT THE FIRST FOUR MONTHS OF THE YEAR, OUR COLLECTIONS ARE PRETTY MUCH WHERE WE EXPECT THEM TO BE. IT REQUIRED ALL ARIZONA MUNICIPALITIES WITH A POPULATION OF MORE THAN 75,000 TO ADOPT REGULATIONS ALLOWING DUPLEXES, TRIPLEXES, FOURPLEX, AND TOWN HOMES, WHICH IS THEY CALLED MIDDLE HOUSING. ON ALL LOTS ZONED FOR SINGLE FAMILY RESIDENTIAL USE WITHIN ONE MILE OF THE MUNICIPALITIES DOWNTOWN AREA, AND ON AT LEAST 20% OF ANY NEW DEVELOPMENT OF MORE THAN 10 CONTIGUOUS ACRES. [00:50:07] THE REASON WHY WE'RE IN FRONT OF YOU TONIGHT IS BECAUSE THE STATUTE DOES HAVE A PROVISION THAT SAYS, IF THE MUNICIPALITY DOES NOT ADOPT THE REGULATIONS REQUIRED BY THIS SECTION ON OR BEFORE JANUARY 1ST, 2026, THEN MIDDLE HOUSING WOULD BE ALLOWED IN ALL LOTS IN THE TOWN THAT ARE ZONED FOR SINGLE FAMILY RESIDENTIAL. EVEN THOUGH THE TOWN HAS NOT QUITE HIT 75,000 IN POPULATION YET, WE DO EXPECT THAT THAT WILL BE IMMINENT IN NOT SO DISTANT FUTURE. TO AVOID HAVING NO LIMITS ON MIDDLE HOUSING, WE'RE BRINGING THIS FORWARD BEFORE THAT JANUARY 1ST, 2026 DEADLINE. BUT IN THIS CASE, OUR STAFF'S PROPOSAL, IS TO HAVE THIS ORDINANCE GOING INTO EFFECT AS OF JANUARY 1ST, 2026, RATHER THAN WAITING FOR THE TOWN TO REACH THE 75,000 POPULATION THRESHOLD. IT IS SOMETHING THAT WE'VE BEEN TALKING ABOUT WITH THE COUNCIL OVER THE LAST MANY YEARS OF TRYING TO PROMOTE HOUSING DIVERSITY IN THE TOWN AND TO HAVE DIFFERENT TYPES OF HOUSING PRODUCT AVAILABLE TO RETIREES OR TO FIRST TIME HOMEOWNERS OR STUDENTS OR THOSE KINDS OF THINGS. STAFF IS RECOMMENDING THAT WE ADOPT THESE PROVISIONS NOW. THE NEW TOWN CODE SECTION IS 17615. IT INCLUDES ALL OF THE ELEMENTS THAT ARE REQUIRED BY THE STATE LAW, DEFINITIONS OF MIDDLE HOUSING. WHAT THE STATE LAW SAYS IS THAT THEY NEED TO BE PERMITTED USES IN THOSE AREAS THAT I DESCRIBED, MEANING THAT THERE WOULD BE NO PUBLIC HEARING. THESE ARE THINGS THAT WOULD BE ADMINISTRATIVELY APPROVED WITH A DEVELOPMENT PLAN. ONE AREA THAT WE DID HAVE A LITTLE BIT OF ABILITY TO DEFINE CENTRAL BUSINESS DISTRICT IS THE ENTIRE GEOGRAPHIC AREA THAT THE TOWN HAS OFFICIALLY DESIGNATED AS ITS DOWNTOWN OR EQUIVALENT ON THE EFFECTIVE DATE OF THE SECTION. THAT'S WHERE WE WERE ABLE TO SAY, WHAT IS OUR CENTRAL BUSINESS DISTRICT? WHAT DO WE THINK IS OUR CENTRAL BUSINESS DISTRICT, WHERE WE'RE GOING TO ALLOW THIS TYPE OF HOUSING WITHIN ONE MILE? WHAT WE HAVE SUGGESTED FOR THE CENTRAL BUSINESS DISTRICT STAFF IS THAT WE USE THE TOWN'S DOWNTOWN MARANA OVERLAY DISTRICT, OUR DO ZONE, AND I'LL SHOW YOU A MAP OF WHERE THAT IS ON ONE OF THE NEXT SLIDES. THE TOWN, IF WE GET AN APPLICATION, WE WOULD HAVE TO DETERMINE THAT THERE'S SUFFICIENT PUBLIC WATER AND SEWER SERVICES AND THAT ADEQUATE URBAN SURFACES ARE AVAILABLE TO SERVE THE DEVELOPMENT SO IT'S NOT JUST A RUBBER STAMP. WE GOT THE APPLICATION, AND IT'S WITHIN THE PARAMETERS. WE DO HAVE TO MAKE SURE THAT THERE IS SUFFICIENT SERVICES TO SERVE THE DEVELOPMENT. CURRENTLY, IN OUR USE MATRIX IN THE CODE, WE HAD DUPLEXES AND TOWNHOUSES WAS LISTED. WE DID NOT HAVE TRIPLEXES AND FOURPLEXES. WE NEEDED TO ADD THOSE. AND WHAT THIS MEANS IS THAT THESE USES WILL BE ALLOWED AS LONG AS THEY MEET CERTAIN CONDITIONS, EXCEPT FOR, AS YOU CAN SEE, IN THE FAR RIGHT HAND SIDE, NOT ALLOWED IN INDUSTRIAL ZONING DISTRICTS. THAT IS IN YOUR PACKET. WE'VE DETERMINED THAT THE MIDDLE HOUSING ORDINANCE IS NOT ANTICIPATED TO HAVE ANY IMPACT ON THE AVERAGE COST TO CONSTRUCT HOUSING. AND IT COULD POTENTIALLY HAVE THE EFFECT OF MAKING HOUSING MORE ATTAINABLE IN MARANA AS IT ALLOWS MIDDLE HOUSING IN SOME INSTANCES WHERE IT WASN'T PREVIOUSLY. THE CASCADA NORTH SPECIFIC PLAN WAS ADOPTED IN 2011 AND BROKE OFF A PIECE OF THE ORIGINAL CASCADA PLUS SOME ADDITIONAL PROPERTY. BUT MORE RECENTLY ON OCTOBER 21ST OF THIS YEAR, THE COUNCIL APPROVED THE CASCADA II SPECIFIC PLAN, WHICH ESTABLISHES ZONING FOR A LITTLE OVER 750 ACRES OF THE REMAINING DEVELOPABLE AREA IN THE CASCADA NORTH AREA. THIS AMENDED AND RESTATED DEVELOPMENT AGREEMENT ON TONIGHT'S AGENDA ADDRESSES THE REVISED DEVELOPMENT PROJECT THAT WAS APPROVED BY THE CASCADA II SPECIFIC PLAN IN OCTOBER. JUST AS A REMINDER, THIS IS THE LAND USE CONCEPT THAT WAS INCLUDED WITHIN THE CASCADA II SPECIFIC PLAN, JUST TO GIVE SOME CONTEXT OF WHERE WE'RE TALKING ABOUT HERE AND WHAT THE PLAN IS FOR THIS PARTICULAR 750 ACRES. THIS AGREEMENT, LIKE THE ONE THAT WE JUST SPOKE ABOUT A MINUTE AGO FOR DOWNTOWN, IS A RETAIL DEVELOPMENT TAX INCENTIVE AGREEMENT. ON OCTOBER 7TH OF THIS YEAR, COUNCIL DID ADOPT THE NOTICE OF INTENT THAT'S REQUIRED FOR US TO ENTER INTO THIS AGREEMENT. AGAIN, A RETAIL DEVELOPMENT TAX INCENTIVE AGREEMENT IS AN AGREEMENT IN WHICH THE TOWN AGREES TO REIMBURSE A DEVELOPER WHO'S GOING TO HAVE RETAIL DEVELOPMENT ACTIVITIES WITH SALES, USE OR TRANSACTION PRIVILEGE TAX REVENUES. IN ORDER TO ENTER INTO AN AGREEMENT SUCH AS THIS, THE COUNCIL HAS TO FIND THAT THE PROPOSED TAX INCENTIVE IS ANTICIPATED TO RAISE MORE REVENUE THAN THE AMOUNT OF THE INCENTIVE THAT WILL BE REIMBURSED TO THE DEVELOPER OVER THE LIFE OF THE AGREEMENT. THESE ARE ALL STATUTORY REQUIREMENTS. THE COUNCIL'S FINDING ON THAT POINT HAS TO BE VERIFIED BY AN INDEPENDENT THIRD PARTY THAT IS NOT FINANCED BY THE DEVELOPER. IN THIS CASE, THE TOWN DID ENGAGE ELLIOTT D. POLLACK AND COMPANY, AND THEY CONDUCTED THE REQUIRED INDEPENDENT THIRD PARTY REVIEW OF THE AGREEMENT AND HAVE VERIFIED THAT FINDING THAT THE TAX INCENTIVE WILL RAISE MORE REVENUE THAN THE TOWN PAYS. BUT THE TOWN THERE'S A LOT OF GREAT INFORMATION IN THAT REPORT, BUT THE TOWN IS PROJECTED TO RECEIVE $197 MILLION IN RETAIL SALES TAX OVER A 20 YEAR ANALYSIS PERIOD. THE DEVELOPMENT AGREEMENT, IF APPROVE, WOULD REIMBURSE THE DEVELOPER UP TO THE DEVELOPER'S FULL COST, FOR SOME DRAINAGE INFRASTRUCTURE THAT IS GOING TO BE REQUIRED TO DEVELOP THE PROPERTY. [01:15:01] THERE'S BASINS THAT ARE LOCATED ON WHAT WILL BE A TOWN PARK AND SOME REGIONAL CHANNELS THAT ARE LOCATED WITHIN THE DEVELOPMENT THAT ARE PRETTY SIGNIFICANT PIECES OF INFRASTRUCTURE THAT WILL NEED TO BE CONSTRUCTED BY THE DEVELOPER. THE CURRENT ESTIMATE FOR THOSE COSTS IS $12- $15 MILLION THAT THE TOWN WOULD BE REIMBURSING THE DEVELOPER THROUGH THE 45% OF RETAIL SALES TAX AND 75% OF CONSTRUCTION SALES TAX THAT ARE GENERATED ON THE CASCADA PROPERTY. THAT'S THE MAIN PROVISION. I DON'T KNOW IF IT'S THE MAIN PROVISION, BUT IT IS OBVIOUSLY A VERY IMPORTANT PART OF THE DEVELOPMENT AGREEMENT, BUT I WAS JUST GOING TO SPEND A COUPLE OF MINUTES AGO OVER SOME OF THE OTHER PARTS OF THE AGREEMENT PARK IMPROVEMENTS. THE DEVELOPER PREVIOUSLY DEDICATED 65 ACRES OF LAND, WHICH IS LOCATED JUST WEST OF THE CASCADA PROPERTY ALONG I10 TO THE TOWN FOR A DISTRICT PARK. THAT'S HAPPENED OVER THE COURSE OF THESE YEARS THAT I WAS DISCUSSING ON THE FIRST SLIDE. WHAT THE DA CALLS FOR IS THAT THE TOWN AND THE DEVELOPER WILL COOPERATE IN MASTER PLANNING PARK FOR THAT SITE. THE TOWN WILL BE RESPONSIBLE FOR DESIGN CONSTRUCTING THE SITE, BUT THE DEVELOPER WILL BE RESPONSIBLE FOR THE COSTS ASSOCIATED WITH THAT DESIGN AND CONSTRUCTION, AND THAT WOULD BE WE'RE NOT PUTTING A LIMIT ON THAT COST. THEY HAVE TO PAY FOR THE FULL COST. BUT AT THE NEXT TOWN DEVELOPMENT IMPACT FEE UPDATE THAT WILL BE COMING UP, WE WILL INCLUDE THOSE COSTS, SO THERE WILL BE ESTIMATES AT THAT POINT WITHIN THE IMPACT FEE PROGRAM, AND THE DEVELOPER WILL BE ENTITLED TO IMPACT FEE REIMBURSEMENTS FOR THE PARK COSTS AS PROVIDED BY STATE LAW. THE PARK IS NOT A NEW ELEMENT. THIS HAS BEEN A PART OF THE PROJECT SINCE THE BEGINNING, AND IT WAS ADDRESSED IN THE ORIGINAL CASCADA SPECIFIC PLAN AND IN THE ORIGINAL CASCADA DA. WE DO HAVE A COMMUNITY PARK CONCEPT THAT'S ATTACHED TO THE DEVELOPMENT AGREEMENT JUST TO HAVE SOME AGREEMENT AT THE START OF WHAT WE THINK IS APPROPRIATE FOR A COMMUNITY PARK OF THIS SIZE. THIS CONCEPT WAS WORKED ON WITH OUR PARKS DEPARTMENT AND THE DEVELOPER. OUR PARKS DEPARTMENT IS COMFORTABLE WITH THIS DESIGN AND HAS GIVEN IT ITS STAMP OF APPROVAL AS A CONCEPT MOVING FORWARD FOR THIS PARK. I WON'T GO INTO GREAT DETAIL, BUT THERE ARE OTHER DA PROVISIONS. THIS PROPERTY OR AT LEAST I'M NOT A DRAINAGE EXPERT, BUT PARTS OF IT ARE LOCATED IN SPECIAL FLOOD HAZARD AREAS. THE DEVELOPER WILL HAVE TO GET LETTER MAP PROVISIONS FROM FEMA, AND THEY DO HAVE A CONDITIONAL LETTER OF MAP REVISION RIGHT NOW FOR PHASE 1 OF THE DEVELOPMENT, AND THEY WILL BE PROCEEDING IN PHASES, BUT THEY WON'T BE ABLE TO GET ANY CERTIFICATES OF OCCUPANCY FOR ANY PHASE IN QUESTION UNTIL THEY'VE GOTTEN THEIR LORM FROM FEMA FOR THAT PHASE. AS FAR AS TRANSPORTATION AND WATER, THE DEVELOPER HAS TO PROVIDE TRAFFIC IMPACT ANALYSIS AS IS THE REGULAR NORMAL IN OUR DEVELOPMENT PROCESS. THERE IS ONE THAT'S BEEN UNDER REVIEW, AND IT DOES HAVE A PHASED LIFE. AS FAR AS I KNOW, IT HAS NOT YET BEEN APPROVED, BUT IT WILL HAVE TO BE PRIOR TO THE DEVELOPER BEGINNING DEVELOPMENT. A WATER PLAN HAS BEEN APPROVED PURSUANT TO NORMAL TOWN STAFF PROCEDURES, AND IT WILL REQUIRE CONSTRUCTION OF 910,000 GALLONS OF STORAGE AT THE TOWN'S BLUE BONNET RESERVOIR SITE, AND THEN FUTURE ANOTHER 900,000 GALLONS AS REQUIRED BY THE APPROVED WATER PLAN AND AS TRIGGERED AS THE WATER PLAN SAYS IT HAS TO BE DONE. DRAINAGE IMPROVEMENTS AS WELL. IT'S NOT MENTIONED ON THE SLIDE, BUT THERE IS A DRAINAGE PLAN THAT WAS APPROVED ALREADY THROUGH THE TOWN'S PROCESSES.
