[ MARANA PLANNING COMMISSION MEETING NOTICE AND AGENDA 11555 W. Civic Center Drive, Marana, Arizona 85653 Council Chambers, February 25, 2026, at or after 6:00 PM Thomas Schnee, Chairman Ronald Hill, Vice Chair David Bowen, Commissioner John Flint, Commissioner John McIntyre, Commissioner Joseph Parsons, Commissioner Sharon Tyson, Commissioner Pursuant to A.R.S. § 38-431.02, notice is hereby given to the members of the Marana Planning Commission and to the general public that the Planning Commission will hold a meeting open to the public on February 25, 2026, at or after 6:00 PM located in the Council Chambers of the Marana Municipal Complex, 11555 W. Civic Center Drive, Marana, Arizona. ACTION MAY BE TAKEN BY THE COMMISSION ON ANY ITEM LISTED ON THIS AGENDA. Revisions to the agenda can occur up to 24 hours prior to the meeting. Revisions to the agenda appear in italics. Marana Planning Commission Welcome to this public meeting of the Marana Planning Commission. The Commission consists of seven citizens who are appointed by the Town Council and serve without pay. For the most part, the Commission acts in an advisory capacity to the Town Council on matters related to land use planning and zoning. Citizens are encouraged to address the Commission with their concerns on agenda items during the public testimony portions of the meeting, or other issues at the Call to the Public. Meeting Times Regular Commission meetings are usually held on the last Wednesday of each month at 6:00 PM at the Marana Municipal Complex, although the date or time may change and additional meetings may be called at other times and/or places. Speaking at Meetings If you are interested in speaking to the Commission during the Call to the Public or Public Hearings, you must fill out a speaker card (located inside the Council Chambers) and deliver it to the Planning Commission Secretary prior to the convening of the meeting. All persons attending the Commission meeting, whether speaking to the Commission or not, are expected to observe the Commission rules, as well as the rules of politeness, propriety, decorum and good conduct. Any person interfering with the meeting in any way, or acting rudely or loudly will be removed from the meeting and will not be allowed to return. Accessibility To better serve the citizens of Marana and others attending our meetings, the Council Chambers are wheelchair and handicapped accessible. Persons with a disability may request a reasonable accommodation, such as a sign language interpreter, by contacting the Town Clerk at (520) 382-1999. I'M HERE BEFORE YOU FOR SOME PRETTY MINOR AMENDMENTS TO THE ACCESSORY DWELLING UNIT REGULATIONS THAT WE ADOPTED LAST YEAR. THESE, REGULATIONS WERE ADOPTED.

I GUESS IT WAS IN 2024 WHEN WE ADOPTED THEM, DUE TO STATE LAW THAT REQUIRED THAT ANY MUNICIPALITY WITH A POPULATION OF OVER 75,000 PEOPLE HAD TO ALLOW ACCESSORY DWELLING UNITS IN RESIDENTIALLY ZONED PARCELS UNDER CERTAIN CIRCUMSTANCES.

AND THERE ARE A LOT OF CIRCUMSTANCES. SO IN 2024, WE BROUGHT FORWARD TO COMMISSION AND THEN TO COUNCIL REGULATIONS REGARDING THOSE ADUS THAT COMPLIED WITH THE STATE LAW. AND WE INCLUDED A PROVISION IN THERE THAT THOSE WON'T BECOME EFFECTIVE UNTIL THE TOWN REACHES THE POPULATION OF 75,000. BUT WE WANTED TO HAVE THEM ON THE BOOKS BEFORE JANUARY 1ST, 2025, BECAUSE THERE WAS A PROVISION IN THE STATE LAW THAT SAID, IF YOU DON'T HAVE SOMETHING ON THE BOOKS, THEY'RE ALLOWED EVERYWHERE.

AND WE JUST WANTED TO MAKE SURE THAT DIDN'T APPLY TO US, EVEN IF WE WEREN'T AT 75,000.

NOW, IN THE LAST LEGISLATIVE SESSION, 2025, THE LEGISLATURE ADOPTED A COUPLE OF TWEAKS TO THE ADU BILL, AND THAT'S WHAT WE'RE ADDRESSING HERE NOW. ONE OF THE TWEAKS WAS A REVISION TO THE DEFINITION OF WHAT IS A RESTRICTED AFFORDABLE DWELLING UNIT. AND YOU CAN SEE ON MY SLIDE HERE I KIND OF HIGHLIGHTED THEY JUST CHANGED SHALL BE TO IS WHICH MAKES A LOT OF SENSE THAT IT'S ONLY A RESTRICTED AFFORDABLE DWELLING UNIT IF IT'S ACTUALLY BEING USED AS ONE CURRENTLY.

AND ON THE BOTTOM OF THE SLIDE, I JUST THIS IS WHAT THE CODE READS RIGHT NOW JUST TO REMIND US ALL OF WHAT THIS IS ABOUT.

IT'S THAT ACCESSORY DWELLING UNITS HAVE TO BE ALLOWED AS A PERMITTED USE.

AS LONG AS THE TOWN DETERMINES THAT THERE'S ADEQUATE PUBLIC UTILITY SERVICES.

THEN THEY'RE PERMITTED USES ON ANY SINGLE FAMILY LOT OR PARCEL THAT CONTAINS A PRIMARY DWELLING,

WITH AN ATTACHED ACCESSORY DWELLING UNIT AND ONE DETACHED ON ANY ONE OF THOSE PARCELS, AND THEN YOU CAN HAVE ONE ADDITIONAL DETACHED IF THE LOT IS ONE ACRE OR MORE IN SIZE, AND IF ONE OF THOSE UNITS IS A RESTRICTED AFFORDABLE DWELLING UNIT.

SO THAT'S WHY THAT DEFINITION IS IN THE CODE.

NOW AS WE TALKED ABOUT THIS WOULDN'T APPLY TO SPECIFIC PLANS THAT ARE ALREADY IN PLACE.

THIS APPLIES TO THE TOWN'S REGULAR ZONING DISTRICTS WHEN WE HIT 75,000.

ANOTHER REVISION THAT THE STATE MADE WAS THERE'S A LIST OF EXCEPTIONS THAT THE ADUS DON'T HAVE TO BE ALLOWED ON CERTAIN PARCELS OF LAND. AND ONE OF THOSE IS LAND IN THE VICINITY OF A PUBLIC AIRPORT AS DEFINED IN STATE LAW.

AND THEY'VE ADDED THIS ADDITIONAL LANGUAGE SO THAT IT ALSO IT HAS TO BE AN AIRPORT THAT HAS A NOISE LEVEL OF GREATER THAN 65DB IN ORDER TO BE EXCLUDED FROM THE REQUIREMENT TO ALLOW ADUS.

SHORT TERM RENTALS. THAT'S BEEN A BIG TOPIC OF DISCUSSION AT THE LEGISLATURE OVER THESE ADU BILLS, THE MUNICIPALITIES AND I THINK THE LEAGUE. BUT I'M NOT POSITIVE.

BUT DEFINITELY MUNICIPALITIES CAME FORWARD AND SAID, IF YOU'RE GOING TO ALLOW ALL THESE ADUS AND FORCE US TO ALLOW THEM, THEN THEY CAN'T BE USED AS SHORT TERM RENTALS.

THEY NEED TO BE, ACTUALLY BE USED TO PROVIDE ADDITIONAL HOUSING STOCK TO PEOPLE, BECAUSE THAT'S SUPPOSEDLY THE REASON FOR THIS.

WE LOST THE MUNICIPALITIES LOST ON THAT POINT.

THEY ARE ALLOWED TO BE USED AS SHORT TERM RENTALS.

AND NOW THIS YEAR, THEY'VE KIND OF MADE IT EVEN HARDER FOR US.

SO PREVIOUSLY, THE CODE JUST SAYS THAT AN ACCESSORY DWELLING UNIT MAY ONLY BE USED FOR SHORT TERM RENTAL IF THE OWNER IS ALSO RESIDING ON THE PROPERTY WHERE THE ADU IS. BUT NOW WE CAN ONLY APPLY THAT RESTRICTION IF THE ADU RECEIVED ITS CFO OR CERTIFICATE OF COMPLETION OR OTHER FINAL APPROVAL. SEPTEMBER 14TH, 2024 OR LATER, WHEN THE ORIGINAL LEGISLATION WENT INTO EFFECT OR WAS ADOPTED.

SO IF IT WAS IN PLACE BEFORE THAT THAT RESTRICTION DOESN'T APPLY.

THE TOWN REALLY HASN'T ALLOWED ADUS, SO IT'S PROBABLY NOT AN ISSUE FOR US IN ANY EVENT, BECAUSE WE WEREN'T, THEY MOSTLY WERE NOT PERMITTED IN MOST LOCATIONS PRIOR TO SEPTEMBER 14TH, 2024, IN ANY CASE.

AND THEN THIS CORRESPONDING CHANGE TO CHAPTER 9-14, WHICH IS NOT ACTUALLY WITHIN YOUR PURVIEW AS THE PLANNING COMMISSION.

IT'S PART OF OUR BUSINESS REGULATION CODE AND OUR REGULATION OF SHORT TERM AND VACATION RENTALS.

THEY HAVE TO GET A SPECIFIC LICENSE AND PROVIDE US WITH SPECIFIC INFORMATION.

AND AGAIN, THAT'S ALL CONTROLLED BY STATE LAW.

BUT WE JUST HAD TO MAKE A CORRESPONDING CHANGE TO THAT SECTION IN 9-14 TO ALSO HAVE THAT, THE, AN ACCESSORY DWELLING UNIT THAT WAS ISSUED A CERTIFICATE OF COMPLETION OR SIMILAR FINAL APPROVAL BY THE TOWN ON OR AFTER SEPTEMBER 14TH, 2024 CAN ONLY BE USED AS A SHORT-TERM RENTAL WHILE THE OWNER RESIDES ON THE PROPERTY.

SO WE'VE JUST INCLUDED IT IN THE ORDINANCE, EVEN THOUGH IT'S NOT SOMETHING THAT YOU GUYS WOULD NORMALLY VOTE ON.

IT'S ALL THE SAME TOPIC. AND WITH THAT, I'LL ANSWER ANY QUESTIONS.

OUR RECOMMENDATION IS THAT THE PLANNING COMMISSION RECOMMEND TO THE TOWN COUNCIL APPROVAL OF THESE REGULATIONS.

WE CAN TAKE A LOOK AT THAT. I'LL HAVE TO REMEMBER WHAT, HOW WE HAVE IT STRUCTURED, BUT WE CERTAINLY CAN ASK FOR ANY INFORMATION THAT WE NEED TO ASK FOR. THAT'S PART OF THE CODE AND A PART OF THE REGULATIONS.

THE APPLICANT IS LJA. THE REQUEST IS A WAIVER FROM THE REQUIREMENT TO UNDERGROUND AN EXISTING OVERHEAD ELECTRICAL POWER LINE ALONG THE SOUTH AND WEST BOUNDARIES OF THE SUBDIVISION. TOWN CODE REQUIRES OVERHEAD LIGHTS ON SITE AND ADJACENT TO NEW DEVELOPMENTS TO BE UNDERGROUND, BUT THE PLANNING COMMISSION MAY WAIVE THAT REQUIREMENT.

THERE IS A LOCATION MAP THERE OF THE VILLA PARK SUBDIVISION.

IT'S AT THE NORTHEAST CORNER OF WENTZ AND GRIER.

AND THEN ON THIS SLIDE, THE LAST SLIDE IS A UTILITY LINE EXHIBIT PROVIDED BY THE APPLICANT.

IN GREEN THERE, IT'S A LITTLE DIFFICULT TO SEE, BUT THOSE ARE THE OVERHEAD LINES THAT ARE BEING PROPOSED TO REMAIN ABOVE GROUND.

IN SUMMARY, THEY'RE INSTALLING. THEY JUST RECENTLY INSTALLED NEW POLES ALONG GRIER ROAD, WHICH IS THE SOUTH SIDE, THE SOUTH RIGHT OF WAY IN THAT EXHIBIT SHOWN.

AND THE REASON FOR KEEPING IT OVERHEAD, IN SUMMARY, I'M NOT GOING TO READ THE ENTIRE LETTER, IS TO, IS FOR EXISTING CUSTOMERS WITHIN THE AREA.

SO ONE SPECIFICALLY AT THE CORNER OF WENTZ AND GRIER ROAD THE EXISTING POLES WITHIN THE AREA DO SERVE THOSE EXISTING CUSTOMERS.

AND THESE UPGRADES ARE NECESSARY TO SUPPORT EXPANDING COMMUNITY AND TO MAINTAIN SAFE, RELIABLE ELECTRICAL SERVICES.

ALL RIGHT. SO THESE FOLKS, WHEN AND WHENEVER THIS GETS BUILT AND WHO'S EVER A LIFETIME, THEY'RE GOING TO DRIVE DOWN TO THEIR SUBDIVISION AND HAVE OVERHEAD LINES. CORRECT.

AND VICE CHAIR HILL, COMMISSIONER FLINT. JUST TO CLARIFY TOO, IT'S ONLY THESE LINES THAT ARE SHOWN HERE.

SO WITHIN THE SUBDIVISION. I REALIZE WITHIN THE SUBDIVISION, BUT YET.

JASON, I DON'T KNOW IF YOU CAN ANSWER THIS OR NOT.

WHEN TANGERINE WAS WIDENED FROM THE INTERSTATE TO ITS TERMINUS OF THE PROJECT AND ALL THOSE POLES WERE MOVED, NOBODY WAS OUT OF SERVICE DURING THAT TIME. WE AWARE OF THAT OR.

NO, I MEAN, ALL THE INDUSTRIAL PROPERTIES THAT ARE ON THE SOUTH SIDE OF TANGERINE AND SOME ON THE NORTH SIDE.

YEAH, COMMISSIONER FLINT, I WASN'T HERE AT THAT TIME, BUT I HAVE NOT HEARD OF ANYONE BEING OUT OF SERVICE DURING THAT WIDENING.

IF I MIGHT JUST INTERJECT ON THIS A LITTLE BIT.

COMMISSIONERS. YOU KNOW, FROM A STAFF LEVEL PERSPECTIVE, WE LOOK AT THIS AND EVEN JANE, BRETT AND I WERE TALKING ABOUT THIS BEFOREHAND.

ONE OF THE THINGS THAT IS A DISCONNECT RIGHT NOW IS IN OUR PROCESS, OVERALL PROCESS IS WHEN THE UTILITIES IN OUR AREA ARE DOING IMPROVEMENTS, WERE NOT MADE AWARE OF THEM UNTIL THEY'RE ACTUALLY UNDERWAY OR BEING COMPLETED.

SO IN THIS CASE, TEP HAS MADE A SIGNIFICANT INVESTMENT IN PUTTING NEW UTILITY POLES IN THERE.

AND NOW TO COME IN AFTERWARDS AND ASK THEM TO TURN AROUND AND UNDERGROUND IT.

WE DO THINK THAT THEY'RE, YOU KNOW, I'LL JUST SAY KIND OF A SLAP IN THE FACE FOR AN INVESTMENT THAT THEY JUST MADE.

BUT IT WOULD HAVE BEEN MORE PRUDENT IF WE KNEW ABOUT IT IN ADVANCE TO SAY, HEY, LOOK, WE KNOW THERE'S DEVELOPMENT THAT'S COMING IN THIS AREA.

YOU SHOULD REALLY BE UNDERGROUNDING THIS. SO I SAY THAT IN LIGHT OF I DON'T THINK THIS IS ANYTHING OF THE APPLICANT'S WRONGDOING IN DOING THIS.

AND I KNOW THAT'S NOT WHAT YOU'RE SUGGESTING EITHER, COMMISSIONER FLINT, BUT YOU KNOW, THAT'S JUST ONE OF THOSE THINGS, I THINK FROM A STAFF LEVEL, THIS IS A REASONABLE AND JUSTIFIED REQUEST.

THERE'S PROBABLY ABOUT 35 OTHER PEOPLE IN DEVELOPMENT SERVICES THAT YOU HAVE NOT INTERACTED WITH, BUT A GOOD GROUP OF PEOPLE AND BRETT HAS BEEN RECENTLY NAMED BY THE TOWN MANAGER TO SERVE IN THE INTERIM ROLE.

SO BRETT WILL BE TAKING OVER. HE IS A VERY CAPABLE INDIVIDUAL.

HE'S BEEN WITH US FOR ABOUT FOUR MONTHS, BUT HAS A WEALTH OF KNOWLEDGE AND EXPERIENCE AND IS VERY CAPABLE OF DOING THIS AND INTERACTS VERY WELL WITH THE TEAM.

SO, I WANT TO THANK ALL OF YOU GUYS FOR THE YEARS MANY OF YOU HAVE BEEN WITH ME FOR THE FULL EIGHT YEARS THAT I'VE BEEN HERE.
