ITS VISION IS TO BE THE DEPARTMENT OF HOMELAND SECURITY'S PREMIER LAW ENFORCEMENT AGENCY, MITIGATING TRANSNATIONAL THREATS AND SAFEGUARDING OUR NATION, COMMUNITIES, LAWFUL IMMIGRATION, TRADE, TRAVEL, AND FINANCIAL SYSTEMS. IF YOU'VE TRAVELED OUT OF THE COUNTRY, YOU DO SEE ICE AGENTS AT US AIRPORTS, AT CRUISE PORTS, ASSURING THAT TRAVELERS ARE HERE LEGALLY. SCHOOLS ARE NOT OPEN TO EVERYONE. PEOPLE MUST CHECK IN SO THAT SCHOOLS KNOW WHO IS ENTERING AND WHY.
THERE'S ALSO BUSINESSES THAT REQUIRE CHECK IN GYMS. YMC, THE MARC THEY WANT TO KNOW WHO'S COMING IN.

LISTENING TO THE OPPOSING VIEWS REGARDING THE ICE FACILITY IN THE LOCATION OF THE FORMER STATE PRISON IN MARANA.AT THE LAST COUNCIL MEETING, MANY SPEAKERS APPEALED TO THIS VENUE TO SAVE OUR DEMOCRACY.
THEREFORE, RATHER THAN EXPRESSING AN OPINION OF MY OWN, I AM HERE TO PRESENT SOME FACTS.
I'D LIKE TO CLARIFY THAT THE UNITED STATES OF AMERICA IS NOT A DEMOCRACY.
EVERY ELECTED OFFICIAL IN ARIZONA, WHEN SWORN INTO OFFICE, TAKES AN OATH TO SUPPORT THE CONSTITUTION OF THE UNITED STATES AND THE CONSTITUTION AND LAWS OF THE STATE OF ARIZONA. THE RULE OF LAW ALSO SERVES AS A CORNERSTONE IN A CONSTITUTIONAL REPUBLIC.
IN A CONSTITUTIONAL REPUBLIC, SUCH AS THE UNITED STATES, EVERY CITIZEN, IRRESPECTIVE OF THEIR STATUS OR AUTHORITY, IS SUBJECT TO THE LAW. THE MARANA FACILITY WAS A STATE'S FIRST PRIVATE PRISON OPERATED BY MTC, AND THE FACILITY HAS THE PROPER ZONING FOR THIS OPERATION.
MTC ALSO ALREADY RUNS FIVE ICE DETENTION CENTERS IN CALIFORNIA, NEW MEXICO, AND TEXAS.
THE DEPARTMENT OF HOMELAND SECURITY STATES THAT ICE INTENDS TO PROCURE COMPREHENSIVE DETENTION SERVICES THROUGH A TWO YEAR AGREEMENT WITH MANAGEMENT AND TRAINING CORPORATION, OR MTC. THE FACILITY IN MARANA WILL HAVE A CAPACITY OF, HOLDING UP TO 775 DETAINEES.
ACCORDING TO THE RULE OF LAW, THE MAYOR AND THIS BODY DO NOT HAVE THE CONSTITUTIONAL AUTHORITY TO BLOCK DHS AND MTC IN THIS AGREEMENT. THEREFORE, PROTESTING AT THESE MEETINGS SERVES NO PURPOSE OTHER THAN WASTING THEIR TIME WHEN THEY COULD BE FOCUSING ON OTHER MATTERS TO BENEFIT MARANA AND THE CITIZENS. THANK YOU FOR YOUR TIME.

BORN CITIZENS. FACT, OVER 70% OF IMMIGRANTS IN DETENTION CENTERS RIGHT NOW HAVE COMMITTED NO CRIMES.
FACT, DONALD TRUMP WAS CONVICTED OF 34 FELONY COUNTS AND A CIVIL TRIAL, FOUND THAT HE SEXUALLY ABUSED, E. JEAN, JEAN CARROLL, AND THEN LIED ABOUT IT.
SO HE IS AN ACTUAL CRIMINAL. FACT, FOR THOSE WHO SAY IMMIGRANTS SHOULD COME HERE THE RIGHT WAY.
THE TRUMP REGIME IS PERSECUTING IMMIGRANTS WHO ARE HERE LEGALLY ALSO, SUCH AS THE HAITIAN COMMUNITY IN MY FATHER'S HOMETOWN OF SPRINGFIELD, OHIO, WHO WERE BROUGHT TO THE U.S. LEGALLY UNDER A PROVISION KNOWN AS TEMPORARY PROTECTED STATUS, WHICH THEY STILL MAINTAIN. I AND OTHERS TOLD YOU THERE WERE ISSUES AND EXPOSURE IN THE ORDINANCE.
YOU DECLINED. MEMBERS CALLED THE CONCERNS SPECULATION AND FEAR MONGERING ON SOCIAL MEDIA PLATFORMS. YOU MOVED FORWARD ANYWAY. THE ORDINANCE IS NOT GOOD ENOUGH, AND TONIGHT I'M HERE TO PUT ON THE RECORD WITH EVIDENCE THAT CANNOT BE DISMISSED.
MARANA'S ORDINANCE DOES NOT REGULATE THE KIND OF NOISE THESE FACILITIES ACTUALLY PRODUCE.
HIGH DENSITY, DRY AIR COOLED DATA CENTERS DO NOT PRODUCE THAT KIND OF NOISE.
THEY PRODUCE LOW FREQUENCY MECHANICAL RUMBLE AND TONAL HUM, SOUND THAT TRAVELS FOR MILES, ESPECIALLY IN THIS PARTICULAR CLIMATE. SOUND THAT PENETRATES WALLS AND WINDOWS, SOUND THAT IS FELT IN YOUR CHEST AS MUCH AS IT'S HEARD WITH YOUR EARS AND SOUND THAT IS VIRTUALLY IMPOSSIBLE TO ELIMINATE ONCE A FACILITY IS OPERATIONAL.
THIS IS NOT THEORY. THIS IS NOT FEAR MONGERING.

I JUST WANT TO THANK ALL OF YOU FOR NOT FALLING VICTIM TO THIS CHILDISH PROPAGANDA, THE EMOTIONAL NONSENSE, THE LIES AND LIES AND MORE LIES NOT JUST ABOUT THE PRIVATE PRISON THAT ICE MAY OR MAY NOT USE, BUT ALSO ABOUT IMMIGRATION AND CUSTOMS ENFORCEMENT, THOSE LAW ENFORCEMENT OFFICERS, AS WELL AS OUR OWN MARANA POLICE DEPARTMENT AND LAW ENFORCEMENT OFFICERS THROUGHOUT THE COUNTRY.
OUR OWN MARANA PD HAS BEEN CALLED UNTRAINED. THEY HAVE BEEN THEY HAVE PEOPLE HAVE SAID THAT THEY'RE NOT GOING TO BE ABLE TO HANDLE HAVING ANY KIND OF FACILITY LIKE THIS ICE FACILITY IN OUR COMMUNITY ICE OFFICERS, OUR POLICE OFFICERS WE USED TO HAVE WHEN I MOVED HERE IN 2010, WE HAD ABOUT A MILLION POLICE OFFICERS IN THE UNITED STATES.
WE'RE DOWN TO ABOUT 750,000. AND I'M GLAD THAT THESE MEN AND WOMEN AT THE MARANA POLICE DEPARTMENT, AS WELL AS IMMIGRATION AND CUSTOMS ENFORCEMENT, CONTINUE TO STAND TO PROTECT ALL OF US HERE IN THE UNITED STATES.
13. THERE IS A 1,300% INCREASE IN ASSAULTS ON ICE AGENTS.
THERE IS A 3,200% INCREASE IN VEHICULAR ATTACKS AGAINST ICE AGENTS, AND AN 8,000% ATTACK ON DEATH THREATS OF ATTACKS ON ICE AGENTS.
AND IN THE LAST 59 DAYS IN THIS COUNTRY, WE HAVE HAD 62 AMERICAN POLICE OFFICERS SHOT.

7 OF THEM WERE KILLED. THAT IS NEARLY ONE A DAY.ATTACKS ON ICE ARE ATTACKS ON THE AMERICAN LAW ENFORCEMENT OFFICER.

YOU JUSTIFIED THE TOWN COUNCIL'S REFUSAL TO DENOUNCE THE CONSTRUCTION OF WHAT WILL BE ONE AMERICA, ONE OF AMERICA'S VERSION OF A CONCENTRATION CAMP, BY SAYING THAT YOU HAD TO OBEY FEDERAL AND STATE LAW. SO I'D LIKE TO SAY SOMETHING ABOUT LAW TODAY.
I'M GOING TO ADDRESS THE TRUTH OF YOUR STATEMENT BY READING AN EXCERPT BY MARTIN LUTHER KING JR'S LETTER FROM A BIRMINGHAM JAIL. AS YOU MIGHT REMEMBER FROM PAST YEARS, OUR FIRST COMPREHENSIVE FEE SCHEDULE DATES BACK TO 2009, AND SINCE THEN WE HAVE COMMITTED TO MAINTAINING AND UPDATING THAT PARTICULAR SCHEDULE.
AND AS ALWAYS, WE TRY TO STREAMLINE OUR FEES WITH THAT IN MIND.
THIS YEAR, WE ARE PROPOSING DURING THIS PROCESS UPDATES TO 46 OF OUR FEES.
WE HAVE ABOUT 12 ADDITIONS, ONE ELIMINATION AND A NUMBER OF CLARIFICATIONS WITH ABOUT 24 INCREASES INCLUDED WITHIN THOSE CLARIFICATIONS. FROM A TIMELINE PERSPECTIVE, THIS IS SOMETHING THAT WE KICK OFF INTERNALLY IN DECEMBER WITH STAFF, AND AT THIS POINT THAT WE'RE COMING TO YOU TO PRESENT THIS INFORMATION AND ASK FOR ANY FEEDBACK OR WELCOME ANY DISCUSSION THAT COUNCIL MEMBERS MIGHT HAVE AS PART OF THAT PROCESS. MOVING ON FROM THERE, WE HAVE A COUPLE OF ITEMS FOR OUR COURTS.
DEVELOPMENT SERVICES HAS FOUR CHANGES. THREE OF THEM ARE CLARIFICATIONS AND1 OF THEM IS AN ADDITION.
THE ADDITION HERE IS SPECIFICALLY FOR REVISIONS.
WE HAVE BEEN SEEING MORE AND MORE REVISIONS TO THIS TYPE OF GRADING PERMIT.
AND NOW THAT WE ARE SPENDING MORE STAFF TIME, WE BASICALLY NEED TO ADD A FEE TO COMPENSATE FOR THAT STAFF TIME THAT IT TAKES TO DO THESE. LOOKING AT THE MARC WE ARE NOW LESS THAN A YEAR.
WE'RE GETTING CLOSER TO A YEAR THAT THE MARC HAS BEEN OPEN AS WE ARE GEARING UP AND WE'RE SEEING WHAT ACTIVITY WE HAVE, WE'RE ALSO NOW TAKING THE OPPORTUNITY TO OFFER MORE PROGRAMS. AND IN OFFERING THOSE PROGRAMS, WE ARE ALSO COMING IN FRONT OF YOU TO SUGGEST THAT WE ADD SOME OF THE LOCATIONS AT THE MARC TO THOSE PROGRAMS THAT ARE BEING OFFERED, AND THEN WE HAVE A FEE FOR THOSE TO BE RENTED OUT, BASICALLY.
AND THEN FINALLY, THE GREATEST NUMBER OF CHANGES IS FOR OUR UTILITY FOR WATER FEES.
IT'S IMPORTANT TO NOTE THAT WHILE THERE ARE THREE SLIDES HERE, I'M NOT GOING TO GO THROUGH ALL OF THEM, THAT THE MAJORITY OF THE FEE UPDATES THAT WE ARE PROPOSING ARE BEING PROPOSED BECAUSE ALL OF THESE FEES HAVE NOT BEEN UPDATED, THE EARLIEST SINCE 2020 AND AS FAR BACK AS 2014.
SO WHAT WE ARE REALLY DOING HERE IS WE ARE JUST COMING BACK, WE'RE PLAYING CATCH UP.
WE'RE RECOGNIZING THAT THE COST OF BOTH OUR LABOR, OUR EMPLOYEES AND THE TIME IT TAKES TO DO WHAT THEY DO AS WELL AS MATERIALS, BECAUSE SOME OF THIS HAS TO DO WITH JUST ACTUAL COST OF THE METERS THEMSELVES NEED TO BE UPDATED TO REFLECT WHAT WE ARE PAYING RIGHT NOW FOR THAT, FOR THAT MATERIAL. PAUL GALES OF GREENBERG TRAURIG AND MR.
