GOOD EVENING, MAYOR, COUNCIL MEMBERS.

MY RESEARCH DURING THE LAST COUPLE OF SPACES HERE THAT I'VE SUBMITTED IS FOCUSED ON THREE CONNECTED ISSUES.

DRY AIR, COOLED.

THERMAL ENVIRONMENTAL IMPACT, EVAPORATIVE COOLING WITH WASTEWATER AND ITS PUBLIC HEALTH IMPACTS, AS WELL AS CRITICAL REGULATORY GAPS AROUND CLOSED-LOOP COOLING SYSTEMS. USING THE URBAN WEATHER GENERATOR, A PEER-REVIEWED MIT-DEVELOPED URBAN MICROCLIMATE MODEL, I CONDUCTED A THERMAL DISPERSION ANALYSIS ON ONE OF THE PROPOSED DATA CENTER LOCATIONS AT THE LUCKETT ROAD COMPLEX AT FULL BUILD-OUT.

AT THE NEAREST SENSITIVE RECEPTOR, THE VETERANS MEMORIAL CEMETERY, LOCATED ACROSS THE STREET FROM THE PROPOSED SITE, THE PROJECTED AMBIENT TEMPERATURE INCREASES SHOWED 5 TO 6 DEGREES FAHRENHEIT ABOVE THE BASELINE IN THE SUMMER, WHICH IS JUST NOTHING THERE IS TODAY, WITH PEAKS AS HIGH AS 30 DEGREES FAHRENHEIT.

THAT'S NOT AN ABSTRACTION.

THE VETERANS MEMORIAL CEMETERY IS A SITE OF ONGOING PUBLIC USE.

FAMILIES, VETERANS ORGANIZATIONS, GROUNDSKEEPING STAFF VISIT REGULARLY, OFTEN DURING THE PEAK.

AFTERNOON HEAT WHEN THE THERMAL PLUME EFFECTS ARE AT THEIR GREATEST.

A FIVE TO SIX DEGREE INCREASE IN AMBIENT TEMPERATURE AT THAT LOCATION SUSTAINED THROUGHOUT THE SUMMER PUSHES CONDITIONS THAT ARE ALREADY DANGEROUS FOR OUTDOOR EXPOSURE INTO A RANGE THAT POSES A CREDIBLE RISK OF HEAT ILLNESS FOR ALL ON SITE.

WHILE THE CURRENT PROJECT PROPOSAL RELIES ON DRY AIR COOLING THERE IS A LOOPHOLE RELATED TO EVAPORATIVE COOLING USING WASTEWATER.

WHILE FINDING THIRD PARTY TO POTENTIALLY PAY FOR WASTEWATER TREATMENT MAY APPEAR ATTRACTIVE, THESE POTENTIAL TOWERS WOULD AEROSOLIZE LARGE VOLUMES OF WATER.

IF THAT WATER IS NOT CONTINUOUSLY TREATED AND MONITORED, THEY POSE A REAL RISK OF LEGIONNAIRE'S DISEASE IN THE AREA.

THIS IS A REAL ISSUE AND IT'S WELL DOCUMENTED ACROSS SCIENTIFIC LITERATURE.

THE ORDINANCE AS WRITTEN CONTAINS NO ENFORCEABLE LEGIONNAIRE'S MONITORING, TREATMENT, DISCLOSURE OR DISCLOSURE REQUIREMENTS.

APPLICABLE TO THE SCALE OF THIS INDUSTRIAL SIZE COOLING OPERATION IF IT WAS TO COME TO PASS.

THIS IS A PUBLIC HEALTH GAP THAT NEEDS TO BE LOOKED AT, NOT A MINOR ADMINISTRATIVE CHANGE IN OPERATION OF THAT FACILITY.

MORE CRITICALLY, THE ORDINANCE'S PERFORMANCE STANDARDS CAN BE AVOIDED ENTIRELY IF A DEVELOPER ELECTS TO ATTEMPT TO USE CLOSED-LOOP COOLING, WHICH THE ORDINANCE TREATS AS CATEGORICALLY EXEMPT FROM THERMAL AND THE WATER USE PROVISIONS.

THERE'S NO REQUIREMENT THAT CLOSED-LOOP COOLING SYSTEMS ACTUALLY DEMONSTRATE REDUCED ENVIRONMENTAL IMPACT.

A DEVELOPER COULD CLAIM THE EXEMPTION, AVOID SCRUTINY,

AND STILL OPERATE THAT INFRASTRUCTURE, WHICH GENERATES SUBSTANTIAL WASTE HEAT, DISRUPTS THE LOCAL AREA CLIMATE, AND POSES SIGNIFICANT CHEMICAL COMPLICATIONS TO THE WATERSHED IN THE AREA.

I'M ASKING THIS BODY TO REQUIRE A FORMAL THERMAL ENVIRONMENTAL IMPACT STUDY AS THE CONDITION OF ANY ZONING APPROVALS FOR DATA CENTERS.

THE COOLING SYSTEM PERFORMANCE STANDARDS, INCLUDING LEGIONNAIRE'S RISKS, MANAGEMENTS AND APPLY ANY OF THIS REGARDLESS OF THE COOLING ARCHITECTURE OF THE FACILITIES PROVIDED.

THEY CREATE OXYGEN, AND THEY EAT CARBON DIOXIDE AND A LOT OF OTHER POLLUTANTS.

IF WE DID NOT HAVE TREES AND GREEN CANOPY ON THIS PLANET, NONE OF US WOULD EXIST.

MARANA IS...

THRIVING IN SO MANY WAYS, AND I THANK ALL OF YOU AND THE LEADERS FOR DOING THAT.

OUR SCHOOLS ARE GREAT.

WE'RE ONE OF THE SAFEST COMMUNITIES IN ARIZONA, IF NOT IN THE WEST.

WE HAVE GREAT HOUSING.

WE HAVE BEAUTIFUL, BEAUTIFUL FAMILIES, AND I SEE THESE FAMILIES ALL THE TIME IN THE SCHOOLS AND THE LIBRARIES WHERE I VOLUNTEER.

AIR QUALITY IS THE SINGLE BIGGEST SHORTFALL WE HAVE IN MARANA, AND I'VE BEEN COMING UP HERE SINCE 1986.

AND I'VE LIVED HERE FOR 10 YEARS.

JUST ON THE WEST SIDE OF THE BIKE LOOP BETWEEN EL RIO PRESERVE AND INA ROAD, WE'VE LOST AT LEAST 15,000 TREES.

AND I FEEL THAT DUST AND THAT NOISE FROM THE FREEWAY AND THE RAILROAD TRACKS.

AND IT'S BECAUSE OF THINGS WE NEEDED.

A WATER LINE, A SEWER LINE, RELOCATING THE RIVER, WHICH MAYBE WE DIDN'T NEED.

WHAT I'M HERE TO ASK IS THAT WE DO A COUPLE OF THINGS.

A, START PROTECTING MORE TREES.

DEVELOPERS HAVE SO MANY GREAT TOOLS NOW.

THERE'S SO MANY SMART WAYS TO DO IT.

SURELY WE DON'T NEED TO JUST BLADE EVERYTHING DOWN.

WE NEED TO KEEP A LOT MORE MATURE VEGETATION.

WE NEED TO SEND OUT THE WATER TRUCKS AND WATER WHEN WE'RE HAVING EXTREME SUMMER DROUGHTS, ESPECIALLY AROUND THE PARKS, AROUND THE SCHOOLS.

HEY.

ANY PLACE WHERE FAMILIES ARE GATHERING, I THINK WE SHOULD FOCUS ON IMPROVING THAT AIR QUALITY BECAUSE THOSE LITTLE LUNGS NEED QUALITY AIR.

AND WE WANT EVERYTHING ELSE TO BE GREAT IN MARANA.

WE CAN HAVE BETTER AIR QUALITY.

THE OTHER GREAT ADVANTAGE IS THE ECONOMIC BENEFIT OF ECOTOURISM.

AND FOREST SERVICE SAYS AVERAGE 300,000 PEOPLE VISIT MARANA.

MADEIRA CANYON EVERY YEAR TO GO BIRDING.

WE ARE IN LOCATION, LOCATION, LOCATION.

WE'VE GOT AT LEAST 11 MILES OF THE SANTA CRUZ RIVER.

WE'VE GOT SAGUARO NATIONAL PARK.

WE'VE GOT IRONWOOD FOREST.

WE GOT THE TORTELLITAS.

WE NEED TO BUILD UP OUR GREEN CANOPY AND OUR NATIVE VEGETATION AND BRING OUR BIRDS BACK AND JUST CAPITALIZE ON BIKING AND BIRDING AND ALL THE WONDERFUL ECOTOURISM THAT PEOPLE WANT TO DO.

WE'VE GOT THE HOUSING AND THE ACCOMMODATIONS THROUGH HOTELS AND RESORTS.

WE NEED TO BUILD THIS OUT.

THE LAST THING I WANT TO TALK ABOUT IS IT'S TIME FOR THE TOWN TO REALLY THINK ABOUT OPENING, CREATING A COMMUNITY FOUNDATION.

WE HAVE HUNDREDS OF THRIVING BUSINESSES.

THEY ALL GIVE CHARITABLY AND HAVE A GREEN RESPONSIBILITY.

THEY WOULD LOVE TO FUND, TO DO GRANTS AND WORK ON PROJECTS.

I'M HERE TONIGHT TO INFORM YOU THAT I TOOK THE INITIATIVE ON MY OWN ACCORD, WITH NO INFLUENCE

FROM ANYONE, AND NOT HIRED BY ANY OUTSIDE AGENCY TO CONDUCT AN ENVIRONMENTAL NOISE LEVEL SURVEY ON OUR VETERANS' CEMETERY PROPERTY.

ADDITIONALLY, I PAID FOR THIS SERVICE OUT OF MY OWN POCKET.

MY MISSION? IS TO EDUCATE OUR COMMUNITY AND VETERANS WHO ARE CONCERNED ABOUT NOISE LEVELS BEING GENERATED BY OUR DATA CENTER THAT COULD INTERFERE WITH THE SERENITY OF OUR CEMETERY.

THIS NOISE SURVEY WAS CONDUCTED ON WEDNESDAY, APRIL 29TH, AROUND 5.15 P.M.

I MET THE TECHNICIAN WHO PERFORMED THE SURVEY AND WALKED AROUND WHILE HE TESTED AREAS NEXT TO I-10 AND WORKED HIS WAY BACK TO THE COMMITTAL SHELTER.

AFTERWARDS, HE SET UP A DEVICE THAT GENERATED...

65 DECIBELS ON LOCKETT ROAD DIRECTLY ACROSS FROM THE ENTRANCE AND MEASURED VARIOUS POINTS ON THE PROPERTY.

I HAVE PROVIDED AN AERIAL VIEW OF THE CEMETERY THAT HAS YELLOW AND RED DOTS THROUGHOUT THE PROPERTY.

THESE ARE AREAS I REQUESTED TO BE MEASURED AND TO SEE HOW NOISE LEVELS WOULD TRAVEL INTO THE CEMETERY.

YELLOW DOTS ARE POINTS MEASURING NOISE LEVELS PRODUCED BY THE 65 DECIBEL GENERATING SOURCE AND THE RED DOTS MEASURED THE NOISE GENERATED FROM THE I-10 TRAFFIC.

I HIRED CSS COMPLIANCE SAFETY SUPPLY WHO ARE BASED OUT OF DENVER, COLORADO.

THE TECHNICIAN WHO PERFORMED THE SURVEY HAS OVER 20 YEARS OF EXPERIENCE WITH THIS TYPE OF TESTING.

THE SPECIFIC MEASUREMENT RESULTS OF THE TEST WON'T BE AVAILABLE FOR AT LEAST ANOTHER WEEK.

HOWEVER, WITH THE TOWN'S PERMISSION, I WOULD LIKE TO PROVIDE ALL THE DETAILS OF THE SURVEY AVAILABLE TO OUR COMMUNITY AND ANYONE OF CONCERN.

I WILL LEAVE IT UP TO THE TOWN ON THE BEST WAY TO MAKE THIS INFORMATION EASILY THE EXPERIENCE.

ACCESSIBLE TO OUR COMMUNITY.

ADDITIONALLY, IF TOWN LEADERSHIP WOULD LIKE ME TO PROVIDE A FOLLOW-UP BRIEF AFTER RECEIVING THE RESULTS AT THE NEXT TOWN MEETING, I WILL DO SO.

IS THIS DETENTION CENTER GOOD FOR THE COMMUNITY OF MARANA? MANY PEOPLE HAVE ALREADY COME BEFORE YOU AND PRESENTED FACTS AND EXAMPLES FROM OTHER COMMUNITIES WHERE DETENTION CENTERS HAVE BROUGHT CONTROVERSY, DIVISION, AND LONG-TERM HARM.

NOT TO MENTION THE DEVASTATION DONE TO THE PEOPLE INTERRED.

YET THE RESPONSE WE KEEP HEARING IS THE SAME.

OUR HANDS ARE TIED.

WE DON'T HAVE A CHOICE.

BUT CHOICE ISN'T THAT SIMPLE.

IT ISN'T FINITE, AND IT ISN'T BINARY.

FROM WHERE MANY OF US ARE STANDING, THIS FEELS LESS LIKE A LACK OF OPTIONS AND MORE LIKE A CRISIS OF IMAGINATION.

YOU'VE SAID YOU CANNOT TELL A PRIVATELY OWNED BUSINESS WHAT TO DO WITH ITS PROPERTY, BUT WE ALL KNOW THAT ISN'T ENTIRELY TRUE.

IF I BOUGHT A PROPERTY HERE AND PROPOSED OPENING AN ADULT ENTERTAINMENT VENUE, THERE WOULD BE IMMEDIATE DISCUSSIONS ABOUT ZONING, PERMITS, UTILITIES, COMMUNITY STANDARDS, ETC.

AND MANY OF THE SAME PEOPLE SUPPORTING THIS DETENTION CENTER WOULD BE STANDING HERE CLUTCHING THEIR PEARLS DEMANDING THAT YOU DO SOMETHING.

AND I DOUBT THE ANSWER WOULD THEN BE, OUR HANDS ARE TIED.

SO THE REAL QUESTION IS NOT WHETHER YOU HAVE THE AUTHORITY, BUT WHETHER YOU ARE WILLING TO FULLY EXPLORE THE AUTHORITY YOU ALREADY HAVE.

YOU'VE ALSO SAID, YOU'RE AFRAID OF BEING SUED.

I UNDERSTAND THAT.

IF THE CONCERN IS LEGAL RISK, THEN WHY NOT MAKE AN OFFER TO PURCHASE THE PROPERTY? IT'S BEEN SUGGESTED.

OR WHY NOT UN-ANNEX THE PROPERTY AND RETURN IT

TO COUNTY JURISDICTION? IF THERE IS TRULY AN ORDINANCE ON THE BOOKS IN THE COUNTY TO STOP PRIVATELY OWNED PRISONS, THEN LET THE COUNTY BE THE ONE TO ADDRESS IT AND BEAR THAT RESPONSIBILITY.

I WANT TO EMPHASIZE THAT PIMA RESISTS ICE HAS NEVER SUGGESTED ANYTHING, ACTION, STEPS, BEHAVIOR, THAT WAS OUTSIDE.

OF THE RULE OF LAW.

WE'VE ABIDED BY THE RULES OF THIS ASSEMBLY AND WE'VE DONE EXTENSIVE RESEARCH IN WAYS BOTH LEGAL AND ADMINISTRATIVE TO PREVENT THE PROPOSED ICE DETENTION CENTER FROM BEING OPENED.

WHAT FEMA RESISTS ICE DOES STAND AGAINST IS PEOPLE WHO VIOLATE RULE OF LAW AND THE POLICIES THAT ARE BEING IMPLEMENTED BY ICE DO JUST THAT.

THEY ARE IN VIOLATION OF U.S.

IMMIGRATION LAWS, AND THEY ARE A BLATANT VIOLATION OF THE CONSTITUTION OF THE UNITED STATES.

THAT IS WHAT PIMA RESIST ICE IS STANDING AGAINST, VIOLATIONS OF RULE OF LAW.

AND I HAD A LOT OF CUSTOMERS THAT HAD INVESTED THEIR PORTFOLIOS BASED ON THAT KIND OF HYPE AND FERVOR THAT WAS IN THE MARKET.

AND OF COURSE, WHEN 2008 HAPPENED, UNFORTUNATELY, THEY WERE ALL IN PRETTY TERRIBLE POSITIONS.

LIKEWISE, DURING THE DOT-COM BUBBLE IN THE 99-2000, THE NASDAQ FELL 80% IN THE COURSE OF ABOUT NINE MONTHS.

I'VE BEEN HERE BEFORE TO TALK ABOUT THE AI BUBBLE, AND I WANT TO TALK ABOUT IT AGAIN.

ROUGHLY 80% OF THE DOLLAR VALUE GAINS IN THE S&P 500 RIGHT NOW ARE BEING DRIVEN BY JUST FIVE COMPANIES.

OUR TAX BASE IS OVERLY CONCENTRATED IN SALES TAX, CONSTRUCTION TAX, AND DURING THE 2008 FINANCIAL CRISIS, IF YOU LOOK AT WHAT HAPPENED TO MARANA'S BUDGET, IT WASN'T PRETTY.

SO I WOULD ENCOURAGE YOU TO EXPLORE WAYS TO DIVERSIFY THE TAX BASE.

I AM VERY WORRIED AT THIS POINT THAT MARANA'S BUDGET AND MARANA'S ECONOMY ARE BASICALLY UNDERPINNED BY TWO SOURCES OF REVENUE THAT IN THE EVENT THAT THIS AI BUBBLE BURSTS, AND WE DON'T HAVE ENOUGH COPPER ON EARTH TO BUILD ENOUGH DATA CENTERS TO KEEP THIS BUBBLE FROM BURSTING.

WE WOULD HAVE TO MINE AS MUCH COPPER IN THE NEXT 10 YEARS AS WE HAVE IN THE LAST 10,000 YEARS.

THE COST OF MINING COPPER HAS GONE UP 50% SINCE 2020.

WE WILL NOT GENERATE $10 TRILLION WORTH OF DEMAND FOR AI BY 2030 AS WE NEED TO TO KEEP THIS BUBBLE INFLATED.

THEY WERE THAT CLOSE, MAYBE CLOSER.

AND BEAUTIFUL HOMES, BEAUTIFUL NEIGHBORHOOD.

SO FAIRLY CLOSE.

AND WE WALKED AROUND THIS DATA CENTER AND BRETT HAD A SOUND MEASURING DEVICE AND HE MEASURED THE SOUND AND IT WAS 60 DECIBELS NEXT TO THE APARTMENTS ACROSS THE STREET FROM THIS DATA CENTER.

THERE WAS REAL, NO REAL, I MEAN, THEY HAD A CRANE OUT THERE THAT, YOU KNOW, WAS RUNNING AT VARIOUS TIMES AND WHEN IT SHUT OFF, IT GOT PRETTY QUIET AND WE COULDN'T REALLY HEAR ANYTHING.

WE WALKED UP THE STREET.

AND THERE WAS ANOTHER DATA CENTER THAT WAS MAKING A LITTLE BIT OF NOISE.

PART OF THIS REQUIREMENT IS COMMUNITY PARTICIPATION.

COMMUNITY INPUT IS OF COURSE VERY IMPORTANT IN DECIDING HOW TO SPEND THESE FUNDS AND SO WE HAVE TWO COMMUNITY MEETINGS PRIOR TO THE DRAFT.

AFTER THOSE MEETINGS WE CREATE THE DRAFT AND THEN WE PUT IT OUT FOR A 30-DAY COMMENT PERIOD.

AND WITHIN THAT TIME, WE HOLD TWO PUBLIC HEARINGS.

AND THEN, OF COURSE, TONIGHT'S MEETING WOULD BE THE THIRD COMMUNITY MEETING.

OUR HOUSING REHABILITATION PROGRAM IS A LONG-STANDING PROGRAM.

THIS PROGRAM SPECIFICALLY FOR OUR ELIGIBLE CLIENTS PROVIDES HOME REPAIR SERVICES SUCH AS ROOF REPAIR, HVAC UNITS.

WATER HEATERS, ELECTRICAL UPGRADES, THINGS LIKE THAT.

OUR UTILITY ASSISTANCE PROGRAM IS A NEWER PROGRAM THAT WE'VE DONE FOR THE LAST PROBABLY TWO YEARS, AND IT IS FOR ELIGIBLE RESIDENTS.

IT PROVIDES UP TO $500 ONE TIME PER YEAR TO UTILITIES, ESSENTIAL UTILITIES, WHICH WE CLASSIFY AS GAS, WATER, AND ELECTRIC.

THE NEXT FUND BUCKET IS OUR ADMINISTRATION.

THIS COVERS...

SOME STAFFING, SALARY, AS WELL AS CONSULTING, AS WELL AS OUR ONLINE APPLICATION SOFTWARE.

AND THEN OUR NEIGHBORHOOD CLEANUP IS ACTUALLY MONEY THAT'S ROLLED OVER FROM OUR PROGRAM YEAR 23, SO MONEY THAT'S JUST ROLLED OVER.

THIS PROVIDES DUMPSTERS TO SOME OF OUR NEIGHBORHOODS THAT JUST PROVIDES AN OPPORTUNITY FOR THEM TO KEEP THEIR NEIGHBORHOODS CLEAN AND CLEAR.

MOVING ON TO THIS CURRENT, THIS NEXT PROGRAM YEAR OF 26, WE RECEIVED $223,434.

OUR UTILITY ASSISTANCE ALSO HAS A CAP, UNFORTUNATELY, OF 15% OF OUR TOTAL ALLOCATION, SO THAT'S $33,515.

OUR HOME REHAB PROGRAM...

WE ARE PROPOSING TO PUT IN ABOUT $75,233.

THAT'S OBVIOUSLY QUITE A SIGNIFICANT DECREASE FROM YEARS PAST, BUT I DO WANT TO NOTE THAT JUST LIKE THE NEIGHBORHOOD CLEANUP PROGRAM THAT HAS ROLLOVER MONEY, WE HAVE LOTS OF ROLLOVER FUNDS FOR HOME REPAIR FROM PREVIOUS YEARS.

SO I DON'T ANTICIPATE THIS DECREASE THIS YEAR AFFECTING OUR ABILITY TO HELP OUR RESIDENTS AT ALL.

AND THEN A NEW PROJECT THAT WE'RE PROPOSING IS A PARKS ADA ACCESSIBILITY ASSESSMENT IN THE AMOUNT OF $70,000.

AS WELL.

SO I'M GOING TO TALK FIRST ABOUT THE CLARK FARMS BOULEVARD REIMBURSEMENT.

THIS PROJECT IS INCLUDED IN THE TOWN'S 2022 STREETS INFRASTRUCTURE IMPROVEMENT PROGRAM, SO IT'S PART OF OUR IMPACT FEE PROGRAM.

AND THE CHART UP HERE ON THE TOP OF THE, YOU KNOW, ABOVE THE MAP HERE IS A CLIP FROM THAT 2022 STREETS IIP, AND IT BREAKS DOWN THE PROJECT INTO TWO PARTS HERE.

CLARK FARMS FROM DESPAIN DRIVE TO LON ADAMS ROAD, WHICH IS THE ORANGE PART HERE, HAS A VALUE OF ABOUT $3.3 MILLION.

AND THEN THE PORTION THAT THE MONARCH DEVELOPER IS BUILDING OF THE NEXT SEGMENT HERE, LON ADAMS ROAD TO MOORE ROAD, HAS A VALUE OF ABOUT $6.1 MILLION.

SO THE DEVELOPER IS ENTITLED TO IMPACT FEE REIMBURSEMENTS FOR PROVIDING THE ROAD PURSUANT TO THE...

THE IIP.

HOWEVER, THE LITTLE OVER $9.5 MILLION, THEY WOULDN'T ACTUALLY RECEIVE IN JUST IMPACT FEE REIMBURSEMENTS.

THE IMPACT FEE REIMBURSEMENTS DOESN'T EVEN GET THEM HALFWAY TO $9.5 MILLION BASED ON THE NUMBER OF EDUS THAT THEY PLAN TO HAVE IN THEIR DEVELOPMENT.

SO THE PROPOSAL IN AND THE SECOND AMENDMENT IS TO ALSO USE CONSTRUCTION SALES TAX REVENUES THAT ARE GENERATED FROM THE MONARCH DEVELOPMENT 75% OF THOSE CONSTRUCTION SALES TAX REVENUES TO ALSO REIMBURSE THE DEVELOPER UP TO THE AMOUNT OF THE NINE POINT FIVE MILLION DOLLARS AND IT'S A LITTLE BIT MORE THAN NINE POINT FIVE MILLION DOLLARS SO THAT IS THE FIRST PROPOSAL OF THE AGREEMENT AND I GUESS I COULD SEE IF THERE'S ANY QUESTIONS ABOUT CLARK FARMS BOULEVARD AND THE REIMBURSEMENT THERE ALL RIGHT, THEN I WILL MOVE ON TO THE SEWER.

SO THERE IS A PROJECT LISTED WITHIN THE 2022 SEWER IIP INFRASTRUCTURE IMPROVEMENTS PLAN.

IT'S LISTED AS IMPROVEMENT NUMBER 10, AND IT IS A 15-INCH GRAVITY SEWER PIPE.

AND IT HAS A DIFFERENT ALIGNMENT THAN WHAT WE'RE PROPOSING AT THIS POINT.

IN THE IIP FROM 2022, THE ALIGNMENT GOES BASICALLY ALONG MOORE ROAD AND THEN UP LAWTON ADAMS ROAD TO CLARK FARMS BOULEVARD.

BUT WITH THE UPDATE TO THE SEWER MASTER PLAN AND THROUGH DISCUSSIONS BETWEEN OUR WATER DEPARTMENT STAFF AND THE DEVELOPER, WE ARE PROPOSING TO CHANGE THAT ALIGNMENT SO THAT THE SEWER LINE WILL RUN JUST THROUGH THE CLARK FARMS BOULEVARD ALIGNMENT.

AND IT ALSO NEEDS TO BE UPSIZED FROM THE 15-INCH THAT WAS IN THE 2022 IIP TO A 21-INCH IN THE MONARCH DEVELOPMENT.

WE WILL BE BRINGING, ASSUMING THIS IS APPROVED, WE WILL BE BRINGING BACK TO THE COUNCIL AN AMENDMENT TO THAT 2022 SEWER IIP TO CHANGE THE ALIGNMENT OF THAT ONE PROJECT, TO UPDATE THE COST FOR THAT PROJECT, AND OF COURSE ALSO...

TO CHANGE THE SIZE FROM THE 15 INCH TO THE 21 INCH.

THE DEVELOPER HAS BUILT THE PORTION OF THAT LINE THAT IS IN THIS SECTION THAT I'M KIND OF POINTING AT HERE OF CLARK FARMS BOULEVARD WHICH WAS CLARK FARMS BOULEVARD PHASE THEY'VE DONE THAT PURSUANT TO THEIR WATER SERVICE AGREEMENT THAT THEY HAVE WITH US AND THEN THIS SECTION THAT GOES FROM KIND OF WHERE BLOCK SIX AND BLOCK SEVEN INTERSECT HERE DOWN TO THE MORE ROAD ALIGNMENT WILL BE COMING AS THE ROAD IS DEVELOPED.

AND THAT COST IS ABOUT $1.4 MILLION.

AND THAT'S WHAT WE WOULD BE PUTTING INTO THE NEW, THE AMENDED 2022 SEWER IEP THAT WE'LL BRING BACK TO YOU.

AND PURSUANT TO THIS, DEVELOPMENT AGREEMENT AMENDMENT AND STATE LAW, THE DEVELOPER WOULD RECEIVE IMPACT FEE CREDITS FOR THAT $1.4

THEY'VE GOT OPEN TRENCHES THERE THAT WE ADVISE THEM IF THEY DON'T GIVE US AN UPDATE ON THE PROGRESS, WE WOULD PROBABLY START THE PROCESS OF DRAWING ON A BOND TO CLEAN UP THE SITE.

THEY RESPONDED BACK THAT KFC IS GOING TO BE.

PAYING THEIR BUILDING PERMITS HOPEFULLY SOMETIME WITHIN THE NEXT WEEK AND THEY ANTICIPATE ON STARTING CONSTRUCTION ON THAT THE FIRST WEEK OF FIRST WEEK OF JUNE.

IT DIFFERS FROM WHAT HER WISHES OR WHAT SHE BELIEVES THE NEEDS ARE FOR ARIZONA IN A NUMBER OF KEY AREAS.

IN THE BUDGET THAT'S ON OUR DESK, THERE'S 5% CUTS ACROSS MOST STATE DEPARTMENTS EXCEPT FOR PUBLIC SAFETY AND SOME OF THE HEALTH AND WELFARE FOR COMMUNITY SERVICES.

THERE'S SIGNIFICANT TAX REFORM THAT SHE'S CONCERNED ABOUT, ALONG WITH OTHER MEASURES THAT ARE INCLUDED WITHIN THAT BUDGET. SO IT'S WIDELY EXPECTED THAT SHE'S GOING TO VETO IT SOON. BUT AS OF TODAY, THAT HASN'T HAPPENED.
